- 0:00Speaker 1: It is a full out assault on the Supreme Court
- 0:03Speaker 1: and the justices by someone who was probably clerking at
- 0:09Speaker 1: the Supreme Court for a liberal justice who decided to
- 0:13Speaker 1: hand deliver were assumed documents to Politico so that there
- 0:16Speaker 1: wouldn't be a paper trail that the FBI could find.
- 0:20Speaker 1: This is an assault on the institution because when Democrats
- 0:23Speaker 1: don't get their way, they want anarchy, they want chaos,
- 0:27Speaker 1: they want people's lives to be threatened. Now, to be clear,
- 0:30Speaker 1: the intent of this idiot was, probably or idiots involved,
- 0:35Speaker 1: was to try to put extreme pressure on the Supreme
- 0:39Speaker 1: Court justices to change their mind before the ruling came out.
- 0:42Speaker 1: Except that's not going to happen. What this person has done,
- 0:46Speaker 1: whoever decided to leak this draft opinion is now revealing
- 0:51Speaker 1: the Democrats will stop at nothing to destroy people or
- 0:55Speaker 1: places or institutions, including the Supreme Court. This is a
- 0:59Speaker 1: massive elation of the separation of powers and this person
- 1:03Speaker 1: deserves to go to jail for doing this. This is
- 1:06Speaker 1: an assault on an institution and how it works. This
- 1:09Speaker 1: has never happened before, so you understand the gravity of
- 1:13Speaker 1: the situation. Politico, by the way, who leak, you know,
- 1:18Speaker 1: got the leaked opinion piece Politico just so you know,
- 1:22Speaker 1: should have never run this. There's lots of stories that
- 1:25Speaker 1: Politico gets that they do not run. Now. Of course
- 1:27Speaker 1: they ran this one because they knew it would cement
- 1:30Speaker 1: Politico maybe forever or certainly for at least the next
- 1:34Speaker 1: decade is a place to go and grab news. They
- 1:37Speaker 1: never should have run this story, this exclusive now. Their
- 1:42Speaker 1: headline says, the Supreme Court is voted to overturn abortion rights.
- 1:46Speaker 1: Draft opinion shows, quote, we hold that Roe and Casey
- 1:50Speaker 1: must be overruled. As to what Justicelito writes in an
- 1:53Speaker 1: initial majority draft circulated inside the Court that has now
- 1:57Speaker 1: been released months before this was supposed to come down,
- 2:01Speaker 1: the Supreme Court has voted to strike down the landmark
- 2:05Speaker 1: rov Way decision, according to an initial draft majority of
- 2:09Speaker 1: written by Justice Alito circulated inside the Court obtained by Politico.
- 2:13Speaker 1: Their headline says the draft opinion is a full throated, unflinching,
- 2:20Speaker 1: They say, unflinching attack of the nineteen seventy three decision,
- 2:30Speaker 1: which guaranteed federal constitutional protections of abortion rights, and a
- 2:35Speaker 1: subsequent nineteen ninety two decision, planned Parenthood v. Casey that
- 2:40Speaker 1: largely maintained the right quote Roe was egregiously wrong from
- 2:44Speaker 1: the start Alito rights quote, we hold that Rowe and
- 2:49Speaker 1: Casey must be overruled. That is what was the document
- 2:55Speaker 1: labeled as the opinion of the Court said, it's time
- 2:57Speaker 1: to heed the constitution return the issue of a to
- 3:00Speaker 1: the people's elected representatives, which means to the state. Now.
- 3:05Speaker 1: To be clear, this isn't saying that we are saying
- 3:07Speaker 1: that abortion is going to be banned. It's saying it's
- 3:09Speaker 1: going to go back to the state's rights issue. Of course,
- 3:12Speaker 1: the left doesn't want you to know that, or understand that,
- 3:15Speaker 1: or understand separation of powers or understand how this works.
- 3:18Speaker 1: Deliberations political rights on controvertial cases, having the past been fluid,
- 3:23Speaker 1: Justices can sometimes do change and sometimes and do change
- 3:28Speaker 1: their votes as draft opinions circulate at major decisions can
- 3:33Speaker 1: be subject to multiple drafts and vote trading, sometimes until
- 3:36Speaker 1: just days before a decision is unveiled. The Court's holding
- 3:40Speaker 1: will not be final until it is published, likely in
- 3:42Speaker 1: the next two months, and that's exactly why this was leaked.
- 3:48Speaker 1: This was leaked to put extreme pressure on Supreme Court
- 3:51Speaker 1: justices to change their vote and The reason why they
- 3:56Speaker 1: want to change their vote is because that they are
- 3:58Speaker 1: afraid for their lives. That's what they're saying. That's how
- 4:04Speaker 1: this is going to go down. That's why it was leaked.
- 4:09Speaker 1: They want this to become a major issue. They want
- 4:14Speaker 1: this to become so much pressure. They want this to
- 4:17Speaker 1: become an election issue as well. Look what happens when
- 4:20Speaker 1: you vote for Republicans. They take away your right to vote.
- 4:26Speaker 1: That's what they're going to say. They're going to take
- 4:29Speaker 1: away your right to have an abortion. Now, whoever did
- 4:34Speaker 1: this deserves to be in jail. The fact that they
- 4:38Speaker 1: did this tells you everything you need to know, right,
- 4:42Speaker 1: The fact that they did this tells you all that
- 4:46Speaker 1: you need to know about how radical the leftist. Remember
- 4:50Speaker 1: what they did during the confirmation hearings of the different
- 4:54Speaker 1: Conservatives that were put on the court by Donald Trump.
- 4:58Speaker 1: Remember that they accused court justices of being junior high
- 5:03Speaker 1: rape partiers that plan rate parties to rate people. Right,
- 5:08Speaker 1: this is what they did to people. They made things up,
- 5:12Speaker 1: just like they made up Russian collusion, just like they
- 5:15Speaker 1: made up that Donald Trump had a connection to a
- 5:19Speaker 1: bank in Russia, just like they made up the Dalcia
- 5:23Speaker 1: and they knew it was a lie, and they still
- 5:25Speaker 1: went with it to impeach Donald Trump. This is no
- 5:28Speaker 1: different way what they did with Supreme Court justices. Never
- 5:31Speaker 1: forget that this is no different than what they're doing
- 5:35Speaker 1: right now. Never forget that this is pure evil. This
- 5:42Speaker 1: is basically I would describe as a kill list, a
- 5:44Speaker 1: hit list. If there's any crazy psychotic leftists out there,
- 5:49Speaker 1: and there are plenty, here's your list of conservatives that
- 5:51Speaker 1: maybe you could go after and change the vote. That's
- 5:54Speaker 1: also part of this, and I'm not saying that it's
- 5:56Speaker 1: already online people are talking about maybe somebody will do
- 5:59Speaker 1: the right thing as they describe it. I can't even
- 6:03Speaker 1: imagine what the security is going to have to be
- 6:05Speaker 1: like for the next three months or two months until
- 6:08Speaker 1: the opinion comes out. Can't imagine what this is going
- 6:12Speaker 1: to be like, what it's going to look like for
- 6:14Speaker 1: their lives as they go around. They're not going to
- 6:16Speaker 1: be able to go out to dinner. They're not going
- 6:18Speaker 1: to be able to live and function this summer the
- 6:21Speaker 1: way they normally do. The amount of security they are
- 6:24Speaker 1: going to need to walk around and they and whoever
- 6:26Speaker 1: leaked this or the people that leak this. That is
- 6:28Speaker 1: exactly why they did it, and that's why they did
- 6:31Speaker 1: it on purpose. This this is a conscientious, deliberate decision
- 6:36Speaker 1: that was done by those on the left to not
- 6:40Speaker 1: only attack Alito and others, but it was to endanger
- 6:44Speaker 1: their lives. Because when you do this, that's exactly what
- 6:47Speaker 1: you get out of it. This has never happened before.
- 6:51Speaker 1: By the way, this is an unprecedented event that has
- 6:57Speaker 1: taken place. I want you to also understand that this
- 7:01Speaker 1: is unprecedented in scope, This is unprecedent in the way
- 7:04Speaker 1: that it was released. And Politico, by the way, should
- 7:07Speaker 1: have never done this because Politico has now put Supreme
- 7:10Speaker 1: Court justices lives at risk. But I'm not sure they
- 7:13Speaker 1: care because man, it's a bait. It's a great headline.
- 7:17Speaker 1: They even put it out there. Deliberations on controversial cases
- 7:20Speaker 1: have in the past been fluid. In other words, they're
- 7:23Speaker 1: implying put extreme pressure on these justices. Justice can and
- 7:27Speaker 1: sometimes do change their vote since draft opinions circulate and
- 7:30Speaker 1: major decisions can be subject to multiple drafts and vote trading. Again,
- 7:34Speaker 1: put extreme pressure on the Supreme Court. The Republican, the
- 7:37Speaker 1: conservative justices that are on there, right, because we know
- 7:41Speaker 1: who's on that side of the vote. Now, go after them,
- 7:45Speaker 1: stock them using the words of democrats, get in their face,
- 7:48Speaker 1: don't let them go shopping, don't let them pump gas,
- 7:51Speaker 1: don't let them do anything, don't let them function in society,
- 7:58Speaker 1: hound them, get in their face. Is remember when Democrats
- 8:01Speaker 1: said that about people that supported Donald Trump. You don't
- 8:04Speaker 1: think they're trying to do the exact same thing right now,
- 8:06Speaker 1: because that's exactly what they're trying to do. As exactly
- 8:10Speaker 1: what they are trying to do right now. Let's talk
- 8:15Speaker 1: about the media for a second and how they're reacting
- 8:18Speaker 1: to this. Oh, they've got some hot takes on this.
- 8:20Speaker 1: You think they're worried about the historical context of what
- 8:23Speaker 1: just happened. No, you think they're worried or upset about
- 8:31Speaker 1: this being leaked and what this does and how this
- 8:34Speaker 1: changes things with our Supreme Court, how it undermines this institution.
- 8:40Speaker 1: Absolutely not. They are not worried about that at all,
- 8:44Speaker 1: because this is great for them, This is great TV.
- 8:49Speaker 1: They don't care about anybody's lives being ruined, destroyed, stalked,
- 8:53Speaker 1: having to go into lockdown. They don't care. This is
- 8:56Speaker 1: a direct attack on the institution. They don't care because, man,
- 9:01Speaker 1: this is a great story. It's a great story for Politico,
- 9:05Speaker 1: it's a great story for everybody else involved. This is
- 9:09Speaker 1: just an amazing moment for them. This morning, Pete Williams
- 9:14Speaker 1: on the Scotus League, he has some sort of I
- 9:18Speaker 1: think journalism, journalistic integrity and understanding of the Supreme Court.
- 9:23Speaker 1: This is what he had to say on NBC MSNBC
- 9:26Speaker 1: this morning when he was asked about this. Listen straight
- 9:29Speaker 1: to the Supreme Court where we find NBC News Justice
- 9:31Speaker 1: correspondent Pete Williams. Pete, good morning. You've had a wild
- 9:35Speaker 1: to digest this, to read through some of this draft opinion.
- 9:38Speaker 1: What more are you hearing about it this morning? Well,
- 9:41Speaker 1: I think it's pretty obvious that this is as far
- 9:44Speaker 1: as you would expect an opponent of Road to go here.
- 9:46Speaker 1: This is Aldo basically demolishing all the arguments in favor
- 9:51Speaker 1: of Roe, saying it was wrongly decided from the very beginning,
- 9:54Speaker 1: marshaling all the examples. He can think of a people
- 9:57Speaker 1: who presumably supported Roe, who have always been a it's
- 10:01Speaker 1: a very far reaching a draft opinion. Now, how it's
- 10:05Speaker 1: going to come out in the end, we don't know.
- 10:07Speaker 1: I mean, typically majority opinions start out this way. You
- 10:10Speaker 1: make all of your big points, and then you take
- 10:12Speaker 1: into account that dissent and some of the fight, some
- 10:15Speaker 1: of the sharper ridges get sanded off in the process.
- 10:18Speaker 1: But one thing about this Willie that really puzzles me
- 10:20Speaker 1: is I don't understand the point of this leak. I
- 10:23Speaker 1: have been on both ends listen to this. I don't
- 10:26Speaker 1: understand the point of this leak. And this is when
- 10:28Speaker 1: it's sad that it's guys like Pete Williams here's from
- 10:31Speaker 1: the last. I think men that understand how the Court's
- 10:36Speaker 1: supposed to work, this separation of powers, that understands how
- 10:41Speaker 1: bad of a deal. This is the precedent that this
- 10:45Speaker 1: is moving forward. There are a lot of things that
- 10:47Speaker 1: you can say right now about Roe v. Wade, but
- 10:51Speaker 1: this isn't really about Roe v. Wade at this point.
- 10:53Speaker 1: This is about somebody that decided they were bigger than
- 10:58Speaker 1: the United States Constitution. On the last, this is a
- 11:01Speaker 1: liberal who decided that they wanted to put Supreme Court
- 11:04Speaker 1: justice lives at risk by leaking this, trying to put
- 11:07Speaker 1: pressure to change a vote before it comes out. I
- 11:11Speaker 1: don't think that's going to happen. But this, this is
- 11:14Speaker 1: how they don't play within the rules. Again, if you
- 11:17Speaker 1: want to understand the sickness of liberalism in America today,
- 11:22Speaker 1: the derangement, the mental disorder of liberalism when they don't
- 11:28Speaker 1: get their ways, it is exactly what you're witnessing right
- 11:30Speaker 1: now at the Supreme Court with this ruling. It's also
- 11:34Speaker 1: and and by the way, these are the top brilliant minds.
- 11:36Speaker 1: Right when you get somebody that quirts the Supreme Court,
- 11:39Speaker 1: we're talking about brilliant people, and it's infected them at
- 11:43Speaker 1: the highest levels of the Democratic Party. The most brilliant
- 11:46Speaker 1: people in the Democratic Party came up with the Russian
- 11:49Speaker 1: collusion hoax. The most brilliant people in society in the
- 11:56Speaker 1: Democratic Party came up with the Russian information campaign, Russian
- 12:01Speaker 1: collusion and everything that comes along with it. Never forget
- 12:06Speaker 1: that they're the ones that came up. The most brilliant
- 12:09Speaker 1: minds in the Democratic Party are also the ones that
- 12:11Speaker 1: came up with a you know, he had junior high
- 12:15Speaker 1: rape parties he planned right when they came after Republican
- 12:19Speaker 1: nominees under Trump, they will stop at nothing to destroy
- 12:22Speaker 1: your life. And they don't care if you die in
- 12:23Speaker 1: the process. They don't care if you are called a
- 12:26Speaker 1: rapist in the process. They don't care that Spring Court
- 12:29Speaker 1: Justice right now probably have more security they've ever had
- 12:31Speaker 1: their entire lives because of this, because that's how vile
- 12:35Speaker 1: and disgusting they are. They refuse to accept defeat when
- 12:39Speaker 1: they lose. They are like kamikaze pilots. We don't get
- 12:44Speaker 1: our way. We kill you and me. We kill everything,
- 12:46Speaker 1: we destroy everything, We ruin everything. Right, That's really what
- 12:52Speaker 1: this is. This is a seek and destroy goes scorts earth,
- 12:56Speaker 1: but not just here and there. It's on everything now.
- 13:00Speaker 1: And that's exactly why Pete Williams like, I really don't
- 13:03Speaker 1: I'm going to back it up at just a moment here.
- 13:05Speaker 1: That's why he says, I really don't understand this league.
- 13:08Speaker 1: I don't understand what they thought was going to happen.
- 13:10Speaker 1: Because he also understands how the Supreme Court works. But
- 13:13Speaker 1: one thing about this Willie that really puzzles me is
- 13:15Speaker 1: I don't understand the point of this leak. I have
- 13:19Speaker 1: been on both ends of the leaking exchange in Washington.
- 13:22Speaker 1: I'm a former government spokesman. I admit I used to
- 13:25Speaker 1: leak stuff in the past. I'm a reporter. I get
- 13:28Speaker 1: leaks now, and you know people leak to affect policy.
- 13:32Speaker 1: But for the life of me, cannot understand the point
- 13:35Speaker 1: of this leak. I think all nine justices came in
- 13:39Speaker 1: to hear this argument knowing how they were going to vote.
- 13:42Speaker 1: They voted that way right afterwards. I don't think the
- 13:45Speaker 1: argument affected It just made it clear to all of
- 13:48Speaker 1: us that they were going to vote to overturn Row.
- 13:51Speaker 1: But now, what's the point of the league? I mean,
- 13:53Speaker 1: is it possible that one of these five members is
- 13:56Speaker 1: teetering and the leaker decided they needed to do this
- 14:00Speaker 1: to cement that person in place? Or is this somebody
- 14:02Speaker 1: that opposed the decision that was just so furious they
- 14:05Speaker 1: wanted it out there. But you know, what, what good
- 14:08Speaker 1: would the leak do in terms of affecting anything. I
- 14:11Speaker 1: just don't get it. Yeah, and Pete here I've been
- 14:16Speaker 1: I mean, he gets it. Why would you do this?
- 14:19Speaker 1: What is the point of this? Well, the point is
- 14:22Speaker 1: maybe there's somebody that could possibly change their opinion, or
- 14:27Speaker 1: maybe there's a Supreme Court justice and some radical out
- 14:30Speaker 1: there will take them out. The person that leaked this
- 14:33Speaker 1: knew what the reaction was going to be from the left.
- 14:35Speaker 1: They know that the left is insane, they know that
- 14:37Speaker 1: they're radical. This isn't this isn't just about trying to
- 14:44Speaker 1: attempt to influence the outcome of the Supreme Court, which
- 14:47Speaker 1: is a massive separation of powers issue. This is about
- 14:51Speaker 1: threatening their lives. That's what this is represented. Michael Walt's
- 14:56Speaker 1: Republican Ford to have this to say about the Supreme
- 14:58Speaker 1: Court talking about this is a Cavanaugh life approached the
- 15:01Speaker 1: Supreme Court on this one. This is scorched earth ruin
- 15:04Speaker 1: their lives or try to threaten their lives. Well, I
- 15:08Speaker 1: think that's unclear at this point because it's never happened
- 15:11Speaker 1: before to my knowledge. This is this is just so
- 15:14Speaker 1: outrageous that this draft opinion was leaked. It's clearly an
- 15:18Speaker 1: attempt to influence the outcome. But guys, be prepared for
- 15:23Speaker 1: the scorched earth tactics of the left on this issue.
- 15:26Speaker 1: They truly believe the ends justify the means, no matter
- 15:30Speaker 1: what laws or what norms they have to break and
- 15:34Speaker 1: be prepared for a Cavanaugh like approach to the Supreme
- 15:39Speaker 1: Court on this one, and they are going to burn
- 15:42Speaker 1: it down as you're hearing the activists say in order
- 15:45Speaker 1: to try to stop this. And what's such a shame
- 15:48Speaker 1: is that many pro life activists, many people who believe
- 15:53Speaker 1: in the sanctity of life, abided by the law for
- 15:57Speaker 1: nearly fifty years, even though they believe that child who's
- 16:01Speaker 1: life was being unjustly taken. But I would not expect
- 16:04Speaker 1: that same courtesy from the other side for our nation's
- 16:08Speaker 1: system and for its rule of law. He's right, this
- 16:14Speaker 1: is about the rule of law. He understands it, and
- 16:19Speaker 1: so do the left when they leak this, and so
- 16:22Speaker 1: did Politico when they broke the story. And I'm sure
- 16:25Speaker 1: Politico said in behind closed doors, screw it, we're going
- 16:29Speaker 1: to run this. Who cares what happens these justices? Right?
- 16:32Speaker 1: Who cares what happens with the radicals trying to change us?
- 16:36Speaker 1: And if you don't think there's psychos out there they're
- 16:38Speaker 1: thinking about, well, maybe we just need to get rid
- 16:39Speaker 1: of one of these Spreme Court justices in the five
- 16:42Speaker 1: before this ruling comes out. And then what happens, Right,
- 16:44Speaker 1: they're vote official if they die. There's crazies out there
- 16:47Speaker 1: that think that way. And I'm sure Politico justified this
- 16:52Speaker 1: by saying, well, if we don't run it, they're just
- 16:54Speaker 1: going to go down the street to this paper, to
- 16:56Speaker 1: this online and it's gonna get out anyway. So we
- 16:59Speaker 1: might as well make some money off of it, make
- 17:01Speaker 1: a name for ourselves with it, and we're going to
- 17:03Speaker 1: be the ones that run it. Who cares, Let's go
- 17:06Speaker 1: for it. Screw everybody whose live is negatively affected by this.
- 17:10Speaker 1: We don't care how how dangerous this leak is. Are
- 17:19Speaker 1: coming out and saying that. Now the commentators and the
- 17:23Speaker 1: hosts are not. But those that understand what the Supreme
- 17:27Speaker 1: Court is in the institution, they get it. Jeffrey Tubin,
- 17:34Speaker 1: he's the senior legal analyst at CNN, the same guy
- 17:38Speaker 1: who got fired from a job for pleasuring himself on
- 17:40Speaker 1: a zoom call with other employees, who got suspended from CNN.
- 17:44Speaker 1: But they rehabbed him at seeing him because he was
- 17:46Speaker 1: a good liberal and we'll bring him back no matter what.
- 17:50Speaker 1: Jeffrey Tuban, that same guy this morning on their morning
- 17:55Speaker 1: show called New Day, said this the fact of this
- 17:58Speaker 1: league here, We've never seen anything like this. I mean,
- 18:01Speaker 1: you know, I've covered the Court for pushing thirty years now.
- 18:03Speaker 1: This is so outside the history of the Supreme Court.
- 18:07Speaker 1: There have been very occasional leaks of votes in cases
- 18:12Speaker 1: you know the Court is going to vote a certain
- 18:14Speaker 1: certain way, but a draft opinion has never been released,
- 18:19Speaker 1: and a draft opinion in a case of monumental significance.
- 18:24Speaker 1: This is going to damage the institution of the Supreme Court.
- 18:28Speaker 1: Regardless of what you think about abortion. This was already
- 18:32Speaker 1: an institution that was much less popular than it used
- 18:35Speaker 1: to be. But the manner in which this is coming
- 18:38Speaker 1: to public view is an real indictment of how this
- 18:43Speaker 1: court operates. Jeffrey Jennifer, thank you both for helping us
- 18:47Speaker 1: understand this. Now what does this bring me to? And
- 18:50Speaker 1: I'm trying to connect doubts as fast as i can.
- 18:53Speaker 1: This is now going to be justification for Joe Biden
- 18:56Speaker 1: packing the Supreme Court. You can't let the Supreme Court
- 19:00Speaker 1: stay at nine. You need to pack that court so
- 19:02Speaker 1: we can get our way. There are two there are
- 19:05Speaker 1: three takeaways. And again I'm still seeing and looking at
- 19:10Speaker 1: this fallout. This is in my initial reaction. But my
- 19:13Speaker 1: initial reactions number one, this is a kill list against
- 19:15Speaker 1: the five people that we're going to vote in favor
- 19:19Speaker 1: of this opinion, right, that are on the side that Rov.
- 19:21Speaker 1: Wade is bad law, which it is. Right, that's number one.
- 19:26Speaker 1: Number two, This is going to justify the Democrats ahead
- 19:29Speaker 1: of the midterms, packing the court and that maybe this
- 19:31Speaker 1: may be their campaign issue now, actually not, maybe this
- 19:34Speaker 1: is their campaign issue. Vote for us and we'll pack
- 19:37Speaker 1: the court. Vote for us, and we'll stop things like
- 19:39Speaker 1: this from happening. Right, you must keep us in the
- 19:41Speaker 1: majority because we must keep sending liberal Supreme Court justice
- 19:45Speaker 1: to rule the overrule of these radical Republicans on the right.
- 19:51Speaker 1: It's a kill list, it's to undermine, it's to justify
- 19:55Speaker 1: court packing, all of these things. Liberalism is a mental
- 20:02Speaker 1: disease when you do this to an institution like this
- 20:05Speaker 1: is a mental disease when you think that the rules
- 20:07Speaker 1: don't apply to you because you have grown up to
- 20:10Speaker 1: believe that whatever it is that you believe is far
- 20:14Speaker 1: superior to anyone else. Because that's what whoever leaked this,
- 20:18Speaker 1: or the people that leak this, that's what they thought.
- 20:22Speaker 1: There's not a lot of people, by the way, that
- 20:24Speaker 1: would even see this, So you understand how Supreme Court works.
- 20:26Speaker 1: I just sent a message to somebody that worked to
- 20:29Speaker 1: the Supreme Court, and I asked them. I was like,
- 20:31Speaker 1: how many people are going to be able to even
- 20:32Speaker 1: see this? And they said, look, this is maybe forty people,
- 20:38Speaker 1: maybe forty five at the most. As it was said
- 20:41Speaker 1: earlier today, it's an unprecedented betrayal by one of the
- 20:44Speaker 1: forty five or so people with access to a draft
- 20:47Speaker 1: Supreme Court opinion to prevent this decision from becoming law
- 20:50Speaker 1: by scaring off moderate justices and attempting to whip the
- 20:54Speaker 1: political left into a psychotic frenzy. There are five key points,
- 21:00Speaker 1: by the way to realize about this opinion and how
- 21:02Speaker 1: it's shockingly could have happened, and why the Supreme Court
- 21:06Speaker 1: will suffer damage, damage that you'll never be able to
- 21:10Speaker 1: undo if one of the majority justices switched asides, because
- 21:13Speaker 1: then it's like, well, every time you don't like something,
- 21:15Speaker 1: elak it. First, what the sixty seven page opinion says.
- 21:21Speaker 1: We hold that Roe v. Wade must be overruled. The
- 21:23Speaker 1: Constitution makes no reference to abortion, and no such right
- 21:26Speaker 1: as implicitly protected by any constitutional provision, including the one
- 21:30Speaker 1: on which the defenders of Row and Casey now chiefly
- 21:34Speaker 1: rely the due process clause of the Fourteenth Amendment. That
- 21:38Speaker 1: provision has been held to guarantee some rights that are
- 21:41Speaker 1: not mentioned in the Constitution, but in such right must
- 21:44Speaker 1: be deeply rooted in this nation's history and tradition, and
- 21:47Speaker 1: implicit in the concept of ordered liberty. The opinion reads,
- 21:52Speaker 1: the right to abortion does not fall into this category
- 21:55Speaker 1: until the later part of the twentieth century, such as
- 21:58Speaker 1: such a right was entire highly unknown to American law. Indeed,
- 22:02Speaker 1: when the Fourteenth Amendment was adopted, three quarters of the
- 22:05Speaker 1: states made abortion a crime at all stages of pregnancy.
- 22:10Speaker 1: The abortion right is also critically different from any other
- 22:13Speaker 1: right that the Court is held to fall within the
- 22:15Speaker 1: Fourteenth Amendments Protection of liberty road defenders characterize the abortion
- 22:20Speaker 1: right is similar to the right recognizing past decisions involving
- 22:23Speaker 1: matters such as intimate sexual relations, contraception, and marriage, but
- 22:29Speaker 1: abortion is fundamentally different, as both row in case he acknowledged,
- 22:33Speaker 1: because it destroys what those decisions called feet of life
- 22:38Speaker 1: and what the law now before us describes as an
- 22:41Speaker 1: unborn human being. The opinion discusses at length whether Constitution
- 22:48Speaker 1: is originally, as originally understood, include a right to abortion,
- 22:53Speaker 1: concluding it does not. It then goes on for many
- 22:56Speaker 1: pages of the features of the legal policy of when
- 23:01Speaker 1: to adhere to Court precedent and explains why it does
- 23:05Speaker 1: not require upholding rose right to abortion. Then, finally, on
- 23:09Speaker 1: page sixty two, it addresses the point that whoever betrayed
- 23:14Speaker 1: the Court was likely trying to make with this unprecedented
- 23:18Speaker 1: violation of trust. Quote. The American people's belief in the
- 23:22Speaker 1: rule of law would be shaken if they lost respect
- 23:25Speaker 1: for this Court as an institution that decides important cases
- 23:28Speaker 1: based on principal, not social and political pressures. Quote. But
- 23:36Speaker 1: we cannot exceed the scope of our authority under the Constitution,
- 23:39Speaker 1: and we cannot allow our decisions to be affected by
- 23:41Speaker 1: the extraneous influences, such as concern about the public's reaction
- 23:46Speaker 1: to our work. Alito responds to the Court, that is both.
- 23:51Speaker 1: That is true both when we initially decided excuse me,
- 23:55Speaker 1: when we initially decide a constitutional issue, and when we
- 23:58Speaker 1: consider whether to over rule a prior decision. Secondly, why
- 24:03Speaker 1: the opinion is probably genuine and an air of word
- 24:07Speaker 1: processors fraudsters can make documents that physically look like the
- 24:10Speaker 1: real thing, but this is different. Experts are now saying, First,
- 24:14Speaker 1: Supreme Court opinions are dense and complex. They're extremely carefully
- 24:19Speaker 1: written and are full of citations and quotations. Experience appellet
- 24:24Speaker 1: attorneys know what to look for and all this carries
- 24:28Speaker 1: all the hallmarks of that. That's why it clearly is
- 24:31Speaker 1: real and by the way, Supreme Court probably would have
- 24:33Speaker 1: come out and said if it wasn't. Also, each justice
- 24:36Speaker 1: has his or her own voice. This reads like an
- 24:39Speaker 1: opinion by sam Alito, experts are now saying, so there's
- 24:42Speaker 1: every reason to believe he authored the first draft. And
- 24:45Speaker 1: given that the DABS case was argued on December first,
- 24:48Speaker 1: the time stamp of February ten on this draft would
- 24:51Speaker 1: fit a normal opinion writing time frame for something of
- 24:54Speaker 1: this scope. Third, how this could have happened and why
- 25:00Speaker 1: the only people who definitively have access to this are
- 25:04Speaker 1: the nine justices and their thirty six law clerks. Four
- 25:09Speaker 1: law clerks are assigned to each justice, for a total
- 25:11Speaker 1: of only forty five people. It is almost certain that
- 25:15Speaker 1: it had to have been one of the law clerks.
- 25:17Speaker 1: Are multiple clerks working on the same team, who would
- 25:21Speaker 1: take the ultimate credential a young lawyer can achieve and
- 25:25Speaker 1: instead put himself for herself on track to never be
- 25:28Speaker 1: licensed to practice law in the nation. Fourth, why this
- 25:32Speaker 1: might not actually become the actual decision of the Supreme
- 25:34Speaker 1: Court takes five votes on the nine member court to
- 25:37Speaker 1: make it a majority opinion. When cases are argued that
- 25:40Speaker 1: justices have a weekly closed door conference on Friday at
- 25:44Speaker 1: which they discuss the case, take a preliminary vote, and
- 25:47Speaker 1: one justice when the majority, is assigned the task of
- 25:49Speaker 1: writing the opinion. After the opinion has written into circulate
- 25:53Speaker 1: to the other justices, that is when the negotiating begins,
- 25:56Speaker 1: where justice say that they could join if certain changes
- 25:59Speaker 1: are made, and others decide to dissent and organize that
- 26:04Speaker 1: writing effort. Still, other justices join the majority judgment, but
- 26:10Speaker 1: right concurring opinions to emphasize some point important to them.
- 26:16Speaker 1: At any time during this process, justices can change their vote,
- 26:22Speaker 1: and it happens often. The cases do not grab headlines,
- 26:26Speaker 1: but earth shattering decisions like the one upholding Obamacare in
- 26:30Speaker 1: twenty twelve bears the hallmark of such a case. This
- 26:35Speaker 1: then appears to be an effort to intimidate a moderate
- 26:39Speaker 1: conservative justice to switch sides, in which the case this
- 26:44Speaker 1: opinion would become a dissenting opinion and a liberal justice
- 26:47Speaker 1: opinion would speak for the majority. Then there's a threat
- 26:51Speaker 1: here which I mentioned a moment ago of court packing.
- 26:54Speaker 1: In the nineteen thirty seven Jones and Laughlin steelcase, two
- 26:59Speaker 1: Supreme Court justice switch from years of their own presence
- 27:03Speaker 1: to reinterpret the commerce caused the Constitution fundamentally transforming the
- 27:09Speaker 1: power of the federal government over the nation. They did
- 27:12Speaker 1: this in an unnecessary attempt to stop FDR's plan to
- 27:15Speaker 1: pack the Court with six new justices for a total
- 27:18Speaker 1: of fifteen. It was unnecessary because the plan was already collapsing,
- 27:24Speaker 1: but the public intimidation convinced a couple of members of
- 27:27Speaker 1: the Court to virtually transform the nation. Democrats have explored
- 27:32Speaker 1: court packing over the past two years for the first
- 27:34Speaker 1: time in eight decades. Doubtless, many on the left will
- 27:37Speaker 1: claim that now they have to do it, so this
- 27:41Speaker 1: will be worth it to justify their means in the
- 27:44Speaker 1: elections coming up. Finally, the Supreme Court's credibilities at stake
- 27:48Speaker 1: to see this through. If anyone switches their vote because
- 27:51Speaker 1: of this, the Court will take more than a generation
- 27:54Speaker 1: regain the trust the American people. To the contrary, the
- 27:58Speaker 1: Justice should double down. This is likely a five four
- 28:01Speaker 1: decision because this betrayal looks like an intimidation tactic. Yet
- 28:05Speaker 1: one justice to change his or her mind. Since decision
- 28:08Speaker 1: is in many ways out, those five should stop the
- 28:11Speaker 1: pressure by all sign the latest version of it and
- 28:14Speaker 1: publishing it immediately as a binding decision of the Court.
- 28:17Speaker 1: Those would dissents or concurrences can publish them later if
- 28:20Speaker 1: they are so inclined. But this shameful debate, shameful debacle
- 28:27Speaker 1: of a debate, and the immediate pressure campaign it is creating,
- 28:31Speaker 1: should in now with the Court handing down the decision
- 28:34Speaker 1: and Dabbs immediately. As the page sixty five of the
- 28:38Speaker 1: League opinion explains, quote, we do not pretend to know
- 28:41Speaker 1: how our political system or society will respond to today's
- 28:44Speaker 1: decision overruling Robe and Casey, And even if we could
- 28:49Speaker 1: foresee what will happen, we would have no authority to
- 28:53Speaker 1: let the knowledge influence our decisions. We can only do
- 28:57Speaker 1: our job, which is to interpret the law, applying longstanding principles,
- 29:02Speaker 1: and decide this case accordingly. We therefore hold the Constitution
- 29:07Speaker 1: does not confer a right to abortion. Rowan Casey must
- 29:11Speaker 1: be overruled and the authority to regulate abortion must be
- 29:13Speaker 1: returned to the people, and they're elected representatives. In other words,
- 29:17Speaker 1: states rights issue doesn't mean, by the way, that abortion
- 29:20Speaker 1: is illegal in America. I want to make that clear.
- 29:22Speaker 1: It means that states are going to get to decide
- 29:24Speaker 1: what they want to do in each state, and liberal
- 29:26Speaker 1: states will still have abortion. Conservative states will probably get
- 29:29Speaker 1: rid of it at the end of the day. What
- 29:33Speaker 1: the Democrats did here to the court, what this person did,
- 29:36Speaker 1: which I hope they find them, arrest them and dispar
- 29:38Speaker 1: them for life, was to influence the court, pack the court.
- 29:42Speaker 1: And by the way, whoever leaked this will become a
- 29:44Speaker 1: hero of the left. They will get six figure book deals,
- 29:47Speaker 1: speaking engagements, they will probably head the National Organization of Women.
- 29:52Speaker 1: They're going to be just fine. And they made that
- 29:54Speaker 1: calculated decision to do this. They're gonna get paid one
- 29:57Speaker 1: way or another. They're gonna go They're gonna be a
- 29:59Speaker 1: women's right, it's advocate for life, and they will become
- 30:02Speaker 1: a hero of the left. And this was a kill
- 30:04Speaker 1: list to go after these five people. Never forget that,
- 30:10Speaker 1: all right. Lastly, please make sure you hit that subscribe
