Transcript
- 0:01Speaker 1: Welcome.
- 0:01Speaker 2: It is verdict to a Senator Ted Cruz ben Ferguson
- 0:04Speaker 2: with you, Senator, it's a headline and I'm going to
- 0:06Speaker 2: read it verbatim. Prostitution rings and a lot of money.
- 0:12Speaker 2: That is what Representative Nancy Mace described the bank reports
- 0:16Speaker 2: on the Biden family business dealing. She got to see
- 0:19Speaker 2: these reports, these suspicious activity reports. She made it very
- 0:23Speaker 2: clear how shocked she was when she left the Treasury,
- 0:26Speaker 2: and this is what she said.
- 0:28Speaker 3: Jess left the Treasury to review over one hundred suspicious
- 0:33Speaker 3: activity reports on the Biden family, and I have to
- 0:36Speaker 3: tell you there are more Biden's involved than we knew previously.
- 0:41Speaker 3: And every time you unturn, overturn.
- 0:44Speaker 4: Or look under a stone, there's so much more you.
- 0:47Speaker 3: Have to investigate because it's while the number.
- 0:51Speaker 4: Of family members involved, and it's even the amount of
- 0:55Speaker 4: money that we're talking about in these suspicious activity reports
- 0:59Speaker 4: is astro nomical, and the accusations there and the source
- 1:03Speaker 4: of the funding, where the money is going, the shell
- 1:06Speaker 4: company's prostitution rings, et cetera. It's insandydy to me that
- 1:12Speaker 4: has not been investigated and the way that.
- 1:15Speaker 5: It should be.
- 1:17Speaker 2: Senaer, you hear that and that's not even the full headline.
- 1:20Speaker 2: The other headline is six additional Biden family members may
- 1:24Speaker 2: have been benefiting from Hunter Biden, Joe Biden, James Biden's
- 1:27Speaker 2: business dealings.
- 1:29Speaker 1: That's a lot your reaction.
- 1:33Speaker 5: Look, I think this is astonishing.
- 1:37Speaker 6: Ask yourself at home, in what universe would you say
- 1:42Speaker 6: that six or more members of your family are profiting
- 1:47Speaker 6: from communist China? Are making millions of dollars from communist China.
- 1:52Speaker 6: I want you to pause and think how unusual this is. Maybe, Look,
- 1:56Speaker 6: you have one cousin who has or know a car
- 2:01Speaker 6: repair business.
- 2:02Speaker 5: That's a little shady.
- 2:02Speaker 6: I'm just trying to hypothesize here, But six family members
- 2:09Speaker 6: on the take from the communist Chinese government to the
- 2:14Speaker 6: tunes of millions of dollars. Do you know anyone for
- 2:19Speaker 6: whom that's the case?
- 2:20Speaker 5: I don't. Look.
- 2:22Speaker 6: I serve in the United States Senate. I think it
- 2:23Speaker 6: would be weird if any of my colleagues had six
- 2:26Speaker 6: family members making millions of dollars from communist China. There
- 2:30Speaker 6: are one hundred Senators, to the best of my knowledge,
- 2:33Speaker 6: zero of them are.
- 2:35Speaker 5: In that business.
- 2:37Speaker 6: The fact that the Bidens, by all appearances, had a
- 2:40Speaker 6: family business and the family business everyone for six family members.
- 2:44Speaker 6: I don't know uncle Fester. I don't even know who's
- 2:47Speaker 6: who the six are. They haven't released the six. But
- 2:50Speaker 6: apparently the entire collective family business is you know, put
- 2:55Speaker 6: at birth on the take. You know, the Chinese will
- 2:57Speaker 6: pay her one hundred thousand dollars. Like it's at this point,
- 3:01Speaker 6: it's getting ridiculous. And I got to say, so, Nancy Mace,
- 3:06Speaker 6: congresswoman from South Carolina, that's who you just played. A
- 3:11Speaker 6: second ago. She had just left the Treasury Department. She
- 3:13Speaker 6: was reading suspicious activity reports. I gotta say the words
- 3:18Speaker 6: that are most remarkable that you just played. She says,
- 3:21Speaker 6: prostitution rings, et cetera. What yeah, Like okay, like the etc.
- 3:31Speaker 6: What's in the et cetera? Like I'm sorry, do you
- 3:36Speaker 6: know anyone who is in the business of running prostitution
- 3:39Speaker 6: rings or profiting from prostitution rings? Like I don't know
- 3:43Speaker 6: what the evidence.
- 3:44Speaker 5: Is, but holy crap.
- 3:47Speaker 6: If she's saying that Joe Biden's family is personally profiting
- 3:51Speaker 6: from prostitution rings. Now, to be clear, I have not
- 3:54Speaker 6: seen this evidence, so I am commenting on what congress
- 4:00Speaker 6: woman may said publicly. But if there is evidence that
- 4:04Speaker 6: the president's family is personally profiting from prostitution rings. And
- 4:08Speaker 6: I don't know if those prostitution rings are connected to
- 4:10Speaker 6: China or not. But you want to talk about bombshell,
- 4:16Speaker 6: and you know what's not happening tonight. It's not going
- 4:20Speaker 6: to be on six o'clock news.
- 4:22Speaker 5: ABC.
- 4:23Speaker 6: I'm gonna wager you one hundred dollars right now, Ben.
- 4:26Speaker 6: ABC will not run this, NBC will not run the
- 4:28Speaker 6: CBS will not run that. Will you take the bet?
- 4:30Speaker 1: Hunter bucks? Now, I'm not.
- 4:31Speaker 2: I don't take tubid bets because you and I both
- 4:33Speaker 2: know there's no way that they would ever report on
- 4:36Speaker 2: six additional Biden family members on the take.
- 4:39Speaker 1: And there is another part.
- 4:40Speaker 6: But wait a second, ABCNBC, and CBS all reported on
- 4:43Speaker 6: the Steel dossier. That was one drunk guy in Europe
- 4:47Speaker 6: that claimed that prostitutes like to urinate on Donald Trump.
- 4:50Speaker 6: So that story, with no basis, no evidence, and now
- 4:55Speaker 6: thoroughly discredited, every network reported on. But here, if I'm
- 5:01Speaker 6: understanding what Congresswoman Mace is saying correctly, there are reports
- 5:06Speaker 6: in the US Department of Treasury that indicate that the
- 5:09Speaker 6: Biden family is directly profiting from prostitution rings, presumably connected
- 5:15Speaker 6: to China in some way, and no one will report
- 5:18Speaker 6: on that, Like what.
- 5:22Speaker 2: This is the this is the media that we now have.
- 5:25Speaker 2: They deliberately are working, I would say, for the Democratic
- 5:28Speaker 2: Communist Party. And there's another question here, Senator that I
- 5:32Speaker 2: think you and I need to help people connect these dots.
- 5:36Speaker 2: Before we found out about these six additional Biden family members'
- 5:40Speaker 2: names Hunter, Biden, and just and we don't know the six.
- 5:44Speaker 6: We don't know six, six, we knew three. So James Comber,
- 5:48Speaker 6: the chairman of the.
- 5:49Speaker 2: COMPS, well, this is nine now, right, total of nine.
- 5:51Speaker 2: I want to make sure we understand that for everybody listening,
- 5:53Speaker 2: this is nine official Biden family members that are now
- 5:57Speaker 2: connected with suspicious activity reports the Treasury Department.
- 6:01Speaker 6: So what James Comer said is the panel has identified
- 6:04Speaker 6: six additional members of Joe Biden's family who may have
- 6:07Speaker 6: benefited from the Biden family's businesses that we are investigating,
- 6:11Speaker 6: bringing the total number of those involved or benefiting to nine.
- 6:15Speaker 6: Like nine, Like is the dog fluffy on the take?
- 6:19Speaker 6: Like how do you find nine family members and have
- 6:24Speaker 6: them all cashing a check from communist China?
- 6:27Speaker 2: That's astonishing, well, and this goes back to the question
- 6:32Speaker 2: that Hunter Biden and his direct associates. Okay, visit the
- 6:36Speaker 2: Obama White House, and this isn't you know where the
- 6:40Speaker 2: vice president lived, This isn't in Delaware. This is just
- 6:43Speaker 2: the actual White House we know of eighty plus times.
- 6:46Speaker 6: And hold on, this is not the White House when
- 6:48Speaker 6: Joe Biden was president. This is the White House when
- 6:51Speaker 6: Joe Biden was vice president. So he lived at the
- 6:53Speaker 6: Naval Observatory, which is a different residence. It's about twenty
- 6:57Speaker 6: minutes away from the White House. And yet apparently all
- 7:02Speaker 6: of Hunter's business partners were going in and out and
- 7:04Speaker 6: in and out of the Obama White House, meeting with
- 7:07Speaker 6: senior officials. And the Biden White House won't tell us
- 7:10Speaker 6: who they met with. They won't tell us how many
- 7:13Speaker 6: times Joe Biden met with them personally. They won't tell
- 7:15Speaker 6: them how many times Joe Biden's staff met with them personally.
- 7:18Speaker 6: But listen, if it's all of Hunter's business partners, there's
- 7:22Speaker 6: no reason to think they're just coming to visit the
- 7:25Speaker 6: Social Secretary because they want to help arrange the flowers
- 7:28Speaker 6: for the French State dinner. They're there to do business
- 7:33Speaker 6: when you get five, I'm sorry, not five, nine family
- 7:38Speaker 6: members being paid by communists China. They're getting paid for something.
- 7:44Speaker 1: Yeah.
- 7:45Speaker 2: Well, and my question is when you add these new
- 7:47Speaker 2: names and centator if eighty meetings at the we what
- 7:52Speaker 2: were connected to Hunter Biden and all right and the
- 7:54Speaker 2: vice president at the White House meeting at the White House?
- 7:58Speaker 2: What does that number now go to if you have
- 8:00Speaker 2: another six family members that apparently, from what we understand,
- 8:03Speaker 2: probably had the same exact access to bringing in their
- 8:06Speaker 2: business associates into the White House.
- 8:09Speaker 5: All right, I'm going to make an official call right now.
- 8:12Speaker 6: The US Department of Treasury needs to release every single
- 8:16Speaker 6: suspicious activity report.
- 8:18Speaker 5: On the Biden family. Janet Yellen, you have a choice.
- 8:23Speaker 6: You are either actively covering up potential evidence of corruption
- 8:28Speaker 6: or release every one of them to the American people.
- 8:31Speaker 6: If of the nine Biden family members profiting off communist China,
- 8:36Speaker 6: let the American people decide if this is benign. Release
- 8:39Speaker 6: the reports. When we've got members of Congress seeing these
- 8:43Speaker 6: reports who are horrified, who are appalled, they're going, holy cow,
- 8:47Speaker 6: how is there so much money flowing from China? Janet
- 8:50Speaker 6: Yellen has a choice right now. She is not innocent
- 8:54Speaker 6: in this. Now, there's no evidence that Janet Yellen was
- 8:57Speaker 6: part and parcel of the Biden family business offening off
- 9:00Speaker 6: communists China. But if she doesn't release those reports, she
- 9:05Speaker 6: is complicit in the cover up. So Secretary Yellen release
- 9:11Speaker 6: every single suspicious activity report on the Biden family. There's
- 9:15Speaker 6: no national security reason to keep them private. There's no
- 9:18Speaker 6: reason whatsoever other than if you want to be part
- 9:23Speaker 6: of a political cover up.
- 9:24Speaker 1: Yeah, it's a great point.
- 9:25Speaker 2: I want to ask you about the Treasury Department and
- 9:27Speaker 2: is it supposed to be a non political because it's
- 9:31Speaker 2: clear I think too many of the American people what
- 9:33Speaker 2: is acting politically right now. Before I get to that,
- 9:35Speaker 2: I want to tell you about our friends over at

- 10:55Speaker 2: Mobile dot com slash verdict. Senator, let's talk about Treasury
- 10:59Speaker 2: for a second here, because I think the history now
- 11:01Speaker 2: of how this has played out is extremely important. The
- 11:04Speaker 2: Treasury Department used to allow any of you in Congress
- 11:07Speaker 2: to see suspicious activity reports based on the reporting then
- 11:12Speaker 2: when Democrats had controlled the House and the Senate. The
- 11:14Speaker 2: Treasury changed the ruin said well, you've got to have
- 11:17Speaker 2: a Democrat that wants to go with you to see them,
- 11:20Speaker 2: and then we'll release them. That's how they protected the
- 11:23Speaker 2: Biden crime family. And now only after Republicans were able
- 11:27Speaker 2: to regain control of the House were we able to
- 11:30Speaker 2: see these reports which we should have been able to
- 11:32Speaker 2: see two years ago or more.
- 11:35Speaker 6: Well, listen, there's a broader pattern of this, which is
- 11:38Speaker 6: the Biden administration is trying to keep as much classified
- 11:42Speaker 6: as possible, as much secret as possible, as much hidden
- 11:45Speaker 6: as possible. There's an irony. Joe Biden campaigned promising to
- 11:49Speaker 6: be the most transparent administration ever. We're now two years
- 11:54Speaker 6: and three months into it, and this is the least
- 11:58Speaker 6: transparent administration ever. Think about it for a second. We
- 12:04Speaker 6: know that classified documents were discovered at Donald Trump's home,
- 12:09Speaker 6: at Joe Biden's home, multiple homes, at Mike pensis home.
- 12:14Speaker 6: We know that Joe Biden was sticking it classified documents
- 12:18Speaker 6: virtually everywhere, including in the garage next to his vintage corvette.
- 12:24Speaker 6: You know what I don't know right now. I have
- 12:27Speaker 6: no idea what classified documents any of the three of
- 12:32Speaker 6: them had. I don't know what Trump had, I don't
- 12:34Speaker 6: know what Biden had, I don't.
- 12:34Speaker 5: Know what Pence had.
- 12:36Speaker 6: Now there's a reason I don't know, which is the
- 12:38Speaker 6: Biden administration won't tell members of Congress. Initially they stonewall.
- 12:42Speaker 6: They said, nobody can know. We're not going to tell anybody.
- 12:45Speaker 6: And their ridiculous explanation was, well, we might be bringing
- 12:51Speaker 6: Department of Justice prosecutions, so we don't want to tell
- 12:54Speaker 6: anyone in Congress anything about anything because.
- 12:57Speaker 5: We might be bringing DOJ prosecutions. That's absurd.
- 13:01Speaker 6: Congress has a very legitimate and important role to ensure
- 13:05Speaker 6: that classified materials are protected. To understand what kind of
- 13:11Speaker 6: classified materials we're at Trump's home, Biden's home, Pensis home.
- 13:17Speaker 1: Were they so?
- 13:18Speaker 6: Look, I've read a lot of classified materials in my
- 13:20Speaker 6: eleven years in the Senate. There are some classified materials
- 13:24Speaker 6: I've read that are so banal, that have so little
- 13:28Speaker 6: insight you could read them in a thoroughly mediocre op
- 13:32Speaker 6: ed in the New York Times. There are others that
- 13:35Speaker 6: are really serious. If you want an intelligence assessment on
- 13:40Speaker 6: how many nuclear weapons we have in a particular location,
- 13:44Speaker 6: or the vulnerability of our troops to a particular kind
- 13:48Speaker 6: of attack, or if you have materials that are based
- 13:52Speaker 6: on covert sources someone close in the orbit of She
- 13:58Speaker 6: and China or Putin in Russia, and we have a
- 14:01Speaker 6: spy that we flipped someone on their staff and they've
- 14:05Speaker 6: given us internal information. That's the kind of classified information
- 14:09Speaker 6: that's incredibly dangerous. That's the kind of classified information that,
- 14:13Speaker 6: if made public, can endanger or even cost the lives
- 14:21Speaker 6: of people who have decided to help the US intelligence agencies.
- 14:27Speaker 6: We don't know what category of classified materials were at Trump's, Pence's,
- 14:33Speaker 6: and Biden's homes.
- 14:36Speaker 5: We ought to know.
- 14:38Speaker 6: Initially, the Biden administration said, we will tell nobody. Hell no,
- 14:41Speaker 6: Our answer is no. Actually, this is one of the
- 14:45Speaker 6: few areas where Senate Democrats were quite strong. Mark Warner,
- 14:49Speaker 6: who's the chairman of the Intelligence Committee, and Marco Rubio,
- 14:51Speaker 6: who's the ranking member of the Intelligence Committee. Both of
- 14:54Speaker 6: them said, this is ridiculous. We want to see the documents.
- 14:58Speaker 6: Where are we now? The Biden administration said they will
- 15:02Speaker 6: tell the Gang of eight. Now, the Gang of eight
- 15:06Speaker 6: is the majority leader and the Minority leader of the Senate,
- 15:10Speaker 6: the Speaker, and the Minority Leader of the House, the
- 15:14Speaker 6: chairman and ranking member of the Senate Intelligence Committee, and
- 15:17Speaker 6: the chairman and ranking member of the House Intelligence Committee.
- 15:19Speaker 5: That's eight people.
- 15:21Speaker 6: They have made some of those documents available to that
- 15:25Speaker 6: gang of eight, not all of them, but some of them.
- 15:28Speaker 6: They won't make them available to the rest of us. Now,
- 15:33Speaker 6: I have to tell you I talked today with Marco Rubio,
- 15:36Speaker 6: the ranking member of the Intelligence Committee, is one of
- 15:38Speaker 6: the Gang of eight.
- 15:39Speaker 5: He's seen them.
- 15:40Speaker 6: He said that the documents are overwhelmingly, if not entirely,
- 15:45Speaker 6: the kind of documents that every member of Congress has
- 15:48Speaker 6: the security clearance to see. If that's true, why are
- 15:52Speaker 6: they hiding them. They're hiding them for political reasons. Why
- 15:57Speaker 6: are they hiding the suspicious activity report on the Biden
- 16:00Speaker 6: family for political reasons? This is not national security, it's
- 16:04Speaker 6: not anything else. And you asked a minute ago, should
- 16:08Speaker 6: the Treasury Department be nonpartisan? Look, not entirely. A president
- 16:14Speaker 6: is entitled to a Secretary of Treasury who shares his
- 16:19Speaker 6: or her partisan ideological views. So if you're a big
- 16:22Speaker 6: government Democrat, you're entitled to have a Treasury secretary who
- 16:27Speaker 6: wants to tax the hell out of the American people
- 16:29Speaker 6: and crush them under the boot of the irs. It's
- 16:31Speaker 6: not good for America, but it is democracy, and you're
- 16:35Speaker 6: entitled to have a Treasury secretary who reflects your policy views. Likewise,
- 16:40Speaker 6: if you're a publican who believes in lower taxes, who
- 16:43Speaker 6: believes in limited government, you're entitled to have a Treasury
- 16:46Speaker 6: secretary who believes in who advocates for lower taxes, simplifying
- 16:51Speaker 6: the tax code, lessening the regulations that are destroying jobs.
- 16:55Speaker 6: So all of those are legitimate. There is an aspect
- 16:58Speaker 6: of Treasury secretary that is policy that is political, that
- 17:03Speaker 6: is legitimately partisan. What is not legitimately partisan is there
- 17:08Speaker 6: is an aspect of the treasure of Secretary's authority that
- 17:11Speaker 6: is law enforcement. And law enforcement, like the intelligence community,
- 17:15Speaker 6: is designed to be nonpartisan. It's designed to be a
- 17:19Speaker 6: political suspicious activity. Reports are not meant to be oppo
- 17:24Speaker 6: research that if your political opponent generates one, okay, this
- 17:28Speaker 6: is great, leak it to the press and let's go
- 17:31Speaker 6: smear them. If your political ally generates one, cover it
- 17:35Speaker 6: up and hide it, because the objective is protect your
- 17:37Speaker 6: political ally. That is what's not appropriate is the law
- 17:41Speaker 6: enforcement component of Treasury should be non political. And given
- 17:46Speaker 6: that we now have multiple House members who reviewed these
- 17:49Speaker 6: suspicious activity reports who said they're damning, who said, holy crap.
- 17:55Speaker 6: Nine Biden family members making money ostensibly from communists, some
- 18:01Speaker 6: at least, according to Congresswoman Mace profiting off of prostitution.
- 18:07Speaker 6: Rings like I'm sorry, every American has a right to
- 18:12Speaker 6: see those reports and assess. And you know what's fascinating
- 18:15Speaker 6: the fact that the press doesn't give a damn. Maggie Hagerman.
- 18:19Speaker 6: You're at the New York Times. You claim to be
- 18:22Speaker 6: a real journalist. Go find these suspicious activity reports. Write
- 18:26Speaker 6: them on the front page of the New York Times.
- 18:29Speaker 6: You don't want to, because the New York Times views
- 18:32Speaker 6: its job as being the political protectors for Joe Biden,
- 18:36Speaker 6: not actually the paper of record reporting on news.
- 18:39Speaker 2: It is shocking to see how much they will just
- 18:42Speaker 2: completely refuse to do their job, even when this is
- 18:46Speaker 2: maybe one of the biggest stories we've ever seen in
- 18:48Speaker 2: political history to hit a White House with six additional
- 18:53Speaker 2: Biden family members that apparently were benefiting from nine business dealings.
- 18:58Speaker 2: Nine total benefit for the business dealings of selling out
- 19:02Speaker 2: basically access to the United States government and favors that
- 19:05Speaker 2: may be needed. And now the question is Senator, and
- 19:08Speaker 2: this is my last question before we move on to
- 19:10Speaker 2: some other news.
- 19:12Speaker 1: How confident are you now.
- 19:14Speaker 2: In Joe Biden's ability to be the president when it
- 19:18Speaker 2: comes to just being compromised by money that came in
- 19:22Speaker 2: from Russian oligarchs and from the Chinese and other countries
- 19:25Speaker 2: around the world. I am terrified that he has compromised.
- 19:29Speaker 2: And I ask you that because it was it was
- 19:31Speaker 2: a very different moment today that connects back to this.
- 19:35Speaker 2: The former Director of National Intelligence, John Radcliffe, someone a
- 19:41Speaker 2: friend of yours and mine, says that there is overwhelming
- 19:45Speaker 2: evidence that COVID was created in the Wuhan lab, and
- 19:47Speaker 2: yet this president refuses to confront that issue with the Chinese,
- 19:52Speaker 2: and it may be because he and his family are
- 19:56Speaker 2: so compromised by the Chinese. Listen to John Radcliffe thoughts today.
- 20:01Speaker 7: Every day that passes makes it less likely that there's
- 20:04Speaker 7: anything that will ever tie this to nature, Whereas on
- 20:08Speaker 7: the other side of the ledger, it's overwhelming when you
- 20:11Speaker 7: look at China's actions and the circumstances surrounding what was
- 20:16Speaker 7: going on from a biosafety standpoint at Wuhan, the massive
- 20:20Speaker 7: number of coronaviruses, the massive numbers of that's carrying coronaviruses
- 20:26Speaker 7: that were brought into Wuhan, all of that weighs heavily
- 20:30Speaker 7: into making assessments at some confidence level that a lab
- 20:33Speaker 7: leak was the origin for this pandemic.
- 20:36Speaker 2: I mean, center, you hear that, and it's pretty clear
- 20:40Speaker 2: that Radkov is saying, we have overwhelming evidence and there's
- 20:45Speaker 2: one reason why we're not bringing this up, and that's
- 20:47Speaker 2: because of the Biden administration.
- 20:50Speaker 6: Well, listen, longtime listeners of Verdict will know that this
- 20:56Speaker 6: podcast laid out the evidence that the Corona virus came
- 21:01Speaker 6: from a Chinese government lab league. We laid this out
- 21:05Speaker 6: in March and in April of twenty twenty one, now
- 21:09Speaker 6: more than two years ago. The evidence was overwhelming then actually,
- 21:13Speaker 6: frankly everything John Ratcliffe said. And by the way, John
- 21:16Speaker 6: Ratcliffe was the head of DNI, he was the Director
- 21:19Speaker 6: of National Intelligence. He was the head of all of
- 21:21Speaker 6: the intelligence community under Donald Trump. He was a US
- 21:24Speaker 6: attorney prior to that, he was a congressman.
- 21:27Speaker 5: In between.
- 21:29Speaker 6: John Ratcliffe is a serious guy. That evidence is overwhelming.
- 21:35Speaker 6: Let's review what this podcast told its listeners.
- 21:40Speaker 5: Two years ago.
- 21:42Speaker 6: Number one, the Wuhan Institute for Virology was studying not
- 21:49Speaker 6: just viruses, but coronaviruses. Not just coronaviruses, but coronaviruses.
- 21:55Speaker 5: Derived from bats. The bats in question.
- 21:59Speaker 6: And remember early on when COVID broke, everyone said, oh,
- 22:02Speaker 6: this came from bats at the wet market. The bats
- 22:06Speaker 6: in question are not found naturally anywhere around Wuhan, So
- 22:11Speaker 6: there aren't the bats just don't occur. What's the closest
- 22:16Speaker 6: the bats naturally occur. The answer is nine hundred miles
- 22:20Speaker 6: away in China and caves in China. Nine hundred miles
- 22:23Speaker 6: away you can find the bats. What's the one exception
- 22:26Speaker 6: to that, Well, there's one place in all of Wuhan
- 22:28Speaker 6: you can find the bats that are normally nine hundred
- 22:30Speaker 6: miles away, and those bats are in the Wuhan Institute
- 22:33Speaker 6: for Virology. Why, because they're studying coronaviruses derived from bats. Now,
- 22:40Speaker 6: where exactly is the Wuhan.
- 22:41Speaker 5: Institute for Virology located? Geographically?
- 22:45Speaker 6: It's not ten miles away from where the outbreak occurred.
- 22:49Speaker 6: It's not five miles away. It's not a mile away.
- 22:53Speaker 6: The Wuhan Institute for virology is literally four hundred yards
- 22:58Speaker 6: away the wet market where allegedly this outbreak began. Not
- 23:05Speaker 6: only that, we now know that three employees at the
- 23:10Speaker 6: Wuhan Institute for Virology were medically treated and hospitalized in
- 23:15Speaker 6: November of twenty twenty for serious flu like symptoms that,
- 23:19Speaker 6: in hindsight sure look an awful lot like COVID nineteen.
- 23:24Speaker 6: We also know that in December of twenty twenty, when
- 23:27Speaker 6: Chinese doctors and whistleblowers began trying to shine the light
- 23:31Speaker 6: on this virus, that the Chinese government disappeared them, hid them,
- 23:38Speaker 6: silence them, did everything they could to cover it up.
- 23:40Speaker 6: We also know that months earlier, the Chinese government was
- 23:44Speaker 6: stockbuiling protective medical equipment things like masks and gloves to
- 23:49Speaker 6: limit the spread a virus like COVID nineteen. At this point,
- 23:55Speaker 6: and frankly two years ago, I think the overwhelming way
- 23:59Speaker 6: to the evidence eighty ninety percent is that this virus
- 24:05Speaker 6: escaped from a Chinese government lab.
- 24:08Speaker 5: Now I'll go further than what John Radcliffe testified today.
- 24:13Speaker 6: I think the odds are significant. I think that it
- 24:16Speaker 6: is a preponderance of the evidence supports the hypothesis that
- 24:22Speaker 6: COVID nineteen didn't just escape from a Chinese government lab,
- 24:26Speaker 6: but that it was genetically engineered and essentially created in a.
- 24:30Speaker 5: Chinese government lab.
- 24:32Speaker 6: They took a virus that occurs in nature with bats,
- 24:37Speaker 6: and they modified it to make it more lethal and
- 24:40Speaker 6: more transmissible. And that particular proposition I don't think has
- 24:46Speaker 6: proven to the same level of confidence that the proposition
- 24:51Speaker 6: is that it escaped from a Chinese government lab. But
- 24:54Speaker 6: I think it's Oh, I don't know. If I were
- 24:56Speaker 6: to pick a number, sixty sixty five, maybe seventy five
- 25:00Speaker 6: percent likely, I think it is more likely than not
- 25:04Speaker 6: that it was genetically modified by the Chinese government to
- 25:08Speaker 6: make it more lethal. We know, and this is one
- 25:11Speaker 6: hundred percent fact, that the Chinese government covered it up,
- 25:15Speaker 6: hit it, did everything they could to avoid accountability. And
- 25:18Speaker 6: we also know that the Biden administration of the Biden
- 25:22Speaker 6: White House refuses to hold the Chinese government accountable. Now,
- 25:26Speaker 6: why I don't know is that that nine members of
- 25:30Speaker 6: the Biden family were getting cash from the Chinese Communist
- 25:34Speaker 6: government or proxies thereof, I don't know, but it sure
- 25:38Speaker 6: seems to me the American people ought to be concerned
- 25:41Speaker 6: and if we had a media that gave a damn
- 25:43Speaker 6: about anything they ought to be concerned.
- 25:46Speaker 2: I want to get to another issue that you guys
- 25:49Speaker 2: are dealing with in Washington, d C.
- 25:51Speaker 1: Right now.
- 25:52Speaker 2: It's an important one with the Senate Committee replacement procedures
- 25:57Speaker 2: that deal with Diane Feinstein. This this is very significant
- 26:02Speaker 2: in the way that the Democrats are trying to deal
- 26:04Speaker 2: with this and what it means for every American listening.
- 26:07Speaker 2: Before we get into that, though, I want to tell
- 26:08Speaker 2: you about a friends of August of precious Metals. If
- 26:11Speaker 2: you've been stressed out because of what's been going on
- 26:13Speaker 2: the economy with inflation, stock market, bank failures, and you're
- 26:18Speaker 2: close to retirement or in retirement, you need to talk
- 26:21Speaker 2: to my friends and a gust of precious Medals. They
- 26:24Speaker 2: help you buy gold and to use it to protect
- 26:27Speaker 2: yourself with a gold ira, to protect your hard earned assets,
- 26:31Speaker 2: protecting your retirement savings. This is why people invest in
- 26:36Speaker 2: gold and silver. It is a hedge against inflation. And
- 26:39Speaker 2: if you've been saving for retirement, Augusta Precious Metals will
- 26:43Speaker 2: actually pay you in pure gold. That's right to learn
- 26:47Speaker 2: how gold iras can protect you. That's a big deal.
- 26:51Speaker 2: If you've saved one hundred thousand dollars or more for retirement,
- 26:55Speaker 2: They're going to give you a pure gold coin for free.
- 26:58Speaker 2: All you got to do is reach out to Augusta
- 27:00Speaker 2: Precious Medals today and get started with gold. Don't let
- 27:03Speaker 2: the bank failures get you down. Get this free gold
- 27:06Speaker 2: and get some peace of mind. Call them eight seven
- 27:10Speaker 2: to seven four gold Ira eight seven seven, number four
- 27:15Speaker 2: gold Ira to learn how to protect your retirement and
- 27:18Speaker 2: get your free gold coin. Yeah, a free gold coin.
- 27:22Speaker 2: That's Augusta Precious Medals eight seven to seven, the number
- 27:25Speaker 2: four Goldira or Augusta Precious Medals dot com center. For
- 27:30Speaker 2: three years, Dems have been trying to boot Diane Feinstein
- 27:33Speaker 2: off the Judiciary Committee. Now Dems are redoubling their efforts
- 27:37Speaker 2: because they want to confirm more radical nominees. This is unprecedented,
- 27:43Speaker 2: completely cynical, and deeply political, is one of the ways
- 27:48Speaker 2: that you could describe this entire fiasco.
- 27:51Speaker 1: So where are we now with this and what's.
- 27:54Speaker 2: Going to take place when it comes to Diane Feinstein
- 27:57Speaker 2: basically being absent from work.
- 28:01Speaker 6: The Democrat Party is doing everything they can to drive
- 28:04Speaker 6: Dianne Feinstein out of the United States.
- 28:06Speaker 5: Senate and to understand why.
- 28:09Speaker 6: Look, Diane Feinstein has been in the Senate for decades.
- 28:13Speaker 6: She is eighty nine years old. She's much older than
- 28:18Speaker 6: you are, much older than I am. She's been in
- 28:20Speaker 6: the Senate since you and I were in short shorts.
- 28:27Speaker 6: This really started in earnest three years ago with the
- 28:33Speaker 6: Senate confirmation of Justice Amy Cony Barrett. Now you recall
- 28:38Speaker 6: that was at the end of the Trump administration, and
- 28:42Speaker 6: the Judiciary Committee took up the nomination quickly. Justice Barrett
- 28:48Speaker 6: was incredibly well qualified and she was confirmed. The Democrats
- 28:52Speaker 6: voted party line against her, because that is their approach.
- 28:58Speaker 5: To judicial nominations. At this point.
- 29:02Speaker 6: At the end of the hearing, when all was said
- 29:05Speaker 6: and done, Diane Feinstein was the ranking member, she was
- 29:07Speaker 6: the senior Democrat on the Judiciary Committee. Lindsey Graham was
- 29:10Speaker 6: the chairman. At the end of the hearing, Diane Feinstein
- 29:14Speaker 6: very briefly hugged Lindsey Graham. Now she did it because
- 29:19Speaker 6: she and Lindsay have served on the committee for decades together,
- 29:23Speaker 6: and she was trying to be gracious. But the radical
- 29:28Speaker 6: left wing of the Democrat Party lost their mind. They
- 29:33Speaker 6: truly went in to fits of rage that she would
- 29:39Speaker 6: dare hug Lindsey Graham. Now, Diane Feinstein was slated to
- 29:43Speaker 6: be the next chairman of the Judiciary Committee if the
- 29:46Speaker 6: Democrats took the majority. Because the radical left wing was
- 29:51Speaker 6: so angry, within days, Chuck Schumer announced Feinstein is no
- 29:57Speaker 6: longer in line to be chairman of the Judiciary Committee. Basically,
- 30:00Speaker 6: he took Feinstein to a back alley and effectively shot her,
- 30:05Speaker 6: and it was giving in to the most extreme left
- 30:09Speaker 6: wing voices of the Democrat Party instead. What he did
- 30:12Speaker 6: is Dick Durbin was on the committee. He was the
- 30:16Speaker 6: next most senior member. But Dick Durbin is also the
- 30:20Speaker 6: number two person in the Democrat Party.
- 30:23Speaker 5: He is the majority whip.
- 30:26Speaker 6: Under Senate rules, typically the majority leader the minority leader.
- 30:32Speaker 6: The majority whip, the minority whip can't be a committee chairman.
- 30:35Speaker 6: Also that there's a basic principle that if you have
- 30:38Speaker 6: one leadership position, you can't have another one. Well, the
- 30:41Speaker 6: Democrats decided, screw that, We're going to make Dick Durbin
- 30:44Speaker 6: both majority Whip and chairman of the Judiciary Committee. Why
- 30:48Speaker 6: because the radical left is so pissed at Diane Feinstein.
- 30:52Speaker 5: All right, fast, forward to now.
- 30:54Speaker 6: So Diane, who's getting older, which all of us are,
- 30:59Speaker 6: has shingles. By all accounts, is a horribly painful disease.
- 31:04Speaker 6: I'm grateful I haven't had it, but everything I've heard
- 31:07Speaker 6: about it, it sounds terrible. Shingles is also curable.
- 31:11Speaker 5: It's not a.
- 31:13Speaker 6: Permanent affliction, but it is very painful while you have it.
- 31:17Speaker 6: So Diane has been out for a couple of months
- 31:19Speaker 6: with shingles. She's been at home recuperating. The radical left
- 31:24Speaker 6: is pissed because while Diane is gone, the Democrats no
- 31:30Speaker 6: longer have a majority on.
- 31:32Speaker 5: The Judiciary Committee.
- 31:34Speaker 6: Because they don't have a majority, it means they can't
- 31:37Speaker 6: ram through their most radical and extreme judicial nominees. Now,
- 31:43Speaker 6: most of their judicial nominees they can pass. Why because
- 31:46Speaker 6: on almost every Joe Biden nominee, Lindsey Graham.
- 31:50Speaker 5: Votes for them.
- 31:51Speaker 6: He has a view that the opposing party should vote
- 31:56Speaker 6: for the nominees of the other party, even if you
- 31:59Speaker 6: diss agree with their ideology. Now I don't agree with
- 32:02Speaker 6: Lindsay's view, but that his long standing view. He's voted
- 32:05Speaker 6: to confirm numerous liberal Supreme Court justices. He votes to
- 32:09Speaker 6: confirm most Biden judicial nominees. I vote against almost all
- 32:15Speaker 6: Biden judicial nominees. But given that Lindsay votes for practically
- 32:20Speaker 6: all of them, the Democrats can move almost the entirety
- 32:25Speaker 6: of Biden's judicial slate. The ones they can't move are
- 32:30Speaker 6: the most radical, are the most extreme. Are the are
- 32:32Speaker 6: the nominees that are so extreme they can't get even
- 32:36Speaker 6: a single bipartisan vote. And the reaction of the radical
- 32:40Speaker 6: left wing number one their number one. Their primary reaction
- 32:44Speaker 6: is throw Diane Feinstein out, force her to resign, shame her,
- 32:49Speaker 6: throw her out.
- 32:49Speaker 5: Of the Senate.
- 32:53Speaker 6: Her response to this has been to send a letter
- 32:56Speaker 6: to Chuck Schumer saying, please temporarily remove me.
- 33:00Speaker 5: From the Judiciary Committee until I come back.
- 33:04Speaker 6: Now, as we sit here, I think the chances of
- 33:09Speaker 6: that happening are exceptionally low. There are two ways that
- 33:13Speaker 6: could happen. Number one by unanimous consent. So the way
- 33:17Speaker 6: Senators get on committees is at the beginning of a Congress,
- 33:21Speaker 6: the Senate passes an organizing resolution. The organizing resolution names
- 33:25Speaker 6: the chairman of every committee, names the ranking members of
- 33:28Speaker 6: every committee, names the members of every committee, and that
- 33:32Speaker 6: usually takes several weeks. It's negotiated between the majority leader
- 33:36Speaker 6: and the minority leader depending on the ratio of how
- 33:39Speaker 6: many Republicans how many Democrats. The balance of how many
- 33:44Speaker 6: are on each committee is negotiated. Once the two parties
- 33:48Speaker 6: reach an agreement, that organizing resolution is typically passed by
- 33:52Speaker 6: unanimous consent. In other words, all one hundred senators agree
- 33:56Speaker 6: to it once the two sides of a reached agreement. Now,
- 33:59Speaker 6: if Schumer wants to change it, he has two ways
- 34:02Speaker 6: to do it. Number one, he could ask unanimous consent
- 34:06Speaker 6: to remove Feinstein from Judiciary and plug some other Democrat
- 34:09Speaker 6: in there. That would take all one hundred senators agreeing.
- 34:14Speaker 6: That will not happen. Multiple Republican senators have said they
- 34:18Speaker 6: would object. I would object like, there's no chance Schumer
- 34:21Speaker 6: is going to get unanimous consent to do that because
- 34:24Speaker 6: a bunch of us would object. I don't see any
- 34:26Speaker 6: reason why we should be complicit in helping the Democrats
- 34:30Speaker 6: confirm their most radical and extreme nominees. The second way
- 34:35Speaker 6: he could do it is he could try to move
- 34:36Speaker 6: it through regular order, which would take sixty votes, which
- 34:40Speaker 6: would mean that he would need to get nine or
- 34:45Speaker 6: ten Republicans. I don't think he'll do that. We've seen
- 34:49Speaker 6: in the past few days multiple Republicans come out and
- 34:52Speaker 6: say we're not going to help Schumer do this. I
- 34:55Speaker 6: think right now the chances that he gets enough Republicans
- 34:58Speaker 6: to get sixty votes are really, really low, given that
- 35:04Speaker 6: the Democrats are in a fix, and what they're doing
- 35:07Speaker 6: is they're just trying to put massive political pressure on
- 35:11Speaker 6: Feinstein to get her to resign from the Senator. If
- 35:15Speaker 6: she resigns from the Senate, Gavin Newsom, the governor of California. Look,
- 35:20Speaker 6: there is a vigorous primary going on to replace Diane Feinstein.
- 35:23Speaker 6: She's not running for reelection, so her seat will be
- 35:26Speaker 6: up in twenty twenty four. Multiple Democrats are running. Adam
- 35:30Speaker 6: Schiff is running, Katie Porter is running, Barber Lee is running.
- 35:34Speaker 6: Gavin Newsom has promised if there's a vacancy, he will
- 35:39Speaker 6: appoint an African American woman, and he will only appoint
- 35:42Speaker 6: an African American woman. So if you're white, you need
- 35:45Speaker 6: not apply. If you're a man, you need not apply.
- 35:47Speaker 6: If you're Hispanic, you need not apply. He is openly
- 35:51Speaker 6: and explicitly racist and sexist in saying who he will appoint. Now,
- 35:56Speaker 6: if you look at the primary contenders. There's only one
- 35:58Speaker 6: of those candidates who's an African American woman. That being said,
- 36:01Speaker 6: I suppose Adam Schiff could announce tomorrow that he identifies
- 36:04Speaker 6: as an African American woman, but absent his doing that,
- 36:08Speaker 6: Barbara Lee is the only person who qualifies.
- 36:12Speaker 5: The radical left would love.
- 36:14Speaker 6: For Feinstein to resign and Barbara Lee to be appointed
- 36:17Speaker 6: to the race and give her a leg up over
- 36:19Speaker 6: Schiff and Katie Porter. I don't think that will happen,
- 36:23Speaker 6: although the press and the Democrats are trying to shame
- 36:25Speaker 6: her into it. And I gotta say, Ben, I've been
- 36:27Speaker 6: in the Senate eleven years. Look, the Senate is a
- 36:31Speaker 6: body with a crap ton of really old people, like
- 36:34Speaker 6: the bunch of people in their seventies and eighties. I've
- 36:37Speaker 6: served with a bunch of colleagues who are way past
- 36:43Speaker 6: their expiration date. It's striking to me that the only
- 36:50Speaker 6: Senator I've ever seen that a party has tried to
- 36:53Speaker 6: drive out because of health is Dianne Feinstein. Listen, John McCain,
- 36:58Speaker 6: who I served with for a long time. John McCain
- 37:00Speaker 6: was hospitalized and was incapacitated for months. He was the
- 37:04Speaker 6: chairman of the Armed Services Committee. There was no effort
- 37:08Speaker 6: to throw John McCain out of the Senate, nor should
- 37:10Speaker 6: there have been. I would not have supported that. I
- 37:13Speaker 6: didn't support that. It's really striking, by the way, right now,
- 37:18Speaker 6: Joe Biden is profoundly mentally diminished. None of these left
- 37:24Speaker 6: wing radicals calling for throwing Diane Feinstein out are calling
- 37:27Speaker 6: for throwing Joe Biden out. And by the way, to
- 37:29Speaker 6: be clear, John Fetterman, the Senator from Pennsylvania, has been
- 37:34Speaker 6: medically unavailable and absent for most of this Congress. He's
- 37:39Speaker 6: been in the Senate only a few days since he
- 37:41Speaker 6: was elected. And none of these radicals who are calling
- 37:45Speaker 6: to throw Diane Feinstein out are calling to throw Fetterman out.
- 37:49Speaker 6: And so it raises an obvious question, why the double standard?
- 37:52Speaker 6: Why is she the target of.
- 37:54Speaker 2: Their ire Yeah, it is shocking to see the way
- 37:57Speaker 2: that they're treating her, and especially while she dealing with,
- 38:01Speaker 2: as you mentioned, a medical issue in shingles. Imagine you're
- 38:04Speaker 2: trying to get over this, and this is what you're
- 38:08Speaker 2: hearing about every day that the Democrats, while you're out
- 38:11Speaker 2: trying to get better, are basically trying to force you
- 38:14Speaker 2: from your office. I want to ask you about the
- 38:18Speaker 2: human aspect of that and will this backfire? Do you
- 38:20Speaker 2: believe on Democrats just looking like they have no compassion
- 38:26Speaker 2: whatsoever for Diane Feinstein in this situation. Before I do that,
- 38:31Speaker 2: I want to tell you about Chalk. If you're a
- 38:33Speaker 2: guy and you're dealing with the real aging issue, losing
- 38:37Speaker 2: your strength and your vitality, and you don't want to
- 38:40Speaker 2: just say all right, I'm willing to give in and
- 38:43Speaker 2: be weak and complacent, that is where Chalk comes in.
- 38:48Speaker 2: Chalk is here to help real America men just like you,

- 39:43Speaker 2: Is there a chance center that this is going to backfire?
- 39:45Speaker 2: And I'm talking about just the human side of this
- 39:48Speaker 2: that it seems so clear now what their goal is,
- 39:51Speaker 2: how they're treating an older woman who has served clearly
- 39:54Speaker 2: the people of California for decades on end, trying to
- 39:57Speaker 2: force her out while she's actually trying to heal from
- 39:59Speaker 2: she Or is this just the Democratic Party in a
- 40:03Speaker 2: nutshell and when they're done with you, they throw you away.
- 40:07Speaker 6: Well, look, I think it could backfire all. To be honest,
- 40:11Speaker 6: I don't think the odds of that are terribly high,
- 40:14Speaker 6: because I think the corporate media is so hypocritical they
- 40:17Speaker 6: won't hold Democrats to account. I think they're activists, are
- 40:21Speaker 6: so extreme they won't care. They're perfectly happy to throw
- 40:24Speaker 6: Diane Feinstein overboard. And so I don't think there's actually
- 40:31Speaker 6: a whole lot of downside now from the Democrats perspective.
- 40:37Speaker 6: And I do want to say something. Look, I like Diane.
- 40:39Speaker 6: I've served with her eleven years. She and I get along.
- 40:43Speaker 5: Fairly well.
- 40:46Speaker 6: It's worth noting there's some irony of my speaking out
- 40:50Speaker 6: in defense of Diane Einstein while most Democrats are eagerly
- 40:56Speaker 6: sticking a knife in her. Which is when I was
- 40:58Speaker 6: a brand new babysitter and I'd been in the Senate
- 41:01Speaker 6: just a few months. One of the very first things
- 41:04Speaker 6: that happened was the horrific shooting in Newtown, Connecticut, and
- 41:09Speaker 6: the Democrats, the Democrats, Barack Obama just been re elected.
- 41:12Speaker 6: So I was elected in twenty twelve. So Obama was
- 41:15Speaker 6: starting a second term, and Chuck Schumer was on the
- 41:20Speaker 6: Sunday shows just exultant saying, We're going to pass gun control.
- 41:24Speaker 6: We're in the sweet spot. We want to take away
- 41:27Speaker 6: everyone's guns. And Diane Feinstein was the point of the
- 41:32Speaker 6: so called assault weapons band in the Senate. She had
- 41:35Speaker 6: advocated it for a long time. And so we're in
- 41:37Speaker 6: the Judiciary Committee and I'm a brand new senator and
- 41:40Speaker 6: we're at a hearing, and I asked her. I said,
- 41:46Speaker 6: in the Bill of Rights, the Second Amendment uses the
- 41:52Speaker 6: words the right of the People to keep in bear
- 41:54Speaker 6: arms shall not be infringed and I pointed out, I said,
- 41:59Speaker 6: the right of the people, when the framers wrote them
- 42:02Speaker 6: into the Bill of Rights, is a term of art,
- 42:05Speaker 6: and it's a term of art that they used repeatedly.
- 42:09Speaker 6: They used it in the First Amendment, the right of
- 42:11Speaker 6: the people to peacedly assemble. They used it in the
- 42:14Speaker 6: Fourth Amendment, the right of the people to be free
- 42:16Speaker 6: from unreasonable searches and seizures. Every time the Framers use
- 42:21Speaker 6: the phrase the right of the people, it referred to.
- 42:23Speaker 5: An individual right.
- 42:25Speaker 6: And I asked her bill banning so called assault weapons
- 42:30Speaker 6: specified about two thousand different weapons that would be prohibited,
- 42:33Speaker 6: and it specified them by name. And I said, given
- 42:36Speaker 6: the Second Amendment uses the words the right of the people,
- 42:40Speaker 6: as does the First Amendment, as to the Fourth Amendment,
- 42:42Speaker 6: would you be okay with legislation on another one of
- 42:46Speaker 6: those amendments, Let's say the First Amendment specifying two thousand
- 42:50Speaker 6: books that should be banned that are no longer allowed.
- 42:54Speaker 6: What gives Congress the right to ignore the right to
- 43:00Speaker 6: the people in the Bill of Rights?
- 43:03Speaker 5: Now?
- 43:03Speaker 6: The response, Diane got very upset, and she said, I
- 43:10Speaker 6: am not a sixth grader. She was really angry, and
- 43:16Speaker 6: she dressed me down and I have to admit, and
- 43:19Speaker 6: this thing went viral. It got gazillion views online. I
- 43:24Speaker 6: have to admit I was astonished. I was brand new
- 43:26Speaker 6: to the Senate and I was sitting there thinking, well,
- 43:28Speaker 6: of course, you're not a sixth grader. I would never
- 43:31Speaker 6: ask a sixth grader a substantive question about the United
- 43:36Speaker 6: States Constitution of the Bill of Rights. You're a Senator
- 43:38Speaker 6: representing the largest state in the Union, California, and a
- 43:42Speaker 6: longtime senator serving on the Senate Judiciary Committee, and you're
- 43:45Speaker 6: proposing legislation that I think is contrary to the Constitution.
- 43:49Speaker 6: So I'm asking you a constitutional law question, like it's
- 43:52Speaker 6: obvious you're not a sixth grader, and actually given that
- 43:58Speaker 6: hot exchange, so I can tell you. In the months
- 44:00Speaker 6: that followed it, Diane and I repeatedly we'd be in
- 44:04Speaker 6: an elevator in the Capitol and she'd look at me
- 44:06Speaker 6: and go, She'd look over me, she kind of purse
- 44:09Speaker 6: her lips and go, hello, tough guy. And I would
- 44:16Speaker 6: smile and I'd say, Diane, I'm sweetness and light, I'm
- 44:22Speaker 6: gentle as a kiddy cat, and she would say, is
- 44:26Speaker 6: that what your wife tells you? We had that conversation,
- 44:30Speaker 6: I kid you, not three times word for word in
- 44:33Speaker 6: Senata elevators, all of which is to say, there is
- 44:37Speaker 6: some irony that I'm now defending Diane. And actually, for
- 44:42Speaker 6: the sake of our podcast listeners, let's go back through
- 44:46Speaker 6: the wayback machine. This is in twenty thirteen. I'm a
- 44:49Speaker 6: brand new baby senator. I'm forty two years old. Let's
- 44:54Speaker 6: play right now the back and forth between Dianne Feinstein
- 44:57Speaker 6: and me on guns, and you can hear her explain
- 45:00Speaker 6: to me that she's not a sixth rate. It's to
- 45:03Speaker 6: me that all of us should begin as our foundational
- 45:05Speaker 6: document with the Constitution, and the Second Amendment in the
- 45:10Speaker 6: Bill of Rights provides that the right of the people
- 45:12Speaker 6: to keep in bear arms shall not be infringed. The
- 45:15Speaker 6: term the right of the people when the framers included
- 45:19Speaker 6: it in the Bill of Rights, they used.
- 45:20Speaker 5: It as a term of art.
- 45:21Speaker 8: That same phrase, the right of the people, is found
- 45:23Speaker 8: in the First Amendment, the right of the people to
- 45:26Speaker 8: peaceably assemble and to petition their government for redress of grievances.
- 45:29Speaker 8: It's also found in the Fourth Amendment, the right of
- 45:31Speaker 8: the people to be free from unreasonable searches, and seizures.
- 45:35Speaker 8: And the question that I would pose to the senior
- 45:38Speaker 8: Senator from California is would she deem it consistent with
- 45:41Speaker 8: the Bill of Rights for Congress to engage in the
- 45:44Speaker 8: same endeavor that we are contemplating doing with the Second
- 45:48Speaker 8: Amendment in the context of the First or fourth Amendment? Namely,
- 45:53Speaker 8: would she consider it constitutional for Congress to specify that
- 45:57Speaker 8: the First Amendment shall apply only to the following books,
- 46:00Speaker 8: and she'll not apply to the books that Congress has
- 46:02Speaker 8: deemed outside the protection of the Bill of Rights. Likewise,
- 46:06Speaker 8: would she think that the Fourth Amendments protection against searchers
- 46:09Speaker 8: and seizures could properly apply only to the following specified
- 46:14Speaker 8: individuals and not to the individuals that Congress has deemed
- 46:19Speaker 8: outside the protection of the development question.
- 46:24Speaker 9: Let me just make a couple of points in response. One,
- 46:27Speaker 9: I'm not a sixth grader, Senator. I've been on this
- 46:30Speaker 9: committee for twenty years. I was a mayor for nine years.
- 46:34Speaker 9: I walked in, I saw people shot. I've looked at
- 46:37Speaker 9: bodies that have been shot with these weapons. I've seen
- 46:40Speaker 9: the bullets that implode. In Sandy Hook, youngsters were dismembered. Look,
- 46:46Speaker 9: there are other weapons I've been up I'm not a lawyer,
- 46:51Speaker 9: but after twenty years I've been up close and personal
- 46:54Speaker 9: to the Constitution.
- 46:55Speaker 5: I have great respect for it.
- 46:58Speaker 9: This doesn't mean thats of war, and the Heller decision
- 47:02Speaker 9: clearly points out three exceptions, two of which are pertinent here.
- 47:08Speaker 9: And so, I you know, I mean, it's fine you
- 47:11Speaker 9: want to lecture me on the Constitution. I appreciate it.
- 47:15Speaker 9: Just know, I've been here for a long time. I've
- 47:18Speaker 9: passed on a number of bills. I've studied the Constitution myself.
- 47:22Speaker 9: I am reasonably well educated, and I thank you for
- 47:25Speaker 9: the lecture. Incidentally, this does not prohibit you use the
- 47:30Speaker 9: word prohibit. It exempts two thousand, two hundred and seventy
- 47:35Speaker 9: one weapons. Isn't that enough for the people in the
- 47:39Speaker 9: United States?
- 47:41Speaker 1: Mister?
- 47:41Speaker 5: Do they need a bazooka?
- 47:43Speaker 9: Do they need other high powered weapons that military people
- 47:48Speaker 9: use to kill in close combat? I don't think so.
- 47:52Speaker 9: So I come from a different place than you do.
- 47:55Speaker 9: I respect your views. I ask you to respect my views. Senator,
- 48:00Speaker 9: I want to apologize to you. You sort of got
- 48:03Speaker 9: my dander up, and that happens on occasion.
- 48:06Speaker 2: But first, mister Chairman, Senator, you can't make it out.
- 48:13Speaker 2: Your recollections spot on on that one.
- 48:16Speaker 6: Well, and that was actually Pat Leahy who threw in
- 48:19Speaker 6: the Rye comment first time ever. So look, the point is,
- 48:23Speaker 6: there's some irony that I'm now defending Dianne Feinstein, but
- 48:28Speaker 6: it's because the radical left she was more than eager
- 48:31Speaker 6: to be the tip of the spear on gun control.
- 48:33Speaker 6: They loved her then, but now their view is she
- 48:37Speaker 6: has shingles. Get the hell out, because we've got radical
- 48:40Speaker 6: judges to confirm. And again it's worth noting.
- 48:45Speaker 5: That the.
- 48:47Speaker 6: Judges, the vast majority of Biden judicial nominees can move forward.
- 48:53Speaker 6: It's only a handful of the nominees who are extreme.
- 48:57Speaker 6: And let me tell you some of the ones that
- 48:59Speaker 6: they really want to move forward. So there's a nominade
- 49:02Speaker 6: named Michael Delaney. Michael Delaney's nominated.
- 49:04Speaker 5: The First Circuit Court of Appeals.
- 49:07Speaker 6: He was representing a very elite private school in litigation
- 49:13Speaker 6: against a sexual assault victim, and he argued in court
- 49:20Speaker 6: that the sexual assault victims should not be allowed to
- 49:23Speaker 6: use a pseudonym, but rather this should be publicly outed
- 49:26Speaker 6: as a victim. Now that's a pretty extreme position. It's
- 49:31Speaker 6: a position that frankly, none of the Democrats wanted to
- 49:34Speaker 6: defend this confirmation hearing, and the only way they're going
- 49:38Speaker 6: to report him to the floor is if Feinstein is
- 49:41Speaker 6: back and they have a straight party line vote, because
- 49:43Speaker 6: there's going to be no Republicans who vote for him.
- 49:44Speaker 5: Lindsey Graham said he would vote no.
- 49:47Speaker 6: A second nominee is Charnell Becklgrin, who's nominated in the
- 49:53Speaker 6: Eastern District of Washington. Now Beckl Grin, astonishingly enough, John
- 49:58Speaker 6: Kennedy Astor and we've played this on on the podcast,
- 50:01Speaker 6: ask her what Article five of the Constitution was. She
- 50:04Speaker 6: had no idea. Article five is the provision that lays
- 50:06Speaker 6: out how you amend the Constitution. He then asked her
- 50:10Speaker 6: what is Article two of the Constitution? Now, I got
- 50:13Speaker 6: to tell you, Ben, if you're not a lawyer, you
- 50:15Speaker 6: might not know what article two is. But if you
- 50:18Speaker 6: are a first year law student and you're asked what's
- 50:21Speaker 6: Article two and your answer is I don't know, you
- 50:24Speaker 6: will flunk conlaw. Article two is the provision of the
- 50:27Speaker 6: Constitution that creates the president and the executive branch, and
- 50:31Speaker 6: the fact that she didn't know demonstrates she is manifestly
- 50:35Speaker 6: unqualified to be a federal judge. And by the way,
- 50:38Speaker 6: Dick Durban, the chairman of the committee, his defense was, well, gush,
- 50:40Speaker 6: there are a bunch of members of this committee who
- 50:42Speaker 6: don't know what Article two is. If there are any
- 50:45Speaker 6: they ought to get the hell off the Judiciary Committee.
- 50:47Speaker 6: You really ought to know what Article two is. The
- 50:51Speaker 6: Beckel Grant is nominated to be what is called an
- 50:54Speaker 6: Article three judge. Article three, which I suspect she has
- 50:58Speaker 6: no idea what it is is the provision that creates
- 51:01Speaker 6: the judiciary. The other two nominees are an individual named
- 51:06Speaker 6: Cato Cruz cr E W s so not not spelled
- 51:10Speaker 6: like me, a nominee to the District of Colorado who
- 51:13Speaker 6: failed to describe the holding of Brady versus Maryland a
- 51:17Speaker 6: foundational criminal law case. Uh and and said, and it
- 51:21Speaker 6: deals with with the the production of exculpatory evidence of
- 51:25Speaker 6: sculpatory evidence to defendants. And instead this this nominee said, quote,
- 51:30Speaker 6: I believe the Brady case involves something regarding the Second Amendment.
- 51:34Speaker 6: I've not had occasion to address that. That's a level
- 51:38Speaker 6: of absolute unfamiliarity with criminal law that makes you unfit
- 51:43Speaker 6: to be a judge. And then the fourth nominee is
- 51:47Speaker 6: someone named Marion Gaston, nominated in the Southern District, California,
- 51:52Speaker 6: who co authored a position paper arguing that sex offender
- 51:57Speaker 6: restrictions are too tough. The paper argues, and this is
- 52:00Speaker 6: a quote difficult as it might be, laws that regulate
- 52:05Speaker 6: where sex offenders may not live should be repealed or
- 52:09Speaker 6: substantially modified in the interest of public safety. The paper
- 52:13Speaker 6: also noted, quote children are not safer because registered sex
- 52:19Speaker 6: offenders are prohibited from residing near schools, parks, daycare centers,
- 52:24Speaker 6: and other places where children tend to gather. Now, I
- 52:27Speaker 6: got to say, Ben, for a radical leftist to argue
- 52:31Speaker 6: we ought to be sending pedophiles to live next door
- 52:34Speaker 6: to a school or a daycare is a holy crap moment.
- 52:38Speaker 6: And so those are the four nominees that this fight's
- 52:42Speaker 6: all about. Because every other nominee, Lindsey Graham's going to
- 52:45Speaker 6: vote for and they can move them to the floor.
- 52:47Speaker 6: This is about those four, and the radical left is saying,
- 52:51Speaker 6: give us our most extreme nominees because that's who we want,
- 52:57Speaker 6: and we can't get that as long as Feinstein is
- 53:00Speaker 6: home and ill.
- 53:01Speaker 2: Yeah, great point, Centator as always, want to remind people
