- 0:01Speaker 1: Welcome it as verdict was Sentator Ted Cruz, Ben Ferguson
- 0:04Speaker 1: with you on what we're referred to as an emergency pod. Senator,
- 0:07Speaker 1: it's one o'clock in the morning central to Eastern AM.
- 0:12Speaker 1: You've just landed and the world is still talking. At
- 0:17Speaker 1: this hour. People are waking up around the world realizing
- 0:21Speaker 1: that the United States of America has made history by
- 0:25Speaker 1: indicting Donald J. Trump. This is a I think, a
- 0:29Speaker 1: sad day, a dark day for our country. I want
- 0:32Speaker 1: to get your thoughts on this for everybody that I
- 0:34Speaker 1: know is listening well, Ben, I have conflicting emotions. Part
- 0:40Speaker 1: of me is angry, it is outrageous what happened earlier day.
- 0:45Speaker 1: Part of me is sad because it is tragic for
- 0:48Speaker 1: the rule of law. This indictment is utter and complete garbage.
- 0:55Speaker 1: This is not law. This is not a prosecute Hian
- 1:00Speaker 1: based on the facts. This is a political vendetta brought
- 1:05Speaker 1: by a left wing partisan Democrat who was elected by
- 1:10Speaker 1: George Soros, a billionaire who spent over a million dollars
- 1:13Speaker 1: to elect Alvin Bragg as district attorney. And Bragg is
- 1:16Speaker 1: motivated by one thing, and that is partisan hatred on
- 1:20Speaker 1: the merits. This case is utterly baseless, it is frivolous.
- 1:25Speaker 1: It is a case that will most assuredly fail in court.
- 1:31Speaker 1: But Bragg doesn't care. The Democrats, the media partisans who
- 1:36Speaker 1: are exultant right now, they don't care. They love the
- 1:43Speaker 1: fact that Donald Trump is being indicted. Never mind the fact,
- 1:47Speaker 1: never mind the law, never mind guilt or innocence. They
- 1:50Speaker 1: hate the man. They are exultant for the political theater
- 1:55Speaker 1: of the mug shot that will happen in the coming days.
- 2:01Speaker 1: Any is there any downside to brag doing this center
- 2:04Speaker 1: because there have been a lot of people saying that
- 2:06Speaker 1: he overstepped here right that this was a complete overstep.
- 2:09Speaker 1: There were Democrats basically begging him not to do this
- 2:13Speaker 1: publicly on TV, saying he should step back from the brink.
- 2:16Speaker 1: They were saying that on CNN. But if you look
- 2:19Speaker 1: at New York, can you look at where's where he
- 2:21Speaker 1: would run for reelection. He's looking at becoming the governor.
- 2:25Speaker 1: And that's what we've been told about him in New York.
- 2:27Speaker 1: Even if he loses, even if all this is thrown out,
- 2:31Speaker 1: is it still in his mind to win for him?
- 2:34Speaker 1: Because it's such a partisan attack on Donald Trump. Well, look,
- 2:39Speaker 1: I don't know the man, but everything about him says
- 2:42Speaker 1: that he is a Zelliot said that, he says that
- 2:44Speaker 1: he's an extreme partisan. I'm a conservative and I'm heartbroken
- 2:49Speaker 1: today because this is such a blow to America. It's
- 2:53Speaker 1: a blow to rule of law. Our constitution was designed. Listen,
- 2:57Speaker 1: they're countries all over the world. If you're in Russia,
- 3:00Speaker 1: this can happen to you. If you're in China, this
- 3:03Speaker 1: can happen to you. If you're in North Korea or
- 3:04Speaker 1: Venezuela or Cuba. This is what banana republics do. This
- 3:09Speaker 1: is what dictatorships do. If one party takes power, you'd
- 3:12Speaker 1: better hope you're not the prior party because they're coming
- 3:15Speaker 1: after you. They're gonna lock you up, and they may
- 3:17Speaker 1: put you in front of a firing squad. I feel
- 3:19Speaker 1: confident at least Alvin Bragg won't take it to that.
- 3:23Speaker 1: But America's different. We're built on rule of law. We're
- 3:27Speaker 1: built on the law applying to everyone, and so as
- 3:31Speaker 1: a conservative, this makes me sad, but I gotta say
- 3:33Speaker 1: the irony then, if I were a liberal Democrat, I'd
- 3:37Speaker 1: be horrified right now because even while this is devastating
- 3:43Speaker 1: to the rule of law, to the confidence the American
- 3:47Speaker 1: people will have in our justice system. At the same time,
- 3:50Speaker 1: I think this is an enormous political gift to Donald Trump.
- 3:53Speaker 1: If I were a Democrat, I might well report Alvin
- 3:58Speaker 1: Bragg to the Federal Election Commission, making the single greatest
- 4:01Speaker 1: in kind contribution to a presidential campaign in history. This
- 4:07Speaker 1: is there's a reason. Look, Trump put out almost two
- 4:11Speaker 1: weeks ago that he was about to get arrested, and
- 4:14Speaker 1: he said he was going to get arrested the next day,
- 4:17Speaker 1: and Bragg delayed and delayed and delayed. A lot of
- 4:19Speaker 1: national Democrats were freaking out, were pressuring Bragg, don't do this,
- 4:23Speaker 1: don't do this, don't do this. This will help Trump.
- 4:26Speaker 1: And you know, as you know, he sent the grand
- 4:30Speaker 1: jury home for a period of time. The press was
- 4:33Speaker 1: reporting the grand jury had been sent home for a month.
- 4:35Speaker 1: Turns out that was false. That was either misreporting or
- 4:39Speaker 1: deliberate misinformation from Brag. But I think the delay you
- 4:44Speaker 1: and I speculated, we talked on the pot it may
- 4:47Speaker 1: have been Bragg getting cold feet, but I'll tell you
- 4:49Speaker 1: I said on the podcast that there was a very
- 4:52Speaker 1: good chance Brag was going to say screw it. I
- 4:55Speaker 1: hate the guy and I'm going to indicte him and
- 4:57Speaker 1: all the rest of you can go jump in the lake.
- 4:58Speaker 1: And sadly, that's what he's done. And you know, this
- 5:03Speaker 1: is not going to be the last salvo. There's going
- 5:07Speaker 1: to be more presidents indicted. This puts America on a
- 5:12Speaker 1: road that is a very very bad road. You know,
- 5:15Speaker 1: you look back in history Richard Nixon, who committed multiple crimes.
- 5:19Speaker 1: As you know, I'm not a Nixon fan. My latest book,
- 5:23Speaker 1: Justice Corrupted, there's an entire chapter detailing the crimes and
- 5:29Speaker 1: obstruction of justice and abuse carried out by the Nixon
- 5:34Speaker 1: White House. But I got to say, when gerald Ford
- 5:37Speaker 1: pardoned Nixon, it probably cost gerald Ford his election. It
- 5:42Speaker 1: probably elected Jimmy Carter. But gerald Ford did it because
- 5:46Speaker 1: he believed he was helping the country. He believed that
- 5:49Speaker 1: having a trial of the former president, even a president
- 5:52Speaker 1: as corrupt as Nixon, he thought, would be deeply harmful
- 5:55Speaker 1: for the country. You know, my sentiments are similar to
- 6:00Speaker 1: what they were when the Democrats impeach Donald Trump, not once,
- 6:03Speaker 1: but twice. And that's when verdict started. Verdict started, as
- 6:08Speaker 1: you now, on the first night of the first impeachment
- 6:10Speaker 1: trial against Trump, and I said at the outset, they're
- 6:14Speaker 1: starting a new chapter. This will become routine. When one
- 6:19Speaker 1: party controls the House and the other party controls the
- 6:22Speaker 1: White House, we will see presidents get impeached. That's not
- 6:25Speaker 1: good for America, that's not good for the rule of law.
- 6:29Speaker 1: And this has now escalated it even further. These are
- 6:33Speaker 1: radical partisans who don't care about the rule of law.
- 6:37Speaker 1: It is war by any means necessary. That's how Alvin
- 6:42Speaker 1: Bragg and George Soros and the radical left approaches that.
- 6:45Speaker 1: And that's a really tragic day for America. What do
- 6:50Speaker 1: we What is your hope for Republicans now, because there's
- 6:53Speaker 1: been a lot of as I was watching earlier tonight
- 6:57Speaker 1: just some of the reactions on TV, they said, get
- 6:59Speaker 1: ready because now what's going to happen is there's gonna
- 7:01Speaker 1: be a tit for tat and you're gonna see uh
- 7:04Speaker 1: district attorneys start going after maybe Biden family members for
- 7:08Speaker 1: the Biden crime family. And what we've seen has come
- 7:11Speaker 1: out with the millions of dollars coming in from the
- 7:13Speaker 1: Russians and the Chinese, this is going to turn into
- 7:16Speaker 1: we open Pandora's box. There's no way to stop this. Now,
- 7:19Speaker 1: it's if you're gonna do it, We're gonna do it.
- 7:22Speaker 1: I worry that we go down that road and there's
- 7:25Speaker 1: no way to turn off the Spickett. What is your
- 7:29Speaker 1: your your hope and how concerned are you that maybe
- 7:33Speaker 1: Republicans say, Okay, well, if Brad's gonna do it, by Galli,
- 7:36Speaker 1: I'll make a name for myself and I'll go after
- 7:39Speaker 1: Joe Biden and all of his allies. Well, look, that
- 7:43Speaker 1: is a very real worry. Historically, the less has been
- 7:46Speaker 1: more willing to do that than the right, but escalation
- 7:51Speaker 1: is a very real possibility. And we've talked on this
- 7:54Speaker 1: podcast before. I believe Merrick Garland. I think the Biden
- 7:57Speaker 1: DOJ is going to Hunter Biden. I think they planned
- 8:01Speaker 1: to indict Hunter Biden. They've leaked it to the press,
- 8:04Speaker 1: which DJ should not be leaky. But I think they
- 8:07Speaker 1: planned to indict Hunter Biden for drug charges or maybe
- 8:11Speaker 1: tax charges, for something that is personal and unique to him.
- 8:16Speaker 1: And I think they want the public narrative to be
- 8:19Speaker 1: this is a poor, tortured soul with serious substance abuse problems,
- 8:23Speaker 1: and and we should our hearts should should break for
- 8:27Speaker 1: the trauma he has served. They are not, i believe,
- 8:31Speaker 1: going to indict Hunter Biden for anything related to corruption
- 8:34Speaker 1: from his father, which is which is the relevant public matter.
- 8:39Speaker 1: It's the relevant issue of public interest. Is the sitting
- 8:43Speaker 1: president engaged in corrupt business dealings? Did the sitting president
- 8:48Speaker 1: as vice president engage in corrupt business dealings? That is
- 8:52Speaker 1: a legitimate, important concern. Look, I'm not saying that it
- 8:57Speaker 1: is always illegitimate to indict prosecute a former president. For
- 9:01Speaker 1: a president commits crimes, serious crimes, that president should be
- 9:06Speaker 1: held accountable, but it shouldn't be ticky tack nonsense. And
- 9:12Speaker 1: this is where and look, we did a podcast last
- 9:16Speaker 1: week that went into the details of it, so I'm
- 9:18Speaker 1: not going to repeat all of it, but let's do
- 9:19Speaker 1: this briefly. We don't know the exact grounds on which
- 9:24Speaker 1: the district attorney is indicting Trump. He has not yet
- 9:28Speaker 1: released the indictment publicly. I assume we will know in
- 9:30Speaker 1: the next couple of days. But in all likelihood, the
- 9:34Speaker 1: statute that he will be basing it on is New
- 9:38Speaker 1: York Penal Law one seventy five Doto five. What does
- 9:41Speaker 1: that do? It makes it a misdemeanor when an individual
- 9:45Speaker 1: makes or causes a false entry in a business record
- 9:50Speaker 1: or alters, erases, obliterates, to leites a true entry in
- 9:54Speaker 1: a business record. In other words, it's a bookkeeping error.
- 10:00Speaker 1: If you write something in the books of a business
- 10:03Speaker 1: enemy that is false under New York law, that's a misdemeanor.
- 10:07Speaker 1: So that's the claim they're basing it on. But it's
- 10:09Speaker 1: even more ludicrous than that, because it's a misdemeanor under
- 10:13Speaker 1: New York law. The statute of limitations is two years.
- 10:18Speaker 1: This alleged crime occurred in twenty sixteen. The alleged crime
- 10:25Speaker 1: is that, in the heat of the presidential campaign against
- 10:28Speaker 1: Hillary Clinton, Donald Trump sent his personal lawyer, Michael Cohen,
- 10:32Speaker 1: to pay Stormy Daniels, a porn star, one hundred and
- 10:35Speaker 1: thirty thousand dollars, to cover up that she had allegedly
- 10:40Speaker 1: had an affair with Donald Trump. I don't know if
- 10:41Speaker 1: any of that's true or not, but that's the allegations.
- 10:45Speaker 1: None of that's illegal on the face of it. There's
- 10:49Speaker 1: nothing in what I've just described it violates New York law.
- 10:52Speaker 1: So what is Alvin Bragg hanging his hat on. He's saying, well,
- 10:56Speaker 1: when one hundred and thirty thousand dollars was paid in
- 11:00Speaker 1: the accounting ledgers, Trump recorded that one hundred and thirty
- 11:04Speaker 1: thousand dollars as legal fees when it was not in
- 11:08Speaker 1: fact legal fees. It was hush money, It was payoff
- 11:10Speaker 1: to Stormy Datas. Now, as I mentioned, that's a misdemeanor
- 11:15Speaker 1: under New York Lasso, the statute of limitations is run,
- 11:17Speaker 1: which means the prosecutor can't charge him. So how is
- 11:20Speaker 1: he bringing this indictment. Well, there's another provision of New
- 11:24Speaker 1: York law, new York Penal Law one seventy five point ten,
- 11:29Speaker 1: that makes it a felony if you create a false
- 11:33Speaker 1: business record in the furtherance of in order to commit
- 11:38Speaker 1: another crime. So he's trying to bootstrap another crime to
- 11:42Speaker 1: transform a misdemeanor into a felony. Let's pause for a
- 11:46Speaker 1: second and reflect on the irony. Alvin Bragg got elected.
- 11:50Speaker 1: George Soros spent it over a million dollars to elect
- 11:52Speaker 1: Alvin Bragg because he is reducing felonies. Every day, he's
- 11:58Speaker 1: reducing felonies to misdemeanors. He's releasing violent criminals from jail.
- 12:02Speaker 1: He's refusing to prosecute violent criminals. He ran on a
- 12:07Speaker 1: platform of let the criminals go. But in this case,
- 12:11Speaker 1: it's a bank robber, it's not a rapist, it's not
- 12:15Speaker 1: a murderer. It's Donald Trump. And to a leftist, Donald
- 12:18Speaker 1: Trump is the worst thing on the face of the planet.
- 12:21Speaker 1: So he's got a ridiculous legal theory to elevate a
- 12:24Speaker 1: misdemeanor into a felony. And we don't know if we're
- 12:28Speaker 1: sure of what alleged crime he's trying to piggyback on
- 12:30Speaker 1: because he hadn't released the indictment yet, But in all
- 12:33Speaker 1: likelihood it is some sort of campaign finance violation for
- 12:39Speaker 1: mischaracterizing the payment. Now, if that's the crime that is
- 12:45Speaker 1: being used to bootstrap the misdemeanor to get around the
- 12:47Speaker 1: statute of limitation to prosecute Trump, to the h Trump
- 12:51Speaker 1: a number of true. Number one, the Federal Election Commission
- 12:54Speaker 1: just declined to bring a case based on this. They
- 12:57Speaker 1: looked at it and said, we don't have a case here.
- 12:59Speaker 1: Number two, The Department of Justice declined to bring a
- 13:02Speaker 1: case on this main Justice. Number three, the Southern District
- 13:06Speaker 1: of New York, the US Attorney in Manhattan, declined to
- 13:10Speaker 1: bring a case on this, looked at it and said
- 13:11Speaker 1: there's nothing here. Number four, the previous district attorney in Manhattan, Sivance,
- 13:18Speaker 1: who's a hardcore liberal, looked at the facts here and said,
- 13:22Speaker 1: we can't bring a case here. Everyone has looked at
- 13:24Speaker 1: this and said this ain't a case. What happened? Alvin
- 13:27Speaker 1: Bragg said, who baby? I hate Trump. I'm indicting me
- 13:31Speaker 1: a Donald Trump, and nothing's gonna stop me. This case
- 13:35Speaker 1: will get thrown out, all right, let's walk through that,
- 13:39Speaker 1: convicting him. Yeah, it's not about convicting him. I couldn't
- 13:42Speaker 1: agree with you more. Let's put people so they understand
- 13:46Speaker 1: because no one I have seen this anywhere Center, and
- 13:48Speaker 1: that's why I want to ask you this. Lastly, no
- 13:50Speaker 1: one has explained what will happen. And by the way,
- 13:54Speaker 1: CNN is reporting tonight, and they have pretty good information
- 13:59Speaker 1: from liberals and New York City, so that's why I
- 14:02Speaker 1: think they're probably leading this. They're getting great leaks. They're
- 14:05Speaker 1: saying Trump faces more than thirty counts related to business fraud.
- 14:08Speaker 1: Sources are now telling CNN he's expected appear in court
- 14:10Speaker 1: on Tuesday, as the first former US president to be
- 14:13Speaker 1: crimply charged he will be fingerprinted, he will have a
- 14:16Speaker 1: mug shot. You just said this will be thrown out.
- 14:19Speaker 1: Explain the process. Donald Trump's gonna have to lawyer up.
- 14:23Speaker 1: If there's thirty plus counts here, He's gonna have to
- 14:25Speaker 1: defend himself. Obviously, just said it's going to be thrown out.
- 14:29Speaker 1: Walk us down this so people understand what really happens next.
- 14:33Speaker 1: Will there be a trial for example, Well, the first
- 14:38Speaker 1: process is going to be Donald Trump being arrested, which
- 14:43Speaker 1: is what he tweeted just under two weeks ago that
- 14:46Speaker 1: he was about to be arrested. Now because he's the
- 14:49Speaker 1: former president of the United States, because he's protected by
- 14:51Speaker 1: Secret Service, You're not going to have NYPD come kicked
- 14:55Speaker 1: down the door of our lago and dragging away at handcuffs.
- 14:59Speaker 1: The Manhattan District Attorney is talking to Trump's attorney and
- 15:04Speaker 1: they're reaching negotiated terms for him to turn himself in.
- 15:07Speaker 1: Now he has said publicly he's going to turn himself in.
- 15:10Speaker 1: He's going to cooperate with him. So what will happen.
- 15:14Speaker 1: I don't know if it'll be Tuesday, I don't know
- 15:16Speaker 1: if those leaks are accurate, but in the next several days,
- 15:20Speaker 1: Tuesday is certainly plausible that that's roughly the right time period.
- 15:23Speaker 1: It could be tomorrow, or it could be any day
- 15:26Speaker 1: in the next week that Trump presumably will present himself
- 15:31Speaker 1: in Manhattan and will turn himself in. When he turns
- 15:36Speaker 1: himself in, he'll be booked. I think it is certain
- 15:40Speaker 1: that they will fingerprint him. I think it is certain
- 15:43Speaker 1: that they will take a mug shot. Frankly, that's a
- 15:45Speaker 1: big part of the reason Alvin Bragg wants to bring
- 15:47Speaker 1: this case is to take the mugshot because it's a
- 15:50Speaker 1: political attack. It's not a legal case. It is a
- 15:52Speaker 1: political attack, and he wants the mug shot. How many
- 15:55Speaker 1: times have you seen ben on Twitter leftists engage in
- 16:01Speaker 1: fan fiction porn where they cut and paced Donald Trump's
- 16:06Speaker 1: face onto the body of someone in an orange jumpsuit
- 16:09Speaker 1: in prison. Yeah, countless the mug shot. They are so
- 16:15Speaker 1: excited as a political matter for that. Now, by the way,
- 16:18Speaker 1: my prediction will see if this is true. My prediction
- 16:21Speaker 1: is when Donald Trump takes his mug shot, he will
- 16:24Speaker 1: be in a Chris blue shirt with an impeccable white
- 16:30Speaker 1: Chris blue suit with an impeccable white shirt and a
- 16:33Speaker 1: bright red Donald Trump tie and he will be smiling
- 16:37Speaker 1: ear to ear. That's my prediction. I don't know that,
- 16:40Speaker 1: but we'll find out in a few days if that's
- 16:42Speaker 1: right or not. Then it will proceed to trial. Now,
- 16:47Speaker 1: before trial, there can go all sorts of pre trial proceedings.
- 16:53Speaker 1: The defense can make motions, they can make motions to
- 16:55Speaker 1: suppress evidence. There will be the disclosure of what called
- 17:00Speaker 1: Brady material, which is the material the prosecutor has that
- 17:04Speaker 1: is potentially exculpatory, that potentially demonstrates Trump is inocent. And
- 17:08Speaker 1: so they'll be a back and forth. You know, Trump
- 17:12Speaker 1: will make bail. I don't know what the bail will
- 17:14Speaker 1: be set at, but he's he's going to make bail
- 17:17Speaker 1: and be released after his booked, and then it will
- 17:19Speaker 1: proceed towards a trial. It is possible that the defense
- 17:25Speaker 1: council will make a motion to dismiss the indictment. And
- 17:29Speaker 1: I don't know who the New York trial judge is
- 17:31Speaker 1: that the case will be assigned to. It will be
- 17:33Speaker 1: a New York state trial judge. New York trial judges
- 17:37Speaker 1: tend to be quite liberal, so it's possible you'll have
- 17:40Speaker 1: a judge that will allow this to linger on for
- 17:42Speaker 1: some time. I gotta tell you, any judge worth his
- 17:45Speaker 1: or her assault would throw this damn thing out because
- 17:48Speaker 1: it's a ridiculous case. And let me get it. Two
- 17:50Speaker 1: data points that are important to know, and they're data
- 17:53Speaker 1: points that you're probably not going to hear on CNN.
- 17:56Speaker 1: You're not going to hear an ABCCBS or NBC. Number one,
- 18:02Speaker 1: a theory similar to this was tried against John Edwards.
- 18:07Speaker 1: John Edwards was the Democrat senator who ran for president,
- 18:11Speaker 1: who had an affair, who had a mistress, who paid
- 18:14Speaker 1: hush money, and he got prosecuted for mischaracterizing the hush money,
- 18:19Speaker 1: and the case blew up at it lost, it did
- 18:21Speaker 1: not succeed. That's the most on point precedent is an
- 18:26Speaker 1: absolute failure of a prosecution. But number two, and this
- 18:30Speaker 1: is the fact that his studying, which is the entire
- 18:35Speaker 1: predicate of the Manhattan DA's case, is that recording as
- 18:42Speaker 1: legal fees a payment that was not in fact legal fees.
- 18:48Speaker 1: He is a crime and a crime worthy of indictment
- 18:52Speaker 1: and prosecution. If that is true, do you know who
- 18:57Speaker 1: else could committed the exact same crime at the same time.
- 19:02Speaker 1: That would be none other than Hillary Rodham Clinton So
- 19:06Speaker 1: all of this conduct occurred during the twenty sixteen campaign,
- 19:09Speaker 1: during the general election, when it was Trump versus Clinton.
- 19:14Speaker 1: That's when Michael Cohen allegedly paid Stormy Daniels one hundred
- 19:17Speaker 1: and thirty thousand dollars and they characterized it as legal fees.
- 19:21Speaker 1: At the exact same time, Hillary Clinton's campaign paid over
- 19:26Speaker 1: a million dollars to develop the Steel Dossier. You remember
- 19:30Speaker 1: the infamous document that is filled with things like the petain,
- 19:34Speaker 1: the allegations of lurid sexual activities from Donald Trump that
- 19:39Speaker 1: the media was so excited when it broke it just
- 19:41Speaker 1: happened to all be garbage and made up fiction. The
- 19:45Speaker 1: Hillary Clinton campaign commissioned the entire thing. They paid for it.
- 19:49Speaker 1: They paid over a million dollars. And you know what,
- 19:51Speaker 1: the Hillary Clinton campaign called the payments to fabricate the
- 19:55Speaker 1: Steele dossier legal fees, the exact same thing. So the
- 20:01Speaker 1: identical conduct characterizing something as legal fees that was not
- 20:05Speaker 1: legal fees occurred in the identical jurisdiction Manhattan at the
- 20:10Speaker 1: exact same time twenty sixteen. If this is a crime,
- 20:16Speaker 1: then objectively, Hillary Clinton not only committed the same crime,
- 20:19Speaker 1: she committed it ten x Trump allegedly did it at
- 20:23Speaker 1: one hundred and thirty thousand dollars. Hillary Clinton did it
- 20:26Speaker 1: at over a million dollars. Not the truth of the
- 20:28Speaker 1: matter is neither one of them is a crime. It's
- 20:30Speaker 1: a tikie tech book. Keepee would prosecute Hillary Clinton or
- 20:33Speaker 1: zero because he supports Hillary Clinton, and that's not how
- 20:38Speaker 1: a prosecution should proceed. Last question for you, I want
- 20:43Speaker 1: to ask, and this is I think a bigger Just
- 20:47Speaker 1: step back and think about this from a different perspective
- 20:51Speaker 1: of how much damage has been done for the future
- 20:56Speaker 1: of this country today because of this indictment, the fact
- 21:01Speaker 1: that in twenty twenty three, we have lost our way
- 21:05Speaker 1: to the point where we're indicting on garbage charges as
- 21:09Speaker 1: you described it, former Presidency United's America. And is there
- 21:12Speaker 1: any way to get this back in the box afterwards
- 21:16Speaker 1: or is the damage that's been done? Will it ever
- 21:18Speaker 1: go away? Look, it is very very hard. As you know.
- 21:23Speaker 1: I've been concerned about this for a long time. Several
- 21:26Speaker 1: months ago, I wrote my latest book. My latest book
- 21:29Speaker 1: is on exactly this topic because I saw this happening.
- 21:32Speaker 1: My latest book is called Justice Corrupted. How the Left
- 21:36Speaker 1: is weaponized the legal system and it describes how Barack
- 21:39Speaker 1: Obama and Joe Biden have corrupted the Department of Justice,
- 21:43Speaker 1: have corrupted, the FBI, have corrupted, the IRS, have corrupted,
- 21:47Speaker 1: the CIA, have weaponized the legal machinery. It talks about
- 21:51Speaker 1: Alvin brag It talks about George Soros. DA's elected with
- 21:56Speaker 1: millions of dollars from George Soros to undermine the rule
- 22:00Speaker 1: of law. And listen, I did not. I wasn't happy
- 22:04Speaker 1: writing the book Justice Corrupted. I love the American justice system,
- 22:10Speaker 1: I love the rule of law. My entire life has
- 22:13Speaker 1: been devoted to the Constitution, literally since I was a teenager.
- 22:16Speaker 1: When I was thirteen, I was part of a group
- 22:19Speaker 1: called the Constitutional Corroborators where we memorized the Constitution in
- 22:24Speaker 1: shortened amountic form. Yes, Ben, I was one heck of
- 22:26Speaker 1: a geek. You were a jock hi ass in high school.
- 22:31Speaker 1: But that was me. You are a pretty geeky jock.
- 22:34Speaker 1: I will give you that. My assid high school. But look,
- 22:39Speaker 1: my entire life, the Constitution, the Bill of Rights. It
- 22:44Speaker 1: has been the pinnacle of human liberty in the entire
- 22:49Speaker 1: existence of mankind. And I wrote Justice Corrupted because I
- 22:55Speaker 1: saw these hardcore partisans these leftists, these Marxists, willing to
- 23:02Speaker 1: use the machinery of justice just as a cudgels as
- 23:07Speaker 1: a club to beat their political opponents, and I was horrified. Look,
- 23:12Speaker 1: I'm going to encourage everyone go on to Amazon right
- 23:14Speaker 1: now buy Justice Corrupted if you want to know what
- 23:17Speaker 1: happened here. This book details exactly what led to today's indictment,
- 23:24Speaker 1: and it, unfortunately, I think it only gets worse over
- 23:29Speaker 1: the next two years under Joe Biden. I can promise
- 23:31Speaker 1: you one thing. We're gonna keep you update on this.
- 23:33Speaker 1: I have a feeling this is going to have a
- 23:35Speaker 1: lot of moving parts, and the weeks and the months ahead,
- 23:39Speaker 1: it'll be interesting to see how it all plays out.
- 23:41Speaker 1: We will let you get you behind the scenes and
- 23:44Speaker 1: let you understand the legal aspect of this, which I
- 23:46Speaker 1: think is one part that's lacking. And I appreciate you
- 23:48Speaker 1: center explaining what is going to happen next, just in
- 23:51Speaker 1: the short term, because people want to know. They're afraid
- 23:53Speaker 1: that the present is going to be ineligible, that he
- 23:55Speaker 1: can't run, that if there's a trial, he's not gonna
- 23:57Speaker 1: be able to run. All that is also not true.
- 24:00Speaker 1: Even if this goes forward, he is not ineligible. It
- 24:05Speaker 1: is completely false. The only way that a president can
- 24:11Speaker 1: be ineligible to run is if the president is impeached,
- 24:15Speaker 1: which takes a majority of the House, and convicted, which
- 24:19Speaker 1: takes two thirds of the Senate, and the Senate imposes
- 24:22Speaker 1: the penalty of making him ineligible to run for office.
- 24:26Speaker 1: That is not going to happen. That has not happened,
- 24:29Speaker 1: and so the fact of an indictment has zero effect
- 24:33Speaker 1: on Trump's being able to run. It has zero effect
- 24:36Speaker 1: on his being able to win the primary, It has
- 24:37Speaker 1: zero effect on his being able to win when the general,
- 24:40Speaker 1: has zero effect in his being able to serve as president.
- 24:43Speaker 1: This is an effort by Alvin Bragg and radical Democrats
- 24:47Speaker 1: to steal the election. The irony is all of these
- 24:51Speaker 1: Democrats who have clutched their pearls and said, defend democracy,
- 24:55Speaker 1: defend democracy. Well, you know what, they're all full of
- 24:58Speaker 1: crap because they don't believe in democracy. Look, if you
- 25:01Speaker 1: don't like Donald Trump, vote against him, but don't abuse
- 25:05Speaker 1: the justice system by trying to bring bogus charges because
- 25:10Speaker 1: you're afraid that the voters might actually vote for the guy.
- 25:14Speaker 1: That's not democracy. It's the opposite of democracy. And these
- 25:18Speaker 1: Marxists don't care. They are carrying down American democracy and
- 25:23Speaker 1: it's why as I sit here at one sixteen in
- 25:26Speaker 1: the morning, I'm pitstocel Yeah, Center, thank you. I think
- 25:32Speaker 1: this is one of the most important podcasts that we
- 25:34Speaker 1: have done, and people want to know what's happening, and
- 25:37Speaker 1: I think this will help distinguish the bas and the
- 25:40Speaker 1: spend from the reality of the situation. We will be
- 25:43Speaker 1: back with you whenever big, big news like this breaks,
- 25:46Speaker 1: even if it's at one twenty in the morning, and
- 25:50Speaker 1: we'll be back with you obviously in a couple of
- 25:52Speaker 1: days as well. We'll see you then. Everybody pray for
- 25:55Speaker 1: our country.
