- 0:00Speaker 1: Welcome in his Verdicus Center. Teed Cruz ben Ferguson with you.
- 0:03Speaker 1: It's nice to have you with us wherever you're listening
- 0:05Speaker 1: around the country, and we've got a pack show for you,
- 0:09Speaker 1: including one of your best friends, Senator Jimmy Kimmel.
- 0:13Speaker 2: Get in the boot.
- 0:14Speaker 1: I mean, are you guys gonna have a lot more
- 0:16Speaker 1: time to play basketball now?
- 0:18Speaker 3: Look, Jimmy Kimmel has been canned. He has been suspended indefinitely.
- 0:25Speaker 3: I think that is a fantastic thing. I think Jimmy
- 0:27Speaker 3: Kimmel was putting out garbage for a long long time.
- 0:30Speaker 3: But we're going to break down because they're real questions
- 0:33Speaker 3: about why ABC suspended Jimmy Kimmel and what the role
- 0:37Speaker 3: was of the SCC. The SCC threatened to revoke ABC's licenses.
- 0:41Speaker 3: We're going to break down the First Amendment implications of that.
- 0:45Speaker 3: We're also going to talk about a hearing that happened
- 0:47Speaker 3: this week. Cash Betel, the director of the FBI, testified
- 0:50Speaker 3: before the Senate Judiciary Committee, and I questioned Cash, and
- 0:54Speaker 3: I called on the Trump administration to designate Antifa as
- 0:59Speaker 3: a terrorist or it is, yeah, And in particular, what
- 1:02Speaker 3: I urge the FBI, and the DOJ to do is
- 1:04Speaker 3: follow the money, follow those who are putting money behind
- 1:08Speaker 3: violent protests, riots, acts of violence. And we're also going
- 1:14Speaker 3: to talk about how the fact that within twenty four
- 1:17Speaker 3: hours the Trump administration announced they were doing exactly that,
- 1:21Speaker 3: they were going to designate Antifa as a terrorist organization.
- 1:25Speaker 3: It's the right thing to do. It makes America safer.
- 1:28Speaker 3: We're going to explain all that to you.
- 1:30Speaker 1: Yeah, it's definitely a lot to discuss, and we're going
- 1:32Speaker 1: to talk about all of it coming up in a moment.
- 1:35Speaker 1: If you've got a dog, I gotta tell you, and
- 1:38Speaker 1: you love your dog, your dog's getting older. I've got
- 1:39Speaker 1: a twelve and a half year old dog. You need
- 1:41Speaker 1: to know about something that has really given my dog
- 1:45Speaker 1: new life. It is called rough greens. My dog was
- 1:48Speaker 1: at that point where if he was on the couch,
- 1:50Speaker 1: he'd kind of whine and bark and you'd have to
- 1:52Speaker 1: coach him off the couch or just pick him up
- 1:54Speaker 1: and put him on the ground. Same thing when he's
- 1:56Speaker 1: jumping up on the couch. Part of that's just getting older. Well,
- 1:59Speaker 1: we decided to try rough greens and he is back
- 2:02Speaker 1: to being able to do it.
- 2:03Speaker 2: On his own.
- 2:04Speaker 1: It is truly amazing to watch this dog have new
- 2:09Speaker 1: I say new life, because he's back to doing what
- 2:12Speaker 1: he was doing before that he loved. He's running around
- 2:14Speaker 1: more in the backyard. He is more active.
- 2:17Speaker 2: Now.
- 2:17Speaker 1: How does rough Creams works? It's pretty awesome. It supports
- 2:20Speaker 1: long term health by providing live, bioavailable nutrients including essential vitamins, minerals, probiotics,

- 2:32Speaker 1: improve nutrition absorption, maintain joint and muscle health of your dog,
- 2:37Speaker 1: and enhance the overall fagutality. And I can tell you
- 2:40Speaker 1: I'm witnessing it now.
- 2:41Speaker 2: It works.

- 3:38Speaker 1: trial all right now, Centaer, let's go back to how
- 3:42Speaker 1: all this went down so people understand the there's a
- 3:45Speaker 1: lot of misinformation. There's just a lot of lies out there.
- 3:48Speaker 1: Let's just be honest about it. There are a ton
- 3:50Speaker 1: of lies in this one. Jimmy Kimmel went after our
- 3:56Speaker 1: dear friend who was assassinated after him and basically implied
- 4:01Speaker 1: that he's responsible for his own assassination. And oh, by
- 4:06Speaker 1: the way, he was a Trump supporter referring to the assassin.
- 4:10Speaker 1: That is why he got in trouble because he lied.
- 4:13Speaker 1: It's not because of free speech, which some people have complicated.
- 4:17Speaker 1: In a free speech issue, he can say whatever the
- 4:19Speaker 1: hell he wants. It doesn't mean you're gonna keep your job.
- 4:24Speaker 3: Well, let's break this down to several things. Number one,
- 4:28Speaker 3: Jimmy Kimmel had become profoundly unfunny. That there was a time,
- 4:33Speaker 3: I don't't know, fifteen years ago, that he was a
- 4:36Speaker 3: talented comedian. He could be funny, you know. He started
- 4:40Speaker 3: hosting The Man Show with Adam Carolla, and they were
- 4:44Speaker 3: pretty funny back then, and that's how he got a
- 4:46Speaker 3: late night gig. I've been on Jimmy Kimmel. I've done
- 4:50Speaker 3: his show, I've done a show a couple of times.
- 4:52Speaker 3: He can be funny. But then Donald Trump got elected.
- 4:56Speaker 3: And when Donald Trump got elected, it broke late night comedy.
- 5:01Speaker 3: The host of late night comedy, they used to be
- 5:03Speaker 3: able to make fun on both sides. And by the way,
- 5:05Speaker 3: good comedy it ought to make fun of Republicans and Democrats.
- 5:08Speaker 3: It ought to just just laugh and have fun. But
- 5:12Speaker 3: Jimmy Kimmel, just like Stephen Colbert, his brain melted when
- 5:17Speaker 3: Donald Trump came into the White House, and it is
- 5:21Speaker 3: now unwatchable. I've grown up. I've grown up watching S
- 5:24Speaker 3: and L I've grown up watching late night comedy. I
- 5:27Speaker 3: like to laugh, and it is now I don't watch
- 5:31Speaker 3: it anymore. In fact, and I'm not unique. The vast
- 5:34Speaker 3: majority of America doesn't watch it anymore because Jimmy Kimmel
- 5:38Speaker 3: would stand up and just basically scream I hate Donald Trump.
- 5:42Speaker 3: And after a while it's like, yeah, we know, there's
- 5:46Speaker 3: no mystery about it. You're not hiding it. But how
- 5:49Speaker 3: about being a comedian, how about telling a joke? By
- 5:52Speaker 3: the way. You know, when I was first selected to
- 5:54Speaker 3: the Senate thirteen years ago, it was a regular part
- 5:58Speaker 3: of the job to go on late night comedy. And
- 6:02Speaker 3: so I've done Jay Leno, I've done Jimmy Kimmel, I've
- 6:06Speaker 3: done Stephen Colbert, I've done Fallaned. That was part of
- 6:12Speaker 3: the job. Today, none of them zero have any Republicans on.
- 6:19Speaker 3: They will not have them on. They just their entire
- 6:22Speaker 3: show is essentially an infomercial screaming that they hate Donald Trump.
- 6:27Speaker 3: On top of that, Kimmel's numbers had plummeted. So here
- 6:31Speaker 3: are some of the stats. According to Late Nighter in August,
- 6:36Speaker 3: Jimmy Kimmel lost eleven percent of his audience, down to
- 6:40Speaker 3: one point one zero four million viewers. To put that
- 6:44Speaker 3: in perspective, Jimmy Kimmel was getting fewer viewers than we
- 6:49Speaker 3: have Verdict listeners.
- 6:52Speaker 1: So this podcast Congratulations by the way, that's like the
- 6:56Speaker 1: real deal right there.
- 6:58Speaker 3: Like he's on AB see in every television in America,
- 7:03Speaker 3: and Verdict was kicking his ass. Now now, by the way,
- 7:06Speaker 3: we will continue kicking his ass, and I want to
- 7:08Speaker 3: keep continue growing those numbers. But one point one zero
- 7:12Speaker 3: four million viewers. And by the way, in the eighteen
- 7:15Speaker 3: to forty nine demographic, which is the critical demographic for
- 7:18Speaker 3: selling stuff that advertiss care about, Kimmel was down fifteen percent.
- 7:24Speaker 3: Do you know how many viewers eighteen to forty ninety had.
- 7:27Speaker 2: I'm going to guess under four hundred thousand.
- 7:31Speaker 3: One hundred and twenty nine thousand. Wow.
- 7:34Speaker 1: So with it's sixteen a report, I think it was
- 7:37Speaker 1: sixteen million dollar year salary.
- 7:38Speaker 3: By the way, for him, Yeah, he was getting paid
- 7:41Speaker 3: a crap ton of money. And to give that in perspective, Colbert,
- 7:45Speaker 3: who was fired, was losing paramount forty million dollars a year.
- 7:51Speaker 2: Yeah.
- 7:52Speaker 3: ABC has not made their numbers public, so we don't
- 7:55Speaker 3: know what the numbers were. But Kimmel had lost even
- 7:59Speaker 3: more viewers than Colbert, So you have to assume he
- 8:02Speaker 3: was losing ABC even more money than Colbert was doing.
- 8:06Speaker 3: So he was a train wreck. He was a disaster.
- 8:10Speaker 3: He was unfunny, and he was also bitter and nasty,
- 8:16Speaker 3: and he lied about Charlie Kirk.
- 8:18Speaker 1: All right, Sanata, I want to go back to what
- 8:20Speaker 1: you were saying a moment ago. And one of the
- 8:22Speaker 1: interesting things about Kimmel that I do want to break
- 8:25Speaker 1: down is so many on the left screaming this is
- 8:28Speaker 1: cancel culture. It is not cancel culture. He said something dumb.
- 8:33Speaker 1: I also think though, that ABC News was looking for
- 8:37Speaker 1: a reason to get out for what you just described,
- 8:41Speaker 1: which is you don't have anybody watching the revenues down.
- 8:45Speaker 1: The guy's making sixteen million dollars a year, and so
- 8:48Speaker 1: this was a perfect opportunity to say, hey, we can
- 8:51Speaker 1: get out of this with reason.
- 8:53Speaker 2: Here.
- 8:53Speaker 1: Page six is even saying they even asked him if
- 8:56Speaker 1: you gave some money and made a donation and apologized,
- 9:00Speaker 1: and apparently he was saying, I won't do it. That's
- 9:02Speaker 1: what they're reporting tonight as well, is that they're saying, hey,
- 9:06Speaker 1: you know, he's like, no, I'm not going to apologize
- 9:08Speaker 1: the Kirk family. So it gave them even an easier
- 9:10Speaker 1: ability to get rid of him and can this thing.
- 9:12Speaker 3: Early look, unquestionably, ABC was hemorrhaging money. This was a
- 9:17Speaker 3: smart business decision, but also what Jimmy Kimmel said was
- 9:20Speaker 3: reprehensible and I want you to listen to it. I
- 9:22Speaker 3: want you to if you're watching online, I want you
- 9:24Speaker 3: to watch. This is the monologue that got Jimmy Kimmel fired.
- 9:29Speaker 3: Give a listen.
- 9:30Speaker 4: We hit some new lows over the weekend with the
- 9:33Speaker 4: Magga Gang desperately trying to characterize this kid who murdered
- 9:37Speaker 4: Charlie Kirk as anything other than one of them and
- 9:39Speaker 4: do everything they can to score political points from and
- 9:43Speaker 4: in between the finger pointing, there was grieving. On Friday,
- 9:46Speaker 4: the White House flew the flags at half staff, which
- 9:48Speaker 4: got some criticism, but on a human level, you can
- 9:52Speaker 4: see how hard the president is taking this back.
- 9:55Speaker 5: Adult's got a latting your friend, Charlie Kirk asked sir personally,
- 9:58Speaker 5: how are you holding up over.
- 10:00Speaker 3: The last day and a half served, I think very good.
- 10:02Speaker 3: And by the way, right there, you see all the trucks.
- 10:05Speaker 3: They just started construction of the new ball room for
- 10:07Speaker 3: the White House.
- 10:09Speaker 2: Which is something they've been trying to get.
- 10:10Speaker 3: As you know, for about one hundred and fifty years,
- 10:13Speaker 3: and it's going to be a beauty. Yes, he's at the.
- 10:17Speaker 4: Fourth stage of grief construction.
- 10:21Speaker 3: Demolition construction.
- 10:25Speaker 4: This is not how an adult grief's the murder of
- 10:27Speaker 4: somebody called a friend.
- 10:28Speaker 3: This is how a four year old mourns a goldfish.
- 10:31Speaker 1: Okay, by the way, so people understand context. There the
- 10:35Speaker 1: reporting out of the White House, and you have talked
- 10:37Speaker 1: to you have said that the present was gutted over
- 10:39Speaker 1: the assassination of Charlie Kirk. It was pretty clear he
- 10:43Speaker 1: did not want to talk about it right then, and
- 10:45Speaker 1: as he was outside.
- 10:47Speaker 3: It's not like reporters are a therapists.
- 10:49Speaker 1: Right, yeah, I mean it was obvious he didn't want
- 10:52Speaker 1: to go there at that moment, and so he.
- 10:54Speaker 3: And let me say, Ben, the thing to understand about
- 10:57Speaker 3: Jimmy Kimmel what he just said there, there's a technical
- 11:00Speaker 3: term for that. It's called a lie. So he stood
- 11:04Speaker 3: up and said, the murderer of Charlie Kirk was a
- 11:09Speaker 3: Maga Republican.
- 11:10Speaker 2: YEP.
- 11:11Speaker 3: That is flat out false. That is a brazen lie.
- 11:15Speaker 3: And we talked about this our last podcast. If you
- 11:18Speaker 3: didn't listen to our last podcast, you should go back
- 11:20Speaker 3: and listen to it. I went on CNN with Caitlin
- 11:23Speaker 3: Collins and she fought me like crazy. We don't know
- 11:26Speaker 3: what the motive of this guy is. This murderer, this
- 11:29Speaker 3: assassin was a left wing radical. He was an Antifa activist.
- 11:35Speaker 3: He was a transgender activist. He was living with a
- 11:39Speaker 3: transgender man transitioning to be a woman. That transgender man
- 11:44Speaker 3: was his boyfriend. He wrote on the bullets Antifa and
- 11:48Speaker 3: transgender slogans. He hated Charlie Kirk. He admitted all of this.
- 11:53Speaker 3: It is unequivocal. This is a hardcore leftist and I
- 11:56Speaker 3: got to say it is amazing. The vast majority of
- 11:59Speaker 3: Democrats today believe Charlie Kirk's murderer was a maga Republican
- 12:05Speaker 3: because the media is corrupt and they are lying. When
- 12:09Speaker 3: I was on CNN with Caitlyn Collins, she refused to
- 12:12Speaker 3: acknowledge that because CNN is lying to their viewers, MSNBC
- 12:18Speaker 3: is lying to their viewers. And Jimmy Kimmel stood up
- 12:21Speaker 3: with his measley one point one million viewers and lied
- 12:25Speaker 3: to them. They said this murderer was a maga Republican. Now, ABC,
- 12:30Speaker 3: theoretically ABC News is a news organization. They should not
- 12:34Speaker 3: be in the business of lying to Americans, and Jimmy
- 12:37Speaker 3: Kimmel shamelessly lied to them because he has a political agenda.
- 12:42Speaker 1: Truth be damned, and I think it's top to bottom.
- 12:46Speaker 1: So people understand this, And I'll give you example. The
- 12:48Speaker 1: view on ABC is actually, I'm pretty sure if I
- 12:51Speaker 1: remember correctly, under the news division, Kimmel is under like
- 12:54Speaker 1: that in general, I think entertainment, but under their news.
- 12:57Speaker 2: If you want to know how much is he entertained? Yeah,
- 13:00Speaker 2: right exactly.
- 13:01Speaker 1: But if you want to know how much propaganda machine
- 13:04Speaker 1: ABC News is, this is just example. It's a small example,
- 13:09Speaker 1: but it's a powerful one. In twenty twenty five, the
- 13:11Speaker 1: viewers had one hundred and two liberal guests on and
- 13:14Speaker 1: not one single Republican guest.
- 13:17Speaker 3: But by the way, to be clear, Ben, I've been
- 13:19Speaker 3: on the View multiple times, so I've written to date
- 13:22Speaker 3: four books. For my second book, they had me on.
- 13:25Speaker 3: For my third book, they had me on now, particularly
- 13:28Speaker 3: for the third book. We got into it. It was
- 13:30Speaker 3: a hell of a scrape. Whoopy Goldberg and the other
- 13:34Speaker 3: cackling hosts of the View insist.
- 13:39Speaker 2: The nicest way it's ever been put.
- 13:41Speaker 3: By the way, did I refrained myself. Look, i gotta
- 13:46Speaker 3: say I'm on good behavior because I went through like
- 13:50Speaker 3: nine different nouns, and I just went with hosts.
- 13:54Speaker 2: I like it well done.
- 13:55Speaker 3: But but Whoopy insisted, She said, violence is only a
- 13:59Speaker 3: right wing phenomenon. I said, well, what about the Antifa
- 14:02Speaker 3: and the Black Lives Matter riots all over the country
- 14:04Speaker 3: that burned cities across America. And she looked at me
- 14:07Speaker 3: befuddled and said, I don't know what a Antifa Black
- 14:10Speaker 3: Lives Matter riot is. You think about the millions of
- 14:15Speaker 3: housewives that watch that show, that are lied to every
- 14:18Speaker 3: single day. It went so badly for them that my
- 14:22Speaker 3: fourth book, Unwoke, How to Defeat Cultural Marxism in America,
- 14:26Speaker 3: available on Amazon, by the way, when when it came out,
- 14:30Speaker 3: I reached out and said, hey, I'd like to go
- 14:32Speaker 3: in the view again, and they said no, thank you,
- 14:35Speaker 3: like like you picked her now, we cannot have. We
- 14:40Speaker 3: are in the business of lying to our viewers, and
- 14:43Speaker 3: when you come on, you make it really hard to
- 14:45Speaker 3: lie to our viewers because you actually bring up facts
- 14:47Speaker 3: and substance and and and we're just not good enough
- 14:51Speaker 3: to lie in the face of facts and substance. So
- 14:53Speaker 3: that's who they are.
- 14:55Speaker 2: That's who they are.
- 14:55Speaker 1: It's funny you mentioned Kaylen Collins in your interview just
- 14:59Speaker 1: just if you miss did it's up on social media.
- 15:02Speaker 1: I actually think that you should do more of these
- 15:05Speaker 1: because the number of viral clips. So now that came
- 15:09Speaker 1: out of you going on with caateon Collins and people
- 15:12Speaker 1: seeing your grand debate with her, which is an important one,
- 15:15Speaker 1: and calling her out for saying we don't know the
- 15:17Speaker 1: motive in the death of the assassination of Charlie Kirk
- 15:21Speaker 1: is one that now has just exploded. And afterwards, I'm like,
- 15:25Speaker 1: you know what, it may be worth it for you
- 15:27Speaker 1: to do this like every week because then you get
- 15:30Speaker 1: to call them out every week and they are held
- 15:33Speaker 1: accountable because otherwise they just go on TV and they
- 15:36Speaker 1: just lie.
- 15:38Speaker 3: Well, understand, Jimmy Kimmel was fired because number one, he's
- 15:41Speaker 3: not funny. Number two, he was losing ABC massive amounts
- 15:44Speaker 3: of money, and number three, he flat out lied an
- 15:47Speaker 3: incredibly important issue, which is who the murder of Charlie
- 15:50Speaker 3: Kirk was.
- 15:52Speaker 1: But first I want to talk to you about something
- 15:53Speaker 1: that probably nine nine point nine percent of you have.
- 15:56Speaker 2: It is a cell phone.
- 15:58Speaker 1: You may not realize it, but if you're with Big Mobile,
- 16:00Speaker 1: you're giving big donations by default to liberal causes and organizations.
- 16:06Speaker 1: We're talking about organizations that are actually fighting for abortions
- 16:11Speaker 1: to take place at record numbers. That is what your
- 16:14Speaker 1: money is going to, including radical liberal causes, candidates and
- 16:19Speaker 1: organizations all at the same time. Now you say, well,
- 16:22Speaker 1: hold on, how's it happened, they get big donations.
- 16:24Speaker 2: It's just that simple. And that is why more than a.
- 16:27Speaker 1: Decade ago, there is a group of people that got
- 16:30Speaker 1: together and said we've got to do something different. We
- 16:33Speaker 1: need to vote with our dollars. They start a company
- 16:35Speaker 1: called Patriot Mobile, and Patriot Mobile is standing in the
- 16:39Speaker 1: gap for every American that believes that freedom is worth
- 16:42Speaker 1: fighting for. Not only are they leading the way in
- 16:45Speaker 1: the red economy, but Patriot Mobile also outgains the competition
- 16:49Speaker 1: now when it comes to technology in twenty twenty five,
- 16:52Speaker 1: so you're going to get insanely good coverage, nationwide coverage,
- 16:56Speaker 1: and Patriot Mobile, in fact, is one of the only
- 16:58Speaker 1: carriers with access to all three major US networks. That
- 17:02Speaker 1: means you get the best coverage you can get, along
- 17:05Speaker 1: with the ability to have multiple numbers on different networks
- 17:08Speaker 1: on a single smartphone. It is a game changer, especially
- 17:13Speaker 1: for businessmen and women who are carrying around two phones.
- 17:16Speaker 1: They also offer a limited data plans, mobile hotspots, international roaming,
- 17:20Speaker 1: internet backup, and so much more. Now switching has never
- 17:24Speaker 1: been easier. You can literally activate in minutes from the
- 17:27Speaker 1: comfort of your home. You keep your number, keep your phone,
- 17:30Speaker 1: or upgrade. And here's where the magic happens. You get
- 17:34Speaker 1: every month when you pay your bill. They take about
- 17:36Speaker 1: five percent of your bill and they give it back
- 17:38Speaker 1: to conservative causes and organizations that fight for a First
- 17:41Speaker 1: and or Second Amendment rights. So if you want to
- 17:44Speaker 1: make a difference in every call you make, you need
- 17:46Speaker 1: to switch to Patriot Mobile. I use them and I
- 17:48Speaker 1: love them. Go to Patriot Mobile dot com slash vertict
- 17:51Speaker 1: and use the promo code vertict. You're gonna get a
- 17:53Speaker 1: free month of service. That's Patriot Mobile dot com slash vertict.
- 17:58Speaker 1: Or you can call them and switch over the phone
- 18:00Speaker 1: seven to Patriot that's nine to seven two Patriot Patriot.
- 18:04Speaker 2: Moobile dot com slash verdict.
- 18:06Speaker 1: All right, so let's get to this issue center about
- 18:08Speaker 1: the FCC. They've gotten involved in this. This is I
- 18:12Speaker 1: want to be clear, I believe it's it's controversial. It
- 18:17Speaker 1: concerns me and you and I actually really haven't talked
- 18:20Speaker 1: about this much, so I genuinely want to know what
- 18:22Speaker 1: you think about this. I don't like people tipping the
- 18:25Speaker 1: scales and pushing too hard, and let me explain why,
- 18:29Speaker 1: because if we do it, they're gonna do it when
- 18:32Speaker 1: they get back in power. And we know the ebbs
- 18:34Speaker 1: and flows of politics. This is something I don't like it.
- 18:37Speaker 1: I don't want anyone getting censored. I do not want
- 18:41Speaker 1: it because it will happen to conservatives. Yes, and it
- 18:43Speaker 1: will happen ten times harder than what we're talking about
- 18:46Speaker 1: right now. And that's just my hot take on it.
- 18:49Speaker 1: But I think it's an important when this is literally
- 18:50Speaker 1: what I do for a living, I don't want one
- 18:52Speaker 1: cutting me down and what I do for a living
- 18:54Speaker 1: or free speech.
- 18:55Speaker 3: Yeah, you and I have not talked about this before
- 18:57Speaker 3: doing the podcast, but I'm not surprised that we're on
- 18:59Speaker 3: the same page. I want to play because a lot
- 19:02Speaker 3: of the media is very much focused on this, particularly
- 19:05Speaker 3: the left wing media. But Brendan Carr is the chairman
- 19:08Speaker 3: of the Federal Communications Commission. He did an interview with
- 19:11Speaker 3: Benny Johnson. Benny's a friend of ours. He's a great guy,
- 19:15Speaker 3: but he leaned in hard on Jimmy Kimmel, and he
- 19:19Speaker 3: threatened government retaliation for what Kimmel said. So I want
- 19:23Speaker 3: you to give a listen to this interview and then
- 19:25Speaker 3: we're going to talk about it.
- 19:28Speaker 6: I think this is an isolated incident.
- 19:30Speaker 5: I mean, you go back to Representative Swallwell, he had
- 19:32Speaker 5: a tweet out last week where he was saying that,
- 19:35Speaker 5: you know, emphasizing that Charlie Kirks killer was a straight
- 19:38Speaker 5: white male from a Republican family that voted for Donald Trump.
- 19:41Speaker 6: In some quarters, there's a very concerted.
- 19:44Speaker 5: Effort to try to lie to the American people about
- 19:48Speaker 5: the nature, as you indicate it, one of the most
- 19:51Speaker 5: significant newsworthy public interest acts that.
- 19:56Speaker 6: We've seen in a long time.
- 19:58Speaker 5: In what appears to be an action, appears to be
- 20:01Speaker 5: an action by Jimmy Kimmel to play into that narrative
- 20:07Speaker 5: that this was somehow a maga or Republican motivated person.
- 20:13Speaker 5: If that's what happened here with his conduct, that is
- 20:16Speaker 5: really really sick. And I've been very clear from the
- 20:18Speaker 5: moment that I have become chairman of the FCC, I
- 20:22Speaker 5: want to reinvigorate the public interest and what people don't
- 20:25Speaker 5: understand is that the broadcasters, and you've gotten this right,
- 20:28Speaker 5: are entirely different than people that use other forms of communication.
- 20:32Speaker 5: They have a license granted by us at the FCC,
- 20:35Speaker 5: and that comes with it an obligation to operate in
- 20:39Speaker 5: the public interest. And we can get into some ways
- 20:41Speaker 5: that we've been trying to reinvigorate the public interest and
- 20:43Speaker 5: some changes that we've seen. But frankly, when you see
- 20:46Speaker 5: stuff like this, I mean, look, we can do this
- 20:48Speaker 5: the easy way or the hard way.
- 20:50Speaker 6: These companies can.
- 20:51Speaker 5: Find ways to change conduct, to take action frankly on
- 20:56Speaker 5: Kimmel or you know there's gonna be additional work for
- 20:59Speaker 5: the FCC ahead.
- 21:01Speaker 7: What kind of action would you see? At the very least,
- 21:04Speaker 7: would like to have an on air apology from Jimmy Kimmel,
- 21:09Speaker 7: to the Kirk family, to all of those who he
- 21:13Speaker 7: slandered because he did say that Charlie Kirk. He is
- 21:16Speaker 7: effectively saying that our movement did this, our movement killed Charlie,
- 21:20Speaker 7: that Charlie was deserving of this effectively, and we've seen
- 21:24Speaker 7: that rear its head. This happens quite regularly actually on
- 21:29Speaker 7: MSNBC and on other networks where they're trying to victim blame.
- 21:34Speaker 7: And what that does, mister Chairman, respectfully, is continues the
- 21:38Speaker 7: lie and continues the threat level to say effectively that
- 21:45Speaker 7: we have no share in this problem at all. On
- 21:49Speaker 7: the left. This is a clear cut case. What would
- 21:52Speaker 7: you like to see done at ABC?
- 21:54Speaker 5: Well, look, I think what you said there strikes me
- 21:57Speaker 5: as a very reasonable minimal step that can be taken.
- 22:00Speaker 6: I mean, obviously, look, there's calls for kim will be fired.
- 22:04Speaker 5: I think you know, you could certainly see a path
- 22:07Speaker 5: forward for suspension over this. And again, you know, the
- 22:11Speaker 5: FCC is going to have remedies that we could look at.
- 22:14Speaker 6: And again you know we may ultimately be called to
- 22:16Speaker 6: be a judge on that.
- 22:18Speaker 3: No, no, no, no, no. Look, look, I like Brendan Carr.
- 22:24Speaker 3: He's a good guy. He's the chairman of the FCC.
- 22:26Speaker 3: I work closely with him. But what he said there
- 22:30Speaker 3: is dangerous as hell uh on.
- 22:34Speaker 1: For people that are listening, because this is going to
- 22:35Speaker 1: be quote controversial. So I want to make sure we
- 22:38Speaker 1: explain it clearly. When you say no and it's dangerous,
- 22:41Speaker 1: explain and run this out the slippery slope that this
- 22:45Speaker 1: can open, so that people understand why we're saying it.
- 22:49Speaker 3: So the Federal Communication Commission is in charge of granting
- 22:53Speaker 3: broadcast licenses, So ABC, NBCCBS they have licenses from the FCC.
- 22:59Speaker 3: It is true that understatute they're required to be in
- 23:02Speaker 3: the public interest. What he is saying is Jimmy Kimmel
- 23:07Speaker 3: was lying. That's true. He was lying, and he is
- 23:10Speaker 3: lying to the American people. Is not in the public interest.
- 23:12Speaker 3: And so he threatens explicitly, We're gonna cancel ABC's license.
- 23:17Speaker 3: We're gonna take him off the air, so ABC cannot
- 23:19Speaker 3: broadcast anymore. And I gotta say, he threatens it. He says,
- 23:26Speaker 3: we can do this the easy way, Oh, we can
- 23:28Speaker 3: do this the hard way.
- 23:30Speaker 2: Yeah.
- 23:30Speaker 3: And I got to say, that's right out of Good Fellows.
- 23:32Speaker 3: That that that that that's right out of a mafioso
- 23:35Speaker 3: coming into a bar going nice bye, you have here.
- 23:38Speaker 3: It'd be a shame of something happened to it. And
- 23:42Speaker 3: I got to say, look, I understand, Jimmy Kimmel has
- 23:46Speaker 3: mocked me so many times I cannot count. The corporate media.
- 23:50Speaker 3: They are dishonest, they are liars. I hate what Jimmy
- 23:54Speaker 3: Kimmel said. I am thrilled that he was fired but
- 23:58Speaker 3: let me tell you, if the government gets in the
- 24:01Speaker 3: business of saying say what you the media have said,
- 24:07Speaker 3: We're going to ban you from the airwaves if you
- 24:10Speaker 3: don't say what we like. That will end up bad
- 24:15Speaker 3: for conservatives. It reminds me of you and I are
- 24:17Speaker 3: both fans of the Lord of the Rings Jarr R. Tolkien.
- 24:20Speaker 3: It reminds me of like the Ring of Power, and
- 24:24Speaker 3: it is so attractive. It's sort of like conservatives saying, wait, wait,
- 24:27Speaker 3: if we have government, we have power, we can ban
- 24:31Speaker 3: the media. Let me tell you what will happen going
- 24:34Speaker 3: down this road. There will come a time when a
- 24:37Speaker 3: Democrat wins again, wins the White House.
- 24:41Speaker 1: They will get rid of every Democrats see me speak
- 24:43Speaker 1: it's a conservative. They'll get rid of every podcast so
- 24:45Speaker 1: get rid of it.
- 24:46Speaker 3: They will silence us. They will use this power and
- 24:50Speaker 3: they will use it ruthlessly, and that is dangerous. And
- 24:54Speaker 3: by the way, in the Biden administration, they tried to
- 24:57Speaker 3: go after and revoke Fox license because they didn't like
- 25:01Speaker 3: and they say everything they say on Fox's hate speech.
- 25:04Speaker 3: I'm sure they say everything you and I say it's
- 25:07Speaker 3: hate speech, is misinformation. They've defined anything counter to the
- 25:12Speaker 3: leftist narrative as misinformation. Now, we just talked about Jimmy
- 25:17Speaker 3: Kimmel was lying. But you know what, it's interesting Brendan said, well, gosh,
- 25:23Speaker 3: they slandered They slandered Charlie Kirk and his family. You
- 25:27Speaker 3: know what, if they slandered him, there's already a remedy.
- 25:31Speaker 3: There's a remedy of defamation. ABC could be sued and
- 25:34Speaker 3: by the way, you get a defamation lawsuit, you could
- 25:36Speaker 3: pay millions of dollars. Let that process play out. I
- 25:40Speaker 3: think it is unbelievably dangerous for government to put itself
- 25:45Speaker 3: in the position of saying, we're going to decide what
- 25:48Speaker 3: speech we like and what we don't, and we're gonna
- 25:50Speaker 3: threaten to take you off air if we don't like
- 25:53Speaker 3: what you're saying. And it might feel good right now
- 25:56Speaker 3: to threaten Jimmy Kimmel, Yeah, but when it is used
- 26:00Speaker 3: to silence every conservative in America, we will regret it.
- 26:03Speaker 3: And so again, I like Brendan Carr, but we should
- 26:07Speaker 3: not be in this business. We should denounce it. It's fine
- 26:10Speaker 3: to say what Jimmy Kimmel said was deplorable, it was disgraceful,
- 26:15Speaker 3: and he should be off air. But we shouldn't be
- 26:18Speaker 3: threatening government power to force him off air. That's a
- 26:21Speaker 3: real mistake.
- 26:23Speaker 2: Senator.
- 26:23Speaker 1: I want to get to something else that happened earlier
- 26:25Speaker 1: this week, and that was the questioning of the FBI Director,
- 26:28Speaker 1: Cash Battel. You had the opportunity to talk with Cash
- 26:32Speaker 1: on a number of different issues. Obviously one of them
- 26:34Speaker 1: that was in front of mine was the assassination of
- 26:38Speaker 1: our friend Charlie kirk Well.
- 26:41Speaker 3: Absolutely so this week Cash Battel, the Director of the FBI,
- 26:44Speaker 3: testified in front of the Senate Judiciary Committee, and I
- 26:47Speaker 3: took the opportunity to question on a number of topics,
- 26:49Speaker 3: but front and center to urge Cash Battel to follow
- 26:54Speaker 3: the money, and in particular to go after Antifa and
- 26:58Speaker 3: to designate Antifa as a terrorist organization. Here's the exchange
- 27:02Speaker 3: Cash that I had. Give a listen. I want to
- 27:06Speaker 3: encourage you, in the course of this investigation. Absolutely go
- 27:11Speaker 3: after anyone who ate it and abedded, but I want
- 27:14Speaker 3: to more broadly encourage you follow the money. The violence
- 27:20Speaker 3: we are seeing is not purely organic. There is I believe,
- 27:27Speaker 3: significant money that is spreading dissension, that is spreading violence. Antifa.
- 27:36Speaker 3: Do you believe Antifa is a terrorist organization.
- 27:39Speaker 8: I believe Antifa is associated with a lot of violence
- 27:42Speaker 8: in this country. As to its designation, I'll leave that
- 27:44Speaker 8: to the appropriate authorities.
- 27:45Speaker 3: So I would encourage the administration to designate Antifa as
- 27:48Speaker 3: a terrorist organization to go systematically after Antifa. They committed
- 27:52Speaker 3: acts of violence all over the country, and the shell
- 27:57Speaker 3: casings have multiple references to slogans that Antifa has popularized.
- 28:02Speaker 3: I believe there is considerable money funding it. I would
- 28:06Speaker 3: note that I've introduced legislation called the Stop Funders Act.
- 28:10Speaker 3: Stop Funders Act would add rioting to the list of
- 28:14Speaker 3: predicate offenses under RICO. I believe the money should be
- 28:18Speaker 3: fuck should be tracked and prosecuted under RICO. And both
- 28:23Speaker 3: the Antifa and Black Lives Matter riots of a couple
- 28:26Speaker 3: of years ago and the pro open border riots in
- 28:30Speaker 3: Los Angeles and other cities of this past year, I
- 28:34Speaker 3: believe there was significant money behind those riots. I'm not
- 28:38Speaker 3: the only person who noticed at the anti Semitic protest
- 28:42Speaker 3: and violent protests on college campuses that many of the
- 28:45Speaker 3: tents all matched, and so I would ask, would it
- 28:49Speaker 3: aid your ability to prosecute these matters? If Congress passed
- 28:55Speaker 3: into law the Stop Funders Act, and if rioting was
- 28:57Speaker 3: added to the list of predicate offenses for Rico. Yes,
- 29:04Speaker 3: talk to me about the efforts of the FBI to
- 29:08Speaker 3: go after the funders of the anti Semitic protests on
- 29:12Speaker 3: college campuses, the pro open border protests in cities, and
- 29:17Speaker 3: potential LGBT violence. Talk to me about the efforts to
- 29:21Speaker 3: go after the money of those who are funding and
- 29:24Speaker 3: promoting violence.
- 29:26Speaker 8: As I've always said, Senator, money doesn't lie, and we've
- 29:28Speaker 8: been following the money. And so that's what we're doing,
- 29:30Speaker 8: issuing lawful process to organizations involved with criminal activity because
- 29:34Speaker 8: the money's got to come from somewhere and it has
- 29:36Speaker 8: to be funded somehow. So we have extensive investigations ongoing
- 29:39Speaker 8: into numerous organizations that are related to violent criminal activity.
- 29:44Speaker 3: Cutting off the money will make America much safer, and
- 29:48Speaker 3: that is the core job of the FBI. And I
- 29:50Speaker 3: thank you for doing your job.
- 29:52Speaker 1: Now you look at what you just said there in
- 29:54Speaker 1: the back and forth, Cenator, and this turned very quickly
- 29:57Speaker 1: into a new policy from the Trump administration as well.
- 30:01Speaker 2: That is the best news coming out of this.
- 30:04Speaker 3: Absolutely.
- 30:05Speaker 5: So.
- 30:05Speaker 3: This testimony was on Tuesday, The very next day, President
- 30:11Speaker 3: Trump announced he was doing what I was calling for,
- 30:14Speaker 3: which is designating Antifa as a terrorist organization. I'm going
- 30:17Speaker 3: to read to you from Fox News. President Donald Trump
- 30:20Speaker 3: on Wednesday announced he will designate Antifa, a left wing
- 30:23Speaker 3: activist group, a major terrorist organization. Trump described the group
- 30:29Speaker 3: as quote a sick, dangerous, radical left disaster in a
- 30:33Speaker 3: truth social announcement, The president added that he will be
- 30:36Speaker 3: strongly recommending that those funding Antifa be thoroughly investigated incordance
- 30:42Speaker 3: with the highest legal standards and practices. The announcement comes
- 30:46Speaker 3: just days after Trump said he would one hundred percent
- 30:49Speaker 3: consider the designation. Speaking to reporters in the Oval Office Monday,
- 30:53Speaker 3: Trump accused Antiva participants of being quote professional agitators in
- 30:58Speaker 3: response to the administration's recent crackdown on illegal immigration. Quote
- 31:02Speaker 3: Antifa is terrible, the President said, these aren't protests. These
- 31:06Speaker 3: are crimes that they're doing. They're throwing bricks at cars
- 31:10Speaker 3: of the Ice and Border Patrol. They're professional agitators. They
- 31:13Speaker 3: should be put in jail. What they're doing in this
- 31:16Speaker 3: country is really subversive. And I will say this goes
- 31:19Speaker 3: right to the heart of a distinction that I've tried
- 31:21Speaker 3: to lay it out layout repeatedly, which is free speech
- 31:25Speaker 3: is protected. You can say things that are vile, that
- 31:28Speaker 3: are hateful, that are horrible, that we hate, and the
- 31:31Speaker 3: First Amendment protects it. Conduct is not protected when you
- 31:36Speaker 3: engage in violence, it is not protected. What Antifa is doing,
- 31:40Speaker 3: engaging in violence, engaging in harassment, engaging in threats. That
- 31:45Speaker 3: is not protected. And so what I urge cash betel,
- 31:50Speaker 3: follow the money, go after the money. And look, I
- 31:54Speaker 3: believe there's money that is coming from foreign nations. There's
- 31:56Speaker 3: money that's coming from Cutter, there's money that's coming from Iran,
- 31:59Speaker 3: there may be money coming from communist China. And there's
- 32:02Speaker 3: also money coming from the gazillionaire left wing funders of
- 32:07Speaker 3: the Democrat Party, people like George Soros at his entire organization,
- 32:11Speaker 3: that are funding these radical organizations. And it's one thing
- 32:16Speaker 3: to go and prosecute the individual criminals. We should do that, sure,
- 32:20Speaker 3: but if you want to solve the problem, it's why
- 32:22Speaker 3: I've introduced the legislation, the Stop Funders Act, because RICO
- 32:26Speaker 3: is an incredibly powerful tool to prosecute not just an
- 32:30Speaker 3: individual defendant, but a criminal organization, and criminal organizations are
- 32:35Speaker 3: usually structured with a hub and spokes, and so following
- 32:39Speaker 3: the money is how you get the people writing checks
- 32:43Speaker 3: that are sitting in their Manhattan penthouses funding the anti American,
- 32:49Speaker 3: anti Israel, communist jihadist agitators that are destroying this country.
- 32:54Speaker 3: And so I got to say I was really encouraged.
- 32:57Speaker 3: I've been pressing in the first Trump administration. I pressed
- 33:01Speaker 3: for years for the first Trump administration to designate Antifa
- 33:07Speaker 3: as a terrorist organization. There was a lot of openness
- 33:10Speaker 3: to that argument, but it never succeeded. They never did
- 33:12Speaker 3: it this time. When I pressed on Tuesday, the next day,
- 33:16Speaker 3: the President came out and said, We're going to do that.
- 33:18Speaker 3: That's exactly the right thing to do.
- 33:20Speaker 1: Yeah, it is big, it's going to be really important.
- 33:23Speaker 1: It's going to have a huge impact going forward. That
- 33:26Speaker 1: may be the best part of all. And of course,
- 33:28Speaker 1: you know you're doing something right when the left is
- 33:30Speaker 1: leasing their mind. They're saying, oh, this is the president
- 33:32Speaker 1: trying to silence political organizations. I'm sorry, they're not a
- 33:37Speaker 1: political organization terrorist organization. There's a big difference between a
- 33:42Speaker 1: political organization and a terrorist organization, and Antifa has all
- 33:47Speaker 1: the markings.
- 33:48Speaker 2: As you described to.
- 33:49Speaker 1: Have a terrorist organization going all the way back to
- 33:52Speaker 1: twenty sixteen when your first we're calling for this.
- 33:54Speaker 3: If you engage in violence, it is not speech. Violence
- 33:58Speaker 3: is not speech. And by the way, one who commits
- 34:00Speaker 3: violence should be prosecuted and go to jail. And that's
- 34:03Speaker 3: true whether you're left wing or right wing. I might
- 34:05Speaker 3: agree with what you're saying, but if you engage in violence,
- 34:08Speaker 3: that is not acceptable. Speech is different from violence. We
- 34:12Speaker 3: have to protect speech and we how to prosecute violence
- 34:15Speaker 3: that put the violent criminals in jail.
- 34:17Speaker 2: Amen to that.
