Latest / The Ben Ferguson Podcast / Election Interference Case Continues w Gag Order Appeal Denied
Transcript
- 0:01Speaker 1: The court has ruled against Donald Trump. No shocker there
- 0:05Speaker 1: and his gag order appeal. Clearly it is election interference.
- 0:11Speaker 1: The fact that Michael Cohen can make money off of
- 0:13Speaker 1: attacking Donald Trump as the starlying witness of this entire
- 0:18Speaker 1: court case pending on hinging on his testimony, and it
- 0:23Speaker 1: has been a total you know what show during his
- 0:26Speaker 1: time in front of the court. Now, let's go back
- 0:30Speaker 1: to the gag order that I started with a second ago.
- 0:32Speaker 1: Former President Trump will remain and gag during his criminal
- 0:38Speaker 1: trial in Manhattan. The New York Appeals Court has ruled
- 0:41Speaker 1: Trump can now petition. However, the New York Court of
- 0:45Speaker 1: Appeals the gag order prevents Trump from making public comments
- 0:50Speaker 1: about witnesses participating in the trial. That obviously means he's
- 0:55Speaker 1: not allowed to talk about Michael Cohen, even though Michael
- 0:59Speaker 1: Cohen is allowed to talk about him, do a podcast,
- 1:02Speaker 1: make money attacking Trump anywhere they'll put him on TV,
- 1:06Speaker 1: and he's doing it a lot, So.
- 1:08Speaker 2: That's number one.
- 1:10Speaker 1: Also, he is gaged from talking about the council other
- 1:14Speaker 1: than the Manhattan District Attorney Alvin Bragg, members of the
- 1:17Speaker 1: court's staff, and the District Attorney's staff. Or the family
- 1:20Speaker 1: members of any council or staff member, if those statements
- 1:24Speaker 1: are made with the intent to materially interfere with the
- 1:27Speaker 1: councils or staff's work on the case. It also encompasses
- 1:31Speaker 1: prospective jurors. The order reads, we find that Justice Merchant
- 1:38Speaker 1: properly waged Petitioners' First Amendment rights against the Court's historical
- 1:42Speaker 1: commitment to ensuring the fair administration of justice in criminal
- 1:46Speaker 1: cases and the right of persons related or tangibly related
- 1:53Speaker 1: to the criminal proceedings from being free from threats, intimidation, harassment,
- 1:58Speaker 1: and harm. Yet all of those things can happen to
- 2:01Speaker 1: Donald Trump, the former president of the United States of America,
- 2:04Speaker 1: while he's the front runner running for president, and while
- 2:07Speaker 1: everyone else can rip on him, he can't defend himself.
- 2:11Speaker 2: Yeah, so they say the judge did it great.
- 2:15Speaker 1: Justice Merchant properly determined the petitioner's public statements pose a significant.
- 2:19Speaker 2: Threat to the integrity.
- 2:21Speaker 1: The order goes on to say of the testimony of
- 2:24Speaker 1: witnesses and potential witnesses in this case as well. Donald
- 2:28Speaker 1: Trump's team argue that the gag order is unconstitutional. You
- 2:31Speaker 1: asked my question, ask me questions I'm not allowed to respond,
- 2:35Speaker 1: is what Trump told reporters Tuesday morning before walking into
- 2:38Speaker 1: the courtroom. Quote, the gag order has to come off,
- 2:42Speaker 1: the President said, I've got a lot more on this,
- 2:45Speaker 1: but let me tell you real quick about my cell
- 2:47Speaker 1: phone provider.
- 2:48Speaker 2: And an important notice for you.
- 2:50Speaker 1: If you have a cell phone, you may not realize
- 2:53Speaker 1: that when you pay your bill every month to Big Mobile,
- 2:56Speaker 1: you are funding the left. Yes, they are big, big
- 3:00Speaker 1: advocates and write big checks to democratic causes as well
- 3:04Speaker 1: as candidates running at the national, state and local level.
- 3:08Speaker 1: You may not realize that when you pay your bill
- 3:10Speaker 1: to Big Mobile, they're also giving big notations to plan parenthood.
- 3:14Speaker 2: And that is why I made the switch. Now.
- 3:17Speaker 1: Look, Patrion Mobile's been around for over a decade, but
- 3:19Speaker 1: the number one reason why people have not changed in
- 3:21Speaker 1: the past is because they're like, well, there's no way
- 3:24Speaker 1: that their service can be as good as what I
- 3:26Speaker 1: have with Big Mobile. Guess what, not true anymore. Because
- 3:29Speaker 1: of how it works in technology, you'll use the same
- 3:32Speaker 1: exact towers that you're using right now. Yeah, the same
- 3:35Speaker 1: network that you're used to, the same coverage you're used to.
- 3:38Speaker 2: You're going to get.
- 3:38Speaker 1: Without the woke radical agenda of the left being funded
- 3:43Speaker 1: when you pay your bill. Now, the other reason why
- 3:45Speaker 1: people don't switch is actually pretty simple. It's because they
- 3:49Speaker 1: think it is just going to be too complicated. Well,
- 3:52Speaker 1: let me get rid of that idea for you, because
- 3:54Speaker 1: I switched the line just the other day, and it's
- 3:56Speaker 1: incredibly easy.
- 3:57Speaker 2: I didn't have to go to.
- 3:58Speaker 1: A store, I didn't all over the phone with an
- 4:02Speaker 1: amazing customer service team that's one hundred percent US based
- 4:06Speaker 1: with Patriot Mobile.
- 4:07Speaker 2: So whether it's you, your family of business, call them.
- 4:11Speaker 1: You'll probably save money over what you're spending right now.
- 4:13Speaker 1: And every time you pay your bill, you're going to
- 4:16Speaker 1: be supporting conservative causes because about five percent of your
- 4:20Speaker 1: bill every month goes back at no extra cost to you,
- 4:23Speaker 1: to conservative organizations to protect our first our Second Amendment rights,
- 4:27Speaker 1: the rights of unborn children, and support our wounded warriors,
- 4:32Speaker 1: our veterans, and our first responder heroes.
- 4:35Speaker 2: So if you're ready to make.
- 4:36Speaker 1: A difference, every time you make a phone call, call
- 4:39Speaker 1: Patriot Mobile nine seven to two Patriot it's nine seven
- 4:43Speaker 1: to Patriot, nine seven to two Patriot or Patriot Mobile
- 4:46Speaker 1: dot com slash ben and use the promo code. Ben
- 4:49Speaker 1: you'll get free activation as well. Nine to seven to
- 4:52Speaker 1: two Patriot. Now, let me go back to what Trump
- 4:56Speaker 1: had argued in this gag order, saying it is quote unconstitutional.
- 5:00Speaker 2: Earlier in May, New.
- 5:02Speaker 1: York court judge Merchant ruled for a second time that
- 5:06Speaker 1: Trump violated his gag order during the trial, holding him
- 5:09Speaker 1: in criminal contempt and threatening to jail him for any
- 5:12Speaker 1: further infractions. Merchant find Trump one thousand dollars for a
- 5:16Speaker 1: single violation, previously fined Trump for nine different violations.
- 5:22Speaker 2: Trump's tenth contempt defense.
- 5:24Speaker 1: Occurred before the last order and not afterwards. Trump did
- 5:30Speaker 1: not push the boundaries after the gag order ruling. Apparently
- 5:33Speaker 1: he was looking for the state to step in or
- 5:36Speaker 1: this appeals court, and they did not.
- 5:39Speaker 2: Now, obviously he can appeal.
- 5:41Speaker 1: Now we'll see what the president decides to do, which
- 5:44Speaker 1: brings me back to this court case. James Carvill. He's
- 5:49Speaker 1: a former Clinton strategist. James Carvill is a guy that
- 5:52Speaker 1: is well known in democratic circles to give brilliant advice to.
- 5:57Speaker 2: Democratic candidates and.
- 5:58Speaker 1: Causes losing his mind now because he says what we
- 6:02Speaker 1: were hoping was going to happen in this court case
- 6:05Speaker 1: is not working. Take a listen to what he had
- 6:09Speaker 1: to say, and then also what tw Shannon had to
- 6:11Speaker 1: say on the Trump hush money trial as well on
- 6:14Speaker 1: Fox Trump's.
- 6:16Speaker 3: Boy ahead than he's ever been more fewer people think
- 6:21Speaker 3: January sixth was of any kind of What it was
- 6:24Speaker 3: was an assault on the temple of democracy to a constitution.
- 6:29Speaker 3: I don't know, whatever you want to say, it's going
- 6:32Speaker 3: the wrong way. It's not working. Everything that we're throwing
- 6:38Speaker 3: is spaghetti at a wall, and none of it is
- 6:41Speaker 3: sticking me.
- 6:43Speaker 4: Included are you seeing and believing what you're hearing from
- 6:48Speaker 4: democratic and we.
- 6:50Speaker 2: Know who he is.
- 6:50Speaker 4: James Carville, analysts, strategists, wear's a lot of.
- 6:54Speaker 2: Hats right now.
- 6:55Speaker 4: He's wearing the hat of saying the quiet part out loud.
- 6:57Speaker 4: I thought the justice system was justice system, but he
- 7:01Speaker 4: says everything that Democrats are throwing at them, well, that's
- 7:04Speaker 4: an admission that this is all part of what some
- 7:06Speaker 4: kind of a game against Trump, and it's not working.
- 7:10Speaker 4: TW Shannon, former Oklahoma House speaker and attorney himself. When
- 7:14Speaker 4: you lose, James Carville and Al Sharpton saying similarly, like
- 7:18Speaker 4: how can democrats talk about January sixth. If all the
- 7:22Speaker 4: protesting is going on and so on and so forth,
- 7:25Speaker 4: we look like what we say we hate.
- 7:28Speaker 2: Or whatever I'm paraphrasing here.
- 7:29Speaker 5: It's like animal farm Haris where you know, we've all
- 7:32Speaker 5: become the pigs in this country now the very thing
- 7:34Speaker 5: we say we hate, the Democrats have actually become. I mean, listen,
- 7:37Speaker 5: this is what you've got to believe if you believe
- 7:39Speaker 5: this case. Because the Democrats can't be Donald Trump at
- 7:41Speaker 5: the ballot box. They're trying to beat them in the
- 7:43Speaker 5: jury box. But the truth is, this case is built
- 7:46Speaker 5: on two things. It's built on a liar, a professional liar,
- 7:49Speaker 5: and a whore. And I use that as a biblical
- 7:51Speaker 5: term because she's accepted money for sex. But you've got
- 7:55Speaker 5: the liar now who's actually horing himself out selling merch
- 7:58Speaker 5: and propaganda the trial.
- 8:00Speaker 6: And you've got the whore who's actually become the liar.
- 8:03Speaker 5: I mean, this whole case in and of itself flies
- 8:05Speaker 5: in the face of our very democracy, our republic, our
- 8:09Speaker 5: founding fathers are turning over because at the end of
- 8:11Speaker 5: the day, what you've got to believe, if you believe
- 8:12Speaker 5: the case of Alvin Brad's is that Donald Trump should
- 8:17Speaker 5: have used campaign funds in order to obtain this agreement
- 8:21Speaker 5: that he had with Stormy Daniels. As part of the
- 8:23Speaker 5: agreement that they have as a non disclosure. This is
- 8:26Speaker 5: not a campaign expense. Cohen even admitted it. Yes, Yes,
- 8:30Speaker 5: So the fact that this case has fallen apart, we
- 8:33Speaker 5: see it happening before our very eyes. And I'm so
- 8:35Speaker 5: glad we've got the Speaker of the House and others
- 8:37Speaker 5: there because this is a constitutional crisis that we're facing,
- 8:41Speaker 5: and these people have taken an oath of office. They
- 8:43Speaker 5: should be there in support of our president. Anybody should
- 8:46Speaker 5: who cares about this country in the constitution.
- 8:47Speaker 1: Yeah.
- 8:47Speaker 2: And by the way, he did admit to that yesterday.
- 8:50Speaker 2: He admitted he paid for it.
- 8:52Speaker 1: He admitted that he did this the way that Donald
- 8:55Speaker 1: Trump said it was done, and that he's also a
- 8:58Speaker 1: serial liar.
- 8:59Speaker 2: In Michael Cohen.
- 9:00Speaker 1: And yet the entire case hinges on his testimony. Many politicians,
- 9:07Speaker 1: by the way, on the Republican side are now stepping
- 9:09Speaker 1: up and showing a very focused support strategy for Donald Trump.
- 9:17Speaker 1: Speaker of the House Mike Johnson saying this earlier today
- 9:21Speaker 1: about the entire case.
- 9:23Speaker 7: President Trump is a friend, and I wanted to be
- 9:26Speaker 7: here to support him. I'm here speaking with you outside
- 9:29Speaker 7: because the court won't allow us to speak inside the building.
- 9:33Speaker 8: That's just one of the many things that are wrong here.
- 9:35Speaker 7: This is the fifth week that President Trump has been
- 9:38Speaker 7: in court for this sham of a trial. They are
- 9:42Speaker 7: doing this intentionally to keep him here and keep him
- 9:45Speaker 7: off of the campaign trail. I think everybody in the
- 9:48Speaker 7: country can see that for what it is. I'm an attorney,
- 9:51Speaker 7: I'm a former litigator myself.
- 9:53Speaker 8: I am disgusted by what is happening here.
- 9:56Speaker 7: What is being done here to our entire system of
- 9:59Speaker 7: justice overall. The people are losing faith right now in
- 10:02Speaker 7: this country, in our institutions. They're losing faith in our
- 10:06Speaker 7: system of justice. And the reason for that is because
- 10:09Speaker 7: they see it being abused as it is being done.
- 10:12Speaker 8: Here in New York. The facts here are very important.
- 10:15Speaker 7: Facts are always important in a trial, or at least
- 10:17Speaker 7: they're supposed to be. The President's actions in this matter
- 10:21Speaker 7: were previously reviewed and no charges were filed. Why is
- 10:26Speaker 7: that because there's no crime here. Now eight years later,
- 10:30Speaker 7: suddenly they've resurrected this thing. They brought it back, And
- 10:33Speaker 7: why is that we'll just apply common sense. Everyone can see.
- 10:37Speaker 7: It's painfully obvious that we are now six months out
- 10:41Speaker 7: from an election day, and that's the reason, that is
- 10:44Speaker 7: the reason why they brought these charges here and across
- 10:47Speaker 7: the country.
- 10:49Speaker 2: Eight years later, they brought it back.
- 10:51Speaker 1: Speaker Johnson absolutely rat right where he said, the facts
- 10:55Speaker 1: are very important. The facts are important in this trial,
- 10:58Speaker 1: at least they were supposed to be. And this is
- 11:02Speaker 1: a witch hunt. There was no crime, right, that's what
- 11:07Speaker 1: he said. The President's actions in this matter were previously
- 11:11Speaker 1: reviewed by the DOJ and no charges were filed. Why
- 11:16Speaker 1: is that because there was no crime here? Now eight
- 11:19Speaker 1: years later, suddenly they resurrect this saying they brought it back.
- 11:22Speaker 1: And why well, because it's six months out from an election,
- 11:28Speaker 1: and that's the reason. That's the reason why they brought
- 11:31Speaker 1: these charges here and across the country to try to
- 11:34Speaker 1: have real interference in this election.
- 11:37Speaker 2: Which brings me to Alan Dersowitz.
- 11:40Speaker 1: Alan Dershowitz went on Newsmax and he said this about
- 11:43Speaker 1: the Democrats and what they're doing.
- 11:46Speaker 9: Purpose of this trial is threefold. Number one, to convict
- 11:50Speaker 9: him down and dirty before the election. Although we'll get
- 11:52Speaker 9: reversed after the election. Number two, to have a gag
- 11:56Speaker 9: order on him, and number three to keep him locked
- 11:58Speaker 9: up in the courtroom so he can't That's a campaign
- 12:02Speaker 9: and those goals may very well be accomplished. This is
- 12:06Speaker 9: election interference at its most obvious. And every American, no
- 12:13Speaker 9: matter whether you're for Trump or against them, I'm not
- 12:16Speaker 9: you know, I voted for Biden. Whatever your political affiliation is,
- 12:20Speaker 9: I'm a Democrat. You should be equally concerned about how
- 12:24Speaker 9: this legal system is being weaponized and abused for partisan purposes.
- 12:31Speaker 1: Alan Dirtzewitz, by the way, is no massive Trump fan.
- 12:34Speaker 1: To be clear, this is a guy that's been more liberal.
- 12:37Speaker 1: He's a guy that is a Harvard law professor.
- 12:41Speaker 2: But he is right.
- 12:42Speaker 1: The three reasons convict him down and dirty before the
- 12:45Speaker 1: election is to say, look, he's a convicted guy. Right,
- 12:49Speaker 1: This guy's a criminal. Donald Trump's a criminal. You don't
- 12:51Speaker 1: want a criminal, believe the president of the United States
- 12:53Speaker 1: of America.
- 12:55Speaker 8: Never.
- 12:55Speaker 1: By the way, don't let's not talk about comparing contrast
- 12:59Speaker 1: with the Biden crime family and what they've gotten away with.
- 13:02Speaker 1: But he's right that that's number one. Number two, he's
- 13:05Speaker 1: right to have a gaggard on him. So he can't
- 13:07Speaker 1: defend himself against the attacks from Michael Cohen or anyone
- 13:10Speaker 1: else in the left that is involved in this trial,
- 13:12Speaker 1: which is also again disgusting. And as he said number three,
- 13:16Speaker 1: which I actually think is the Democrat's most important reason
- 13:20Speaker 1: for doing this, and the timing of it, is to
- 13:22Speaker 1: keep Donald Trump locked up in the courtroom so he
- 13:25Speaker 1: can't go out on the campaign trail, and those goals
- 13:28Speaker 1: may very well be accomplished here. He said, this is
- 13:33Speaker 1: election interference, and it's most obvious in every American, no
- 13:36Speaker 1: matter whether you're for Trump or against him, you should
- 13:40Speaker 1: be able to see it. And I agree with him,
- 13:41Speaker 1: by the way, this is something that everyone should be
- 13:44Speaker 1: able to see.
- 13:46Speaker 2: Now.
- 13:46Speaker 1: I'm glad that Republicans are coming to his aid. I
- 13:49Speaker 1: think this is a smart response. If you can't be
- 13:53Speaker 1: out there campaigning, then at least have people that are
- 13:57Speaker 1: out there at campaigning on your behalf, making statement on
- 14:00Speaker 1: your behalf, have a united front here to talk about
- 14:04Speaker 1: just how egregious all of this is.
- 14:07Speaker 2: Having the Speaker of the House.
- 14:08Speaker 1: Go to New York to this court to do this
- 14:11Speaker 1: press conference and to answer these questions and to bring
- 14:14Speaker 1: up these different things that he just did. Is exactly
- 14:17Speaker 1: what the conservative movement should be doing for Donald J.
- 14:20Speaker 1: Trump because he cannot campaign right now. And everybody knows it,
- 14:27Speaker 1: like every like, the Democrats know it, the media know it.
- 14:30Speaker 2: They all know it.
- 14:32Speaker 1: Byron Donald's said this outside the courthouse as well as
- 14:35Speaker 1: he was sitting there with Vivik Garramswami and others.
- 14:37Speaker 10: Listen, ladies and gentlemen of America. This this trial is
- 14:41Speaker 10: a joke. This thing is a farce. We were in
- 14:44Speaker 10: there all morning. Michael Cowen basically sat there and said, yeah,
- 14:49Speaker 10: he did voids legal expenses. The Trump campaign, the Trump organization,
- 14:53Speaker 10: not the campaign, paid out money in legal expenses. Where's
- 14:57Speaker 10: the crime. There is no crime. The crime that's happening
- 15:01Speaker 10: here is this Democrat judge and the Democrat Party prosecuting
- 15:05Speaker 10: their political rival right in the middle of a presidential election.
- 15:09Speaker 10: The crime here is that the issues facing our nation
- 15:12Speaker 10: are not being addressed by the Democrats, but they want
- 15:15Speaker 10: to go after Donald Trump.
- 15:17Speaker 8: And there's nothing wrong.
- 15:18Speaker 10: There's nothing that has been wrong here, nothing that has
- 15:21Speaker 10: been done poorly by President Trump. The only thing that's
- 15:24Speaker 10: being done wrong is by this judge. His daughter's making
- 15:28Speaker 10: money raising money for Democrats, and all of the fundraising
- 15:32Speaker 10: emails and all the fundraising things are about this trial
- 15:35Speaker 10: that his daughter is using. He will recuse himself. This
- 15:38Speaker 10: is a travesty of justice, This is a misuse of
- 15:41Speaker 10: the justice system. And look around New York. New York's
- 15:44Speaker 10: got plenty of issues. I'm from Brooklyn, New York. You
- 15:47Speaker 10: have all of NYPD's finance down here because of this
- 15:50Speaker 10: travesty going on in that courtroom. Meanwhile, the citizens of
- 15:54Speaker 10: New York are less safe, and the district attorney in
- 15:56Speaker 10: New York is not prosecuting real crime.
- 15:59Speaker 8: He's a sorrow's.
- 16:01Speaker 10: Back da going after his chief political rival in Donald Trump.
- 16:05Speaker 10: America is better than this, and so unfortunately it's going
- 16:08Speaker 10: to take the American people this November to let their
- 16:12Speaker 10: voices be heard on this travesty of justice that's occurring
- 16:16Speaker 10: and making sure that Donald Trump is the forty seventh
- 16:18Speaker 10: president of the United States.
- 16:21Speaker 1: Byron Donald's, I think brings up some really good points here.
- 16:25Speaker 1: And look, the media is filling this as well. George Stepanopolis,
- 16:30Speaker 1: former Press Secretary, White House Press Secretary, Bill Clinton, a
- 16:33Speaker 1: guy that you now know on NBC News or is
- 16:35Speaker 1: it CBS. I can't even remember because I never watched
- 16:37Speaker 1: it anymore, but he hosts that, you know, Good Morning America,
- 16:41Speaker 1: whatever it is, and he was on MSNBC and one
- 16:47Speaker 1: of the things that he said on MSNBC is that
- 16:52Speaker 1: if Trump wins, the situation room quote unquote will be uncontrolled.
- 16:58Speaker 1: This is exactly what the media and the left said
- 17:01Speaker 1: last time. Trump was going to if he became president
- 17:04Speaker 1: in sixteen, Right, Oh, he's going to take us into
- 17:06Speaker 1: World War three?
- 17:07Speaker 2: Did he put us in any wars? No, he didn't.
- 17:10Speaker 2: He did not put us in any wars.
- 17:12Speaker 10: Oh.
- 17:12Speaker 2: He can't be trusted with the nuclear codes.
- 17:15Speaker 8: Right?
- 17:15Speaker 1: What are the checks and balances that the president decides to,
- 17:18Speaker 1: you know, shoot a nuclear weapon in another country? Is
- 17:21Speaker 1: are people in place to stop him?
- 17:23Speaker 10: Right?
- 17:23Speaker 2: Those are the That was the media coverage.
- 17:26Speaker 1: You can't trust Donald Trump with nuclear weapons. He may
- 17:30Speaker 1: just wake up one day and decided to start blowing
- 17:33Speaker 1: up the world. I guess Democrats think, all right, well
- 17:36Speaker 1: we got to go back to that. It worked last time,
- 17:38Speaker 1: we might as well do it again this time. Listen
- 17:40Speaker 1: to George Stephanopol. Listen his own words.
- 17:42Speaker 11: It's going to be uncontrolled.
- 17:44Speaker 10: You know.
- 17:44Speaker 11: One of the things that I point out, and others
- 17:45Speaker 11: pointed out as well. But I pointed out in my
- 17:47Speaker 11: chapter on President Trump is the most damning testimony of
- 17:51Speaker 11: his confidence and character comes from those who had the
- 17:53Speaker 11: most senior level positions in the White House situation where
- 17:57Speaker 11: he was supered under them. From James Mattis, Defense Secretary,
- 18:01Speaker 11: From John Bolton, his National Security advisor, From John Kelly,
- 18:04Speaker 11: his White House chief of staff, who all talk about
- 18:07Speaker 11: how frightened they are by the prospect that he would
- 18:10Speaker 11: become president again, apparently with no guardrails, without the kind
- 18:13Speaker 11: of people who are serving him in the first term.
- 18:15Speaker 11: Instead of having guardrails, it appears that he's going to
- 18:17Speaker 11: have a bunch of enablers like those who see you
- 18:20Speaker 11: sitting with him in the courtroom over the last several days,
- 18:24Speaker 11: and something that is chilling to many of those who
- 18:28Speaker 11: served in the situation room and during the first administration
- 18:31Speaker 11: but are no longer supporting President Trump.
- 18:34Speaker 1: I love, by the way, how the left they do this.
- 18:38Speaker 1: They start bringing up all these guys like John Kelly.
- 18:41Speaker 1: They hated John Kelly, by the way, they hate John Bolton, right,
- 18:46Speaker 1: these people that they bring up now acting like they're
- 18:48Speaker 1: great statesman and James Mattis. These guys were the biggest
- 18:52Speaker 1: scumbags in the world when they were working for Trump
- 18:54Speaker 1: in the eyes of the media, and now they're like, oh,
- 18:57Speaker 1: well there's some sort of great heroes here. These are
- 19:01Speaker 1: patriots and Donald Trump's not going to have them around him.
- 19:04Speaker 1: Do you remember how much they ripped on Donald Trump
- 19:07Speaker 1: and his National Security Advisor John Bolton? Do you remember
- 19:10Speaker 1: that they're like, oh, he's a racist, is a bigot
- 19:13Speaker 1: his NFO.
- 19:13Speaker 2: Remember that.
- 19:14Speaker 1: Yeah, Now they're like, oh, he's a great patriot because
- 19:17Speaker 1: he's speaking out against Trump. Let me also play for
- 19:21Speaker 1: you something that I think is interesting. And Jonathan you
- 19:24Speaker 1: was on Fox News. He's a law professor, and he
- 19:28Speaker 1: was talking about the Trump trial in general, and Michael
- 19:32Speaker 1: Cohen being there and saying, you know, Mike Cohen confirms
- 19:36Speaker 1: he threatened to sue companies on behalf of Trump. Remember
- 19:39Speaker 1: he was the man, right, He was a big man
- 19:41Speaker 1: with a big stick, who now is making money off
- 19:43Speaker 1: of attacking his former client. Actually not making money, making
- 19:47Speaker 1: a living off of being a Trump hater. He's a
- 19:50Speaker 1: guy that's also been convicted of line. So if you
- 19:54Speaker 1: want to know if you should trust this guy, look
- 19:56Speaker 1: at his rap sheet. But listen to what he has
- 19:59Speaker 1: to say a out this trial. It's very interesting perspective Nation.
- 20:02Speaker 12: It's good to have you, John. I want you to
- 20:04Speaker 12: listen to President Trump. This is right before court today
- 20:08Speaker 12: declaring his innocence.
- 20:10Speaker 11: There's a political witches and nobody's ever seen anything like that.
- 20:15Speaker 9: I tell you what the Abello Division on the judges.
- 20:18Speaker 3: You step in because this judge is getting away with
- 20:21Speaker 3: this racial including the.
- 20:23Speaker 13: Fact that we have thousands of people, we have one
- 20:26Speaker 13: hundred thousands of people in the jujus they would like
- 20:29Speaker 13: to show their support.
- 20:31Speaker 2: John.
- 20:31Speaker 12: Is it possible that the appellate division would step in here?
- 20:33Speaker 12: I mean that seems highly unusual, but it's not totally
- 20:36Speaker 12: out of the question, is it, Teane.
- 20:38Speaker 6: I think it's unlikely.
- 20:39Speaker 13: I think what the Court's going to do is let
- 20:42Speaker 13: Judge Merchon finish out the trial, get to a verdict,
- 20:46Speaker 13: and then hear all the legal issues at the same time.
- 20:49Speaker 13: And part of that is because this case is so
- 20:51Speaker 13: riddled with mistakes and problems that the appellate Court would
- 20:54Speaker 13: have to pingpong this quick case back and forth with
- 20:57Speaker 13: this trial judge repeatedly if it was going to try
- 21:00Speaker 13: to fix all the errors. As I went on.
- 21:02Speaker 6: Part of that is the trial judges.
- 21:04Speaker 13: I think strategy here is just to steamroll through all
- 21:07Speaker 13: the problems, all the ones you've been hearing about on
- 21:09Speaker 13: your panel this morning, with the failure to find any
- 21:12Speaker 13: kind of legal crimes that have been committed, the failure
- 21:16Speaker 13: to connect what happened last week with that explosive Stormy
- 21:19Speaker 13: Daniel's testimony with the actual charges, the problems with ambiguity
- 21:24Speaker 13: of the indictment, not even telling President Trump what the
- 21:26Speaker 13: real crimes are. So I think this is going to
- 21:28Speaker 13: have to wait for a pellet review before it could
- 21:31Speaker 13: be fixed. Maybe Judge Child will come to a census
- 21:33Speaker 13: and it quit Trump before they even have to add on.
- 21:36Speaker 12: So I know, I know, I just had to ask
- 21:37Speaker 12: in case how the president brings it up. I like
- 21:40Speaker 12: to ask a smart person about it, and that would
- 21:41Speaker 12: be you today.
- 21:42Speaker 14: Cohen is now describing how they communicated with each other.
- 21:45Speaker 14: He says Trump never had an email address. Cohen says
- 21:48Speaker 14: Trump made comments about people quote getting in trouble or
- 21:51Speaker 14: gone down as a direct result of using emails because
- 21:54Speaker 14: prosecutors can follow the paper trayal So that's Cohen, I's
- 21:58Speaker 14: wrong I thought, as we have seen time and time again,
- 22:02Speaker 14: Jonathan Turlely, jump on back in here, because it seems
- 22:06Speaker 14: pretty straightforward now, like the trial's been clarified, and it's
- 22:11Speaker 14: been clarified to this point. It's Cohen's word against everybody else.
- 22:16Speaker 2: Do you see it that way?
- 22:18Speaker 6: Well, well, we've already learned a couple of things.
- 22:22Speaker 15: One is that a vortex did not open up the
- 22:25Speaker 15: minute Cohen took the oath, and I have the entire
- 22:28Speaker 15: courtroom disappear into another world, so we can check that off.
- 22:33Speaker 15: Because the fact that Cohen is taking yet another oath
- 22:37Speaker 15: itself was quite an attraction. And obviously he's going to
- 22:42Speaker 15: get queasin arted on cross examination. But it was really
- 22:46Speaker 15: interesting before his testimony to watch this effort to get
- 22:50Speaker 15: in the agreement of the accountant. That was such an
- 22:55Speaker 15: obvious and dishonest move by the prosecutors.
- 22:59Speaker 6: You have to under whether this judge.
- 23:01Speaker 15: Is having second thoughts about his failure to stop this
- 23:07Speaker 15: case or at least force the prosecution to be clear
- 23:09Speaker 15: about it. There's nothing stopping the prosecutor from calling that accountant,
- 23:14Speaker 15: So the introduction of that agreement was clearly intended to
- 23:19Speaker 15: suggest to the jury they have some smoking gun evidence,
- 23:24Speaker 15: but because of this agreement they can't present it. That's
- 23:27Speaker 15: entirely untrue, and so the Merchant was right to say,
- 23:31Speaker 15: I'm not going to let you do that. But it
- 23:34Speaker 15: goes to how this is a potent and village of
- 23:37Speaker 15: a case. They're proving stuff that's not an evidence while
- 23:41Speaker 15: leaving suggestions of stuff that is an evidence with the jury.
- 23:46Speaker 6: So the thing to keep in mind is when.
- 23:49Speaker 15: The prosecution wraps up its case, the defense will stand
- 23:54Speaker 15: up and make a standard motion for a directed verdict
- 23:57Speaker 15: to say that there's insufficient evidence to support a i'm
- 24:00Speaker 15: in this case. That's an extremely powerful argument because you've
- 24:03Speaker 15: seen we're still debating what that crime is. Even on
- 24:07Speaker 15: this network, you have people disagreeing as to what the
- 24:11Speaker 15: theory of this case is, and the prosecution is about
- 24:14Speaker 15: to wrap. Now what the prosecution is worried about is
- 24:17Speaker 15: that even Judge Merchant may just say, you know what,
- 24:20Speaker 15: I gave you a shot and you didn't sink it,
- 24:23Speaker 15: and so I'm going to direct this verdict.
- 24:26Speaker 6: I'm going to issue an acquittal.
- 24:28Speaker 15: The way they're going to get around that is to
- 24:30Speaker 15: just get Cohen to say this happened, that he intentionally
- 24:35Speaker 15: wanted me to put out and wanted this to be
- 24:37Speaker 15: a legal expense. He intentionally was committing fraud. He was
- 24:40Speaker 15: trying to conceal campaign violations, even though very few people
- 24:44Speaker 15: on Earth would believe Michael Cohen.
- 24:47Speaker 6: The prosecutors will then.
- 24:48Speaker 15: Argue to the judge, that is a credibility question, judge,
- 24:53Speaker 15: and you need to let this go to the jury.
- 24:55Speaker 15: Whether you believe him or not, that is a fat
- 24:59Speaker 15: question for the jury. That is their entire strategy. And
- 25:03Speaker 15: so as unbelievable as Cohen may be, I don't think
- 25:06Speaker 15: the prosecutors think he will be believable.
- 25:08Speaker 6: They just want him to check a bog.
- 25:10Speaker 1: Now, if you just listen to what Turley said there,
- 25:13Speaker 1: and you listen to what the other law professor said.
- 25:15Speaker 1: At the very beginning, they're saying, Okay, you've got to
- 25:20Speaker 1: hope right that this jury is smart enough to understand
- 25:26Speaker 1: when they're being misled. You have to hope that this
- 25:31Speaker 1: jury is going to be honest and isn't a jury
- 25:34Speaker 1: stacked with Trump haters. Remember, they picked Manhattan on purpose,
- 25:38Speaker 1: and they picked Manhattan on purpose because they knew that
- 25:41Speaker 1: ninety percent of the people they're voted against Donald Trump.
- 25:45Speaker 1: So they thought, I think it would be easy, right,
- 25:47Speaker 1: It would be really easy for them to be able to,
- 25:50Speaker 1: you know, find a bunch of people. They're like, yeah,
- 25:53Speaker 1: let's put Donald Trump in jail. And if we can't
- 25:56Speaker 1: do that, at least let's find him, you know, find
- 25:59Speaker 1: him guilty of of committing a crime. So then the
- 26:03Speaker 1: Democrats can run against him and say, see, he's a criminal,
- 26:06Speaker 1: because the appeal wouldn't happen and the case will be
- 26:10Speaker 1: overturned on appeal. I have no doubt about it in
- 26:14Speaker 1: a higher court. Every legal scholar has said that, on
- 26:16Speaker 1: the left and the right, and they want to be
- 26:19Speaker 1: able to.
- 26:19Speaker 2: Use this to run against him for the election.
- 26:22Speaker 1: And plus, now he's in court being mandate to stay
- 26:25Speaker 1: in New York in this court.
- 26:26Speaker 2: Now it's been.
- 26:27Speaker 1: Five weeks, So for five weeks, Donald Trump has not
- 26:31Speaker 1: been on the road campaigning. And that's the most valuable
- 26:35Speaker 1: thing to the Biden campaign. This is basically a massive
- 26:40Speaker 1: in kind contribution to Joe Biden and Kamala Harris for
- 26:44Speaker 1: president twenty twenty four.
- 26:46Speaker 2: Now, there was one.
- 26:47Speaker 1: Other question that was asked of Jonathan Turley, and I
- 26:50Speaker 1: want you to listen to this because I think He
- 26:52Speaker 1: brings up a great point about this judge possibly having
- 26:56Speaker 1: second thoughts.
- 26:59Speaker 14: You're arguing that the judges having second thoughts about previous
- 27:03Speaker 14: decisions that have been made in this case. And I
- 27:05Speaker 14: would just add to that, Jonathan, it came from the
- 27:08Speaker 14: bench on Friday afternoon when the judge told the state
- 27:11Speaker 14: to tell Michael Cohen.
- 27:13Speaker 2: To stop talking, And that was after all the tiktoks
- 27:16Speaker 2: came out, all the tweets, etc.
- 27:17Speaker 6: Etc.
- 27:19Speaker 14: You're making a case now that the judge thinks they
- 27:23Speaker 14: may have gone too far.
- 27:24Speaker 6: No, I'm not saying that judges having second thoughts. He
- 27:28Speaker 6: might be.
- 27:29Speaker 15: I can't imagine that any competent lawyer at this point
- 27:33Speaker 15: would not be embarrassed by what has happened in this courtroom.
- 27:36Speaker 15: This is an utter disgrace that this case has gotten
- 27:40Speaker 15: this far, and I would.
- 27:42Speaker 6: Hope that he would have second thoughts.
- 27:44Speaker 15: But keep in mind when he told when he told
- 27:47Speaker 15: the prosecutors, can you tell Michael Cohen to cut it out?
- 27:50Speaker 6: Stop the antics? Am I going to tell you I
- 27:53Speaker 6: was not.
- 27:53Speaker 15: One of those complimenting the judge. Why wouldn't you do
- 27:57Speaker 15: that at the beginning of the trial. You were doing
- 27:59Speaker 15: that weekend before he testified. This guy has been out
- 28:03Speaker 15: there with a three ring circus going on, and you
- 28:06Speaker 15: haven't said a thing, and then suddenly said, it'd be
- 28:09Speaker 15: nice if we can go through the weekend without him
- 28:10Speaker 15: trolling for dollars on TikTok.
- 28:13Speaker 2: Jonathan Turley is absolutely right.
- 28:16Speaker 1: Don't be impressed by this judge saying that the week
- 28:19Speaker 1: you know, days before he's about to testify. Hey be
- 28:25Speaker 1: impressed right by by by the fact that this judge
- 28:28Speaker 1: is said to knock it off to Michael Cohen, who's
- 28:32Speaker 1: the entire basically case against Donald Trump.
- 28:37Speaker 2: He should have done it at the very beginning.
- 28:39Speaker 1: But you've got to understand, this judge is all in
- 28:44Speaker 1: to go down in history as the guy who got
- 28:47Speaker 1: a conviction against Donald Trump and then got to sentence him.
- 28:51Speaker 2: That's his motivation here.
- 28:53Speaker 1: Now is he embarrassed by maybe just how bad the
- 28:56Speaker 1: prosecution is done here?
- 28:58Speaker 2: There is a chance of that.
- 29:01Speaker 1: Is he embarrassed at the fact that how bad this
- 29:04Speaker 1: case has been this court, his court, he has run
- 29:08Speaker 1: this case there also, I think you could argue was
- 29:11Speaker 1: a chance of that and maybe he realizes, now, hey,
- 29:14Speaker 1: I got to live with this, right, I have to
- 29:18Speaker 1: really live with this the rest of my career, that
- 29:23Speaker 1: I had this you know what showcase, and I was
- 29:26Speaker 1: interfering with an election, and I was allowing the prosecutor
- 29:30Speaker 1: to politicize my courtroom to a point where I couldn't
- 29:34Speaker 1: even defend it anymore. And their case was so weak,
- 29:38Speaker 1: which again I go back to what I said earlier
- 29:40Speaker 1: about this. This case was so weak that eight years
- 29:43Speaker 1: ago the FED said there is no case here. They
- 29:46Speaker 1: resurrected it only to go after Donald Trump and to
- 29:50Speaker 1: try to turn him in to some sort of criminal,
- 29:54Speaker 1: so that Joe Biden could barely walk onto a stage,
- 29:57Speaker 1: read a teleprompter and go that guy's a good felling
- 30:01Speaker 1: you don't want to that guy's been convicted, or that
- 30:04Speaker 1: guy's going to jail right like. They needed to give
- 30:07Speaker 1: him that talking point. And even if it didn't work,
- 30:12Speaker 1: the question is did it Because if your ultimate goal
- 30:16Speaker 1: is to keep Donald Trump out of the White House,
- 30:19Speaker 1: taking him off the campaign trail for five weeks could
- 30:23Speaker 1: turn into six weeks or even longer, we don't know yet.
- 30:28Speaker 1: But if you can take him off off of the
- 30:32Speaker 1: campaign trail, did you accomplish your ultimate goal, which was
- 30:37Speaker 1: to weaken and not give him the advantage of being
- 30:39Speaker 1: able to travel and campaign for president of the United
- 30:43Speaker 1: States of America.
- 30:45Speaker 2: I'm going to keep covering this trial.
- 30:46Speaker 1: I can promise you that I'll keep giving you my thoughts,
- 30:50Speaker 1: and we'll give you the best analysis we can from
- 30:52Speaker 1: others they're talking about as well. Make sure you share
- 30:55Speaker 1: the show with your family and your friends, and I'll
- 30:57Speaker 1: see you back here tomorrow.
