- 0:00Speaker 1: Welcome. It is Verdict with Senator Ted Cruz, Ben Ferguson
- 0:03Speaker 1: with you. Nice to have you with us wherever you
- 0:04Speaker 1: are around the country, especially if you're listening on radio
- 0:07Speaker 1: right now as well. We've got a pack show and
- 0:11Speaker 1: Senator I don't even know if you thought that it
- 0:13Speaker 1: was going to be all about you with the James
- 0:16Speaker 1: Comy indictment. He has been indicted for alleged false statement,
- 0:20Speaker 1: substruction of congressional proceedings. This is obviously, as you would say,
- 0:25Speaker 1: a big damn deal, and the clip of you talking
- 0:28Speaker 1: to James Comy is what everyone's playing on TV right now.
- 0:32Speaker 2: Well, Bennett's a momentous day. The former director of the FBI,
- 0:35Speaker 2: James Comy, has been indicted on two counts of lying
- 0:38Speaker 2: to Congress under oath and lying to Congress under oath
- 0:42Speaker 2: to be clear in response to questioning from me in
- 0:45Speaker 2: front of the Senate Judiciary Committee. The grand jury has
- 0:49Speaker 2: indicted him. He's facing prosecution, and we are seeing the
- 0:52Speaker 2: media losing their minds. The media is letting out a
- 0:56Speaker 2: primal scream of horror. The Democrats are horror. We're going
- 1:01Speaker 2: to break down exactly why James Comy has been indicted.
- 1:04Speaker 2: We're going to give you the factual predicate. We're going
- 1:06Speaker 2: to give you the legal predicate, and I will tell
- 1:09Speaker 2: you James Comy is defending himself, and he's defending himself
- 1:13Speaker 2: as a partisan, as someone who hates Donald Trump. He
- 1:16Speaker 2: is defending himself as if he were Chuck Schumer or
- 1:18Speaker 2: Nancy Pelosi, rather than actually addressing the facts that I
- 1:22Speaker 2: believe demonstrated he committed deliberately committed felonies when he testified
- 1:27Speaker 2: and falsely testified under oath to the United States Senate.
- 1:30Speaker 2: We're going to give you all those details. We're also
- 1:33Speaker 2: going to talk about the tragic shooting that happened when
- 1:35Speaker 2: a deranged sniper targeted an ICE facility in Dallas, Texas.
- 1:40Speaker 2: I was on the ground there moments after the shooting occurred.
- 1:44Speaker 2: This is yet the latest incidence of politically motivated violence
- 1:49Speaker 2: and violence directed against ICE agents and CBP and law enforcement.
- 1:54Speaker 2: This is getting worse and worse, and this must stop.
- 1:57Speaker 2: We're going to tell you exactly what happened and give
- 1:59Speaker 2: you all the facts.
- 2:01Speaker 1: Yeah, it's certainly a very very very big story. All
- 2:04Speaker 1: of you know that I am a pro Second Amendment guy.
- 2:07Speaker 1: I've shared on numerous occasions how caring my firearms saved
- 2:10Speaker 1: my life from a gang related attack. But for those
- 2:13Speaker 1: of you out there with family members who may not
- 2:16Speaker 1: be comfortable having a gun by their side, you still
- 2:19Speaker 1: want them to be able to protect themselves and others
- 2:21Speaker 1: in times of danger, and that's where the Burno launcher
- 2:24Speaker 1: comes in. Berna is a handheld pistol that fires both
- 2:28Speaker 1: kinetic rounds and chemical irritants to separate you from an attacker.
- 2:32Speaker 1: Berna is a handheld pistol that fires both kinetic rounds
- 2:36Speaker 1: and chemical irritants to separate you from the attacker. I'm
- 2:40Speaker 1: here today with Josh Cherard from Berna to share the
- 2:43Speaker 1: true story of how a California homeowner used a Berna
- 2:47Speaker 1: launcher to stop a home intruder. Josh tell us what happened.
- 2:51Speaker 3: You know, Bob Braid was one of the earliest adopters
- 2:53Speaker 3: of Burna back when we first started. He lived in
- 2:55Speaker 3: California in a residential suburb of LA that was pretty
- 2:59Speaker 3: pro into a lot of vagrancy, a lot of homeless
- 3:01Speaker 3: walking up and down the street. He kept the burnet's
- 3:04Speaker 3: living room and one of these vagrants wandered in his
- 3:06Speaker 3: home just confused, probably chunk and intoxicated in the wrong house.
- 3:11Speaker 3: Bob was able to pull his burne out, point it
- 3:13Speaker 3: at the intruder, who promptly backed out of the home
- 3:17Speaker 3: back into the yard. And of course it was all
- 3:18Speaker 3: taught on surveillance. He didn't even have to use the
- 3:21Speaker 3: berna and he was able to ward off this intruder
- 3:24Speaker 3: in a situation that could have ended incredibly badly had
- 3:28Speaker 3: more force than used. This is a great demonstration of
- 3:31Speaker 3: how the lowest level of force can be used to
- 3:33Speaker 3: rectify a situation. And of course it was all thought
- 3:36Speaker 3: on video, which it makes for a great illustration of
- 3:39Speaker 3: how that burnet can be used on a day day basis.
- 3:42Speaker 1: There's a lot of people are going to say, well,
- 3:43Speaker 1: why wouldn't the homeowner just use a gun in this case?
- 3:46Speaker 3: Yeah, Well, one, it comes down to the legality you
- 3:48Speaker 3: know in this part of California and made very difficult
- 3:51Speaker 3: to use the gun. And then two, we saw that
- 3:54Speaker 3: this intruder literally just stumbled into the wrong home in
- 3:58Speaker 3: an altered state of mind. Nobody wants to kill anybody
- 4:02Speaker 3: that doesn't need killing that they absolutely don't have to.
- 4:05Speaker 3: So this is a great instance where the Berno was
- 4:07Speaker 3: able to be used the lowest level of les legal
- 4:10Speaker 3: forces able to use direct by the situation without bringing
- 4:13Speaker 3: a gun into that situation.
- 4:15Speaker 1: Yeah, I tell you I have one of these. My
- 4:17Speaker 1: family members do as well a lot of my friends.
- 4:19Speaker 1: If you want more information how you or a family
- 4:22Speaker 1: member can protect themselves with a Berno auncher, go to
- 4:25Speaker 1: Berna by RNA dot com. That's burna dot com by
- 4:31Speaker 1: RNA dot com again, protect yourself and your family burna
- 4:35Speaker 1: b why RNA dot com? All right, so, Senator, I
- 4:39Speaker 1: want to start with this clip, and I think this
- 4:42Speaker 1: is a great starting point for this indictment of the
- 4:45Speaker 1: former REPBI director James Comy. This is you questioning Comy
- 4:50Speaker 1: back in September of twenty twenty. Uh. This is the
- 4:55Speaker 1: back and forth between the two of you. Everyone listening.
- 4:58Speaker 1: This is really an important and part of history now
- 5:01Speaker 1: and could probably be an important part of this case.
- 5:03Speaker 2: To another topic. On May third, twenty seventeen, in this committee,
- 5:09Speaker 2: Chairman Grassley asked you point blank, quote have you ever
- 5:13Speaker 2: been an anonymous source in news reports about matters relating
- 5:16Speaker 2: to the Trump investigation of the Clinton investigation? You responded,
- 5:20Speaker 2: under oath quote never, he then asked you, quote, have
- 5:25Speaker 2: you ever authorized someone else at the FBI to be
- 5:27Speaker 2: an anonymous source in news reports about the Trump investigation
- 5:32Speaker 2: or the Clinton administration? You responded again under oath No. Now,
- 5:37Speaker 2: as you know, mister McCabe, who works for you, has
- 5:40Speaker 2: publicly and repeatedly stated that he leaked information to the
- 5:44Speaker 2: Wall Street Journal and that you were a directly aware
- 5:47Speaker 2: of it and that you directly authorized it. Now, what
- 5:52Speaker 2: mister McCabe is saying and what you testify to this
- 5:55Speaker 2: committee cannot both be true. One or the other is false.
- 6:00Speaker 2: Who's telling the truth.
- 6:02Speaker 4: I just can only speak to my testimony. I stand
- 6:04Speaker 4: by what the testimony you summarized that I gave in
- 6:07Speaker 4: May of twenty seventeen.
- 6:08Speaker 2: So your testimony as you've never authorized anyone to leak,
- 6:12Speaker 2: And mister McCabe, if he says contrary, is not telling
- 6:14Speaker 2: the truth. Is that correct?
- 6:16Speaker 4: Again, I'm not going to characterize Andy's testimony, but mine
- 6:19Speaker 4: is the same.
- 6:19Speaker 2: Today, all right, I'm going to make a final point
- 6:21Speaker 2: because my time has expired. This investigation of the president
- 6:25Speaker 2: was corrupt. The FBI and the Department of Justice were
- 6:28Speaker 2: politicized and weaponized, and in my opinion, there are only
- 6:32Speaker 2: two possibilities that you were deliberately corrupt or wilfully incompetent,
- 6:38Speaker 2: and I don't believe you were incompetent. This has done
- 6:41Speaker 2: severe damage to the professionals and the honorable men and
- 6:45Speaker 2: women at the FBI, because law enforcement should not be
- 6:49Speaker 2: used as a political weapon.
- 6:52Speaker 1: All right, So you listen to that, and then you'll
- 6:54Speaker 1: look at the indictment. Count one false statement to the
- 6:57Speaker 1: US Senate that he had not quote authorized someone else
- 7:01Speaker 1: of the FBI to be an anonymous news source. Count
- 7:04Speaker 1: two call me obstructed the Judiciary Committee's investigation through his
- 7:09Speaker 1: quote false and misleading statements. That is a big smoking gun.
- 7:15Speaker 2: Well it is. It's the basis of the indictment and
- 7:17Speaker 2: this will be the central focus of the trial. Now.
- 7:22Speaker 2: James Comy put out a statement tonight on Instagram, and
- 7:25Speaker 2: his statement is striking in that it is a political statement.
- 7:28Speaker 2: It is not a statement about the facts of the law.
- 7:31Speaker 2: So give a listen to what James Comby said this
- 7:33Speaker 2: evening in response to the indictment.
- 7:36Speaker 4: My family and I have known for years that there
- 7:38Speaker 4: are costs to standing up to Donald Trump, but we
- 7:42Speaker 4: couldn't imagine ourselves living any other way. We will not
- 7:46Speaker 4: live on our knees, and you shouldn't either. Somebody that
- 7:51Speaker 4: I love dearly recently said that fear is the tool
- 7:54Speaker 4: of a tyrant, and she's right. But I'm not afraid,
- 8:00Speaker 4: and I hope you're not either. I hope instead you
- 8:03Speaker 4: are engaged, You are paying attention, and you will vote
- 8:08Speaker 4: like your beloved country depends upon it, which it does.
- 8:13Speaker 4: My heart is broken for the Department of Justice, but
- 8:17Speaker 4: I have great confidence in the federal judicial system, and
- 8:20Speaker 4: I'm innocent, So let's have a trial.
- 8:24Speaker 1: I love how he is a victim there and acting
- 8:28Speaker 1: like he's above all of this. But center, let's just
- 8:31Speaker 1: go back to three point thirty of twenty three. James
- 8:35Speaker 1: Comey tweeted out, quote, it's been a good day. That
- 8:39Speaker 1: is how I reacted to Trump being in died in
- 8:41Speaker 1: the Alvin Bragg hush money case. So to act like
- 8:45Speaker 1: he's some sort of guy that's above all this. Look
- 8:47Speaker 1: at his own.
- 8:47Speaker 2: Words, well, his statement he put out in response to
- 8:50Speaker 2: this that could have been given by Chuck Schumer, Nancy Pelosi,
- 8:54Speaker 2: or King Jeffries or any other political Democrat. And in
- 8:58Speaker 2: fact he makes a call Mountain vote, it's a get
- 9:01Speaker 2: out the vote message. This is a former director of
- 9:04Speaker 2: the FBI. But to give you a sense of just
- 9:06Speaker 2: how much he loathes Donald Trump, this is a former
- 9:10Speaker 2: director of the FBI who tweeted out to the world
- 9:13Speaker 2: a picture of shells spelling out eighty six forty seven,
- 9:17Speaker 2: in other words, slang for kill the current President of
- 9:20Speaker 2: the United States, Donald V.
- 9:21Speaker 4: Trump.
- 9:22Speaker 2: To say, calling for the murder of the sitting president
- 9:25Speaker 2: is not appropriate for the former FBI director In an
- 9:29Speaker 2: ordinary time, that would be such an obvious statement that
- 9:33Speaker 2: nobody would even think to say it. But that's just
- 9:36Speaker 2: how much James Comy loathes Donald Trump. And understand. When
- 9:42Speaker 2: Trump became president the first time in January of twenty seventeen,
- 9:48Speaker 2: President Trump unfortunately made a serious mistake, which is he
- 9:51Speaker 2: left James Comey in office. In hindsight, on January twentieth,
- 9:56Speaker 2: twenty seventeen, President Trump should have called James Comy and
- 9:59Speaker 2: said thank you for your service to the nation. Your
- 10:01Speaker 2: services are no longer required. I am certain President Trump
- 10:06Speaker 2: wishes he had done that. I think the White House
- 10:09Speaker 2: team believed that Komy could focus on law enforcement, could
- 10:12Speaker 2: not be politicized, and that assumption proved to be in error.
- 10:19Speaker 2: James Comy presided over weaponizing and politicizing the FBI. He
- 10:24Speaker 2: was part of weaponizing and politicizing the Department of Justice.
- 10:28Speaker 2: And it was because they hated Donald Trump, and frankly,
- 10:33Speaker 2: they were angry at the American people for electing him
- 10:35Speaker 2: in twenty sixteen, and so the FBI set out to
- 10:40Speaker 2: try to attack and to try to ultimately remove from
- 10:43Speaker 2: office the President of the United States. Now, again this
- 10:48Speaker 2: should not bear saying, but it is not the job
- 10:52Speaker 2: of law enforcement to determine the will of the voters.
- 10:56Speaker 2: Is wrong, and the elected president should no longer be president.
- 11:00Speaker 2: That's what Comy presided over. And so when I listened
- 11:02Speaker 2: to him say I weep for the Department of Justice,
- 11:05Speaker 2: it really is. You know, there's a Yiddish word, hootspot.
- 11:09Speaker 2: And I got to say, James Comy really ought to
- 11:11Speaker 2: have a T shirt with that printed on it, because
- 11:15Speaker 2: he is grieving for the Department of Justice. Why because
- 11:18Speaker 2: he has been indicted for what I think is clearly
- 11:21Speaker 2: a felony. And we're going to break down in just minutes,
- 11:25Speaker 2: why exactly this is a felony, what the crime is,
- 11:28Speaker 2: And I want to point out Nowhere in his statement
- 11:32Speaker 2: does Comy get into the actual facts. Nowhere in the
- 11:35Speaker 2: statement does he get into what he did. Nowhere in
- 11:37Speaker 2: the statement does he get into law. He just gives
- 11:40Speaker 2: a political statement. He will not be on his knees.
- 11:43Speaker 2: He calls Trump a tyrant who is ruling by fear. Look,
- 11:47Speaker 2: this is an indictment that was returned by a grand
- 11:50Speaker 2: jury in the Commonwealth of Virginia, and it was returned
- 11:54Speaker 2: because of I believe clear evidence demonstrating Comy committed felonies.
- 12:00Speaker 1: Senator, I want to bring up a point that no
- 12:04Speaker 1: one in the media has brought up so far about
- 12:08Speaker 1: this indictment. And I brought it up on CNN and
- 12:11Speaker 1: they were like all deer in headlights, there is something
- 12:15Speaker 1: about this case. And they were saying, Oh, this is
- 12:17Speaker 1: just political retribution by Donald Trump that clearly they weren't
- 12:21Speaker 1: going to bring this case. He had to fire the
- 12:23Speaker 1: person in charge of this office in Virginia, had to
- 12:26Speaker 1: put in somebody that would weaponize the DOJ. Here's the
- 12:30Speaker 1: fact that most people don't know, James Comy's own son
- 12:35Speaker 1: in law was literally inside the prosecutor's office that was tasked.
- 12:42Speaker 1: Just think about this with indicting his father in law.
- 12:46Speaker 1: And so when you sit there and I look at this,
- 12:48Speaker 1: I'm like, man, the deep State got together to protect
- 12:50Speaker 1: James Comy at all costs. And as soon as the
- 12:54Speaker 1: indictment came out later in the day, James Comy's son
- 12:57Speaker 1: in law then gave his resign letter because I guess
- 13:01Speaker 1: he just couldn't stop what was inevitable.
- 13:03Speaker 2: Well, and look, I think what should govern this case
- 13:07Speaker 2: is the facts and the law. And I believe James
- 13:10Speaker 2: Commey should have been indicted five years ago. And indeed
- 13:13Speaker 2: I called upon him to be indicted five years ago.
- 13:15Speaker 2: So let me lay out the facts and in December
- 13:18Speaker 2: of twenty twenty. So the questioning that we played in
- 13:21Speaker 2: the first segment was for September thirtieth of twenty twenty.
- 13:24Speaker 2: And by the way, the reason the indictment was brought
- 13:27Speaker 2: right now is the statute limitations was going to run
- 13:29Speaker 2: next week, and so they had to bring it before
- 13:31Speaker 2: the end of the statute limitations or they would not
- 13:34Speaker 2: be able to charge him. But on December tenth of
- 13:37Speaker 2: twenty twenty, here's the letter that I sent to Bill Barr,
- 13:41Speaker 2: then the Attorney General of the United States, and Christopher Ray,
- 13:45Speaker 2: who was then the director of the FBI. Days before
- 13:49Speaker 2: the presidential election in twenty sixteen, a Wall Street Journal
- 13:53Speaker 2: article quoted an anonymous source confirming the existence of a
- 13:56Speaker 2: probe into Hillary Clinton's use of a private eas mail
- 14:00Speaker 2: server while serving as Secretary of State, an investigation that
- 14:04Speaker 2: up to that point mister Komy and the FBI declined
- 14:07Speaker 2: to confirm. We now know that this leak was authorized
- 14:12Speaker 2: by then Deputy Director of the FBI Andrew McCabe. Mister
- 14:16Speaker 2: McCabe initially told FBI agents under oath that he did
- 14:20Speaker 2: not authorize the leak and he did not know who did,
- 14:24Speaker 2: but when confronted later with contrary evidence, he confessed both
- 14:28Speaker 2: to knowing about and authorizing the leak. We do not know, however,
- 14:34Speaker 2: whether and to what extent then FBI Director Comy was
- 14:39Speaker 2: aware of and authorized this leak. After the fact, mister
- 14:42Speaker 2: McCabe has repeatedly stated that mister Komy knew of and
- 14:47Speaker 2: effectively authorized the leak by approving it. He told the
- 14:51Speaker 2: Office of Inspector General that quote. He and Komy discussed
- 14:55Speaker 2: the October thirtieth Wall Street Journal article in person on
- 14:59Speaker 2: October thirty five, Verse twenty sixteen, and that at that meeting,
- 15:03Speaker 2: quote he told Comy that he had authorized ad slash
- 15:08Speaker 2: OPA and Special Council to disclose the account of the
- 15:12Speaker 2: August twelfth call and did not say anything in any
- 15:16Speaker 2: way to suggest that it was unauthorized. According to mister McCabe,
- 15:21Speaker 2: mister Comby quote did not react negatively, just kind of
- 15:25Speaker 2: accepted it and quote thought it was a good idea
- 15:30Speaker 2: that they presented this information to the media. He again
- 15:35Speaker 2: reiterated mister Comy's involvement at a hearing last month at
- 15:38Speaker 2: the Senate Judiciary Committee. I asked mister McCabe. According to
- 15:42Speaker 2: The Washington Times April eighteenth, twenty eighteen, mister McCabe insisted
- 15:48Speaker 2: that he told his boss that he had authorized disclosure
- 15:51Speaker 2: about the Clinton investigation. But mister Comy has denied this claim,
- 15:56Speaker 2: and mister McCabe told investigators that mister Comby knew he
- 15:59Speaker 2: had authorized disclosure and agreed it was a good idea.
- 16:03Speaker 2: Is that accurate? Is that your testimony to this committee?
- 16:08Speaker 2: Mister McCabe replied, that is my recollection. Mister Komy, however,
- 16:14Speaker 2: has sworn under oath that he has neither authorized the
- 16:18Speaker 2: leak nor knew of mister McCabe's involvement. At a May
- 16:21Speaker 2: twenty seventeenth hearing before the Senate Judiciary Committee, Senator Grassley asked,
- 16:26Speaker 2: mister Comy, have you ever been an anonymous source in
- 16:30Speaker 2: news reports about matters relating to the Trump investigation or
- 16:33Speaker 2: the Clinton investigation. Mister Komy replied never. Senator Grassley then asked,
- 16:41Speaker 2: have you ever authorized someone else at the FBI to
- 16:44Speaker 2: be an anonymous source in news reports about the Trump
- 16:47Speaker 2: investigation or the Clinton administration? He testified no. And this
- 16:54Speaker 2: October that a Senate Judiciary Committee hearing, mister Komy testified
- 16:58Speaker 2: in response to my question, quote, I stand by the
- 17:02Speaker 2: testimony that you summarized that I gave in May of
- 17:05Speaker 2: twenty seventeen. Mister Komy's denial in front of the Senate
- 17:09Speaker 2: is consistent with his statement to the OIG. He told
- 17:13Speaker 2: the OIG that quote, he recalled seeing this article, but
- 17:17Speaker 2: he did not know how the disclosure about the paidag
- 17:20Speaker 2: call in the October thirtieth article happened. He said that
- 17:24Speaker 2: he was quote very concerned about that part of the article.
- 17:29Speaker 2: Komy told OIG he considered the disclosure about the paidag's
- 17:32Speaker 2: call problematic because it related the sensitive FBI information. The
- 17:38Speaker 2: OIG report continues, quote according to Komy, he discussed the
- 17:43Speaker 2: issue with McCabe after the article was published, and at
- 17:46Speaker 2: the time mccab quote definitely did not tell me that
- 17:51Speaker 2: he authorized the disclosure of the paidag call. Komy said
- 17:55Speaker 2: that McCabe gave him the exact opposite impression. Mister Comy
- 18:00Speaker 2: asserted that he took from whatever communication they had that
- 18:03Speaker 2: mister mccab wasn't involved in the leak. And here's what's critical,
- 18:09Speaker 2: mister Comy and mister mccab's statements are irreconcilably contradictory. Mister
- 18:15Speaker 2: McCabe says that he told mister Comy of the leak
- 18:18Speaker 2: and that mister Comy approved effectively authorizing the leak after
- 18:22Speaker 2: the fact. Mister Comy, on the other hand, has said
- 18:25Speaker 2: that he neither authorized the leak nor knew of mister
- 18:28Speaker 2: McCabe's involvement. One of them is lying under oath a
- 18:33Speaker 2: Federal crime eighteen USC. Section sixteen twenty one. The American
- 18:39Speaker 2: people deserve to know who those are the facts and
- 18:44Speaker 2: it is a simple binary choice. Either James Comy lied
- 18:49Speaker 2: under oath and committed to felony or Andrew McCabe lied
- 18:53Speaker 2: under oath or committed to felony, because what they said
- 18:56Speaker 2: is precisely opposite. There is not a world in which
- 18:58Speaker 2: neither of them committed a felon And the only choice
- 19:01Speaker 2: is which one broke the law by bringing this indictment. Obviously,
- 19:06Speaker 2: the Department of Justice has determined it was James Comey
- 19:10Speaker 2: who lied under oath and broke the law, and that's
- 19:13Speaker 2: what the trial will be all about.
- 19:15Speaker 1: You've got a lot of choices for cell phone service,
- 19:17Speaker 1: with new ones popping up all the time. But here's
- 19:20Speaker 1: the truth. There's only one that stands boldly in the
- 19:22Speaker 1: gap for every American that believes that freedom is worth
- 19:27Speaker 1: fighting for, and that's Patriot Mobile. And every time if
- 19:30Speaker 1: you're a member of Patriot Mobile, you make a phone call,
- 19:33Speaker 1: you send a text, you pay your bill, you're making
- 19:36Speaker 1: a difference setting up for what you and I believe in,
- 19:39Speaker 1: because Patriot Mobile takes about five percent of your bill
- 19:42Speaker 1: each and every month, and they give it back to

- 21:00Speaker 1: what I've been hearing on online from the media. They're like, hey,
- 21:05Speaker 1: Donald Trump, weighed in on this too much. They're gonna
- 21:07Speaker 1: get this thing kicked out before it even goes to
- 21:09Speaker 1: a judge. This is a waste of the American taxpayer's dollars.
- 21:13Speaker 1: And then if that's not enough, they say, well, no
- 21:16Speaker 1: one ever gets indicted and they actually go forward and
- 21:19Speaker 1: get a conviction on someone lining to Congress because well,
- 21:22Speaker 1: a lot of people lie to Congress, and even if
- 21:23Speaker 1: you did lie, it may have been a mistake. It's
- 21:25Speaker 1: gonna be very hard to get a conviction. Break down
- 21:28Speaker 1: how this could roll out in court, what could happen.
- 21:32Speaker 2: Well, at the end of the day, the factual predicate
- 21:34Speaker 2: behind this crime is not terribly complicated. As I mentioned,
- 21:38Speaker 2: there's a direct contradiction between James Comey's testimony under oath
- 21:43Speaker 2: before the Senate and Andrew McCabe's testimony under oath before
- 21:47Speaker 2: the Senate. They cannot both be true. One or the
- 21:51Speaker 2: other is deliberately lying, And how do we know which
- 21:54Speaker 2: one is likely to be lying? Well, the FBI, in
- 21:58Speaker 2: all likelihood possesses the information that confirms who's telling the
- 22:02Speaker 2: truth and who's lying. Indeed, if you look at the
- 22:06Speaker 2: account of what occurred, mccab initially told the same lie
- 22:11Speaker 2: that Comy did. Mcab initially said he didn't leak the information,
- 22:16Speaker 2: he didn't authorize it, and he didn't know who did.
- 22:18Speaker 2: But then the FBI Office of Inspector General confronted him
- 22:24Speaker 2: with contrary evidence. I don't know what the contrary evidence is,
- 22:27Speaker 2: but they put in front of him, mister McCabe, you
- 22:30Speaker 2: said you didn't leak this information. Well, boom, here's the
- 22:33Speaker 2: evidence to the contrary And what did McCabe do. Oh crap,
- 22:36Speaker 2: you got me?
- 22:36Speaker 3: Okay, you're right.
- 22:38Speaker 2: I leaked it. I'm the one who did it, and
- 22:41Speaker 2: I talked to Comy about it. I told him about it.
- 22:44Speaker 2: So he admitted that when he was caught in a lie.
- 22:47Speaker 2: I don't know specifically what confirming evidence the FBI in
- 22:53Speaker 2: the Department of Justice has, but they have enough that
- 22:56Speaker 2: they caused McCabe to reverse his first lie and instead
- 23:01Speaker 2: to say, yes, he did it, and Comy knew about it,
- 23:04Speaker 2: and so between the two, you know, it was interesting.
- 23:07Speaker 2: When I was questioning Comy, he said a couple of times. Well,
- 23:11Speaker 2: I'm not going to characterize, as he put it, Andy's testimony. Well,
- 23:15Speaker 2: I get politically that's a smart move not to characterize
- 23:18Speaker 2: Andy's testimony. But you know what, his entire legal defense
- 23:22Speaker 2: is going to be, McCabe is lying because he doesn't
- 23:24Speaker 2: have an alternative. That's his only argument is when McCabe
- 23:28Speaker 2: said under oath, good point that I knew about it.
- 23:32Speaker 2: Comy's defense team is going to have to say McCabe
- 23:35Speaker 2: was lying. And by the way, mccab is going to
- 23:36Speaker 2: be the star witness at the prosecution. The prosecution is
- 23:41Speaker 2: going to put Andy McCabe on the stand and he's
- 23:44Speaker 2: going to ask them, did you leak it? Now, I'm
- 23:48Speaker 2: going to predict Andy McCabe is going to say, yes,
- 23:52Speaker 2: did you talk to James Comy about it? Yes? Did
- 23:55Speaker 2: he authorize it? Yes? And the reason I'm going to
- 23:58Speaker 2: predict he's gonna do all of that that is because
- 24:00Speaker 2: Andy McCabe testified to that in front of Congress, and
- 24:04Speaker 2: if he gives any other answer, he'll be indicted for
- 24:07Speaker 2: lying to Congress. So he can't have it both ways.
- 24:12Speaker 2: And I expect that Comy's lawyer will try to cross
- 24:16Speaker 2: examine him and we'll try to argue McCabe is lying,
- 24:20Speaker 2: but it's very difficult to see why McCabe would have
- 24:22Speaker 2: any incentive to lie. He and Comy were Thicke as thieves.
- 24:27Speaker 2: He was only forced to admit the truth when confronted
- 24:32Speaker 2: with contrary evidence. Again, we don't know what that evidence is,
- 24:35Speaker 2: but presumably the FBI and the Department of Justice do so.
- 24:38Speaker 2: I don't know if it is contemporaneous phone calls, perhaps
- 24:42Speaker 2: with the reporters. I don't know if it is notes.
- 24:44Speaker 2: I don't know if it's emails. I don't know if
- 24:46Speaker 2: it's testimony from someone else at the FBI who said, hey,
- 24:50Speaker 2: Andrew McCabe told me to do this. But it is something,
- 24:54Speaker 2: and it was something that was compelling enough that it
- 24:57Speaker 2: caused Andrew McCabe to aban then lie number one, and
- 25:02Speaker 2: and so at the end of the day, this is
- 25:05Speaker 2: not a complicated factual case. This is not some grand tapestry.
- 25:10Speaker 2: It's a he said, he said, she said. But you
- 25:15Speaker 2: have both testimonies under oath, and it's going to be
- 25:18Speaker 2: a question of what additional evidence is there to confirm
- 25:21Speaker 2: who's telling the truth and who's not. I also think
- 25:24Speaker 2: I will be surprised if James Comy's lawyer puts him
- 25:29Speaker 2: on the stand. Now, under our justice system, the prosecution
- 25:34Speaker 2: cannot force a defendant to testify. But I'm going to
- 25:38Speaker 2: predict James Comy is not going to take the stand
- 25:42Speaker 2: because if he takes the stand, he can be cross examined,
- 25:45Speaker 2: and he does not want to be cross examined, because
- 25:48Speaker 2: this is someone who presided over weaponizing the Department of
- 25:54Speaker 2: Justice with the objective of taking out Donald J. Trump
- 25:58Speaker 2: and getting under oath, getting cross examined by a skilled
- 26:01Speaker 2: trial attorney, and again under oath. By the way, if
- 26:04Speaker 2: he lies in his trial testimony, he can be indicted
- 26:06Speaker 2: and prosecuted again for lying under oath. Again, I don't
- 26:10Speaker 2: think his lawyer will do that. And so at the
- 26:14Speaker 2: end of the day, look, the press is going to
- 26:16Speaker 2: go on and on and say, well, Trump hates James Comy.
- 26:19Speaker 2: That is certainly true, But being hated by the President
- 26:22Speaker 2: is not enough to exonerate you from criminal conduct. And
- 26:25Speaker 2: in this instance, I believe Comy should have been indicted
- 26:29Speaker 2: five years ago because it was clear he had deliberately
- 26:33Speaker 2: lied to Congress. And look, we started by playing my
- 26:37Speaker 2: cross examination. This wasn't an absent minded lie. This wasn't oh,
- 26:42Speaker 2: I'm not paying attention. This was careful, This was deliberate,
- 26:47Speaker 2: This was strategic, this was planned. I believe this was
- 26:50Speaker 2: James Comy saying, I face no accountability whatsoever. I can
- 26:54Speaker 2: lie under oath and no one's going to hold me
- 26:56Speaker 2: to account. And I think he feels he feels it's clever,
- 27:00Speaker 2: but he also feels vindicated. Listen, James Comy was someone
- 27:05Speaker 2: who I think fancied himself as j Edgar Hoover. He
- 27:09Speaker 2: fancied himself as as an incredibly powerful director of the FBI,
- 27:15Speaker 2: empowered to remove the tyrant. That's what he said in
- 27:19Speaker 2: his statement tonight that he thinks Trump is a tyrant.
- 27:23Speaker 2: And I think when the American people elected him in
- 27:25Speaker 2: twenty sixteen, I think Comy was angry and he decided
- 27:30Speaker 2: he would use the power of the FBI to remove
- 27:32Speaker 2: the president elected by the people. And so I think
- 27:36Speaker 2: it is quite fitting that he is facing accountability for
- 27:40Speaker 2: committing criminal conduct. Let me repeat, this indictment is not
- 27:45Speaker 2: for being an opponent of Donald Trump. It is not
- 27:47Speaker 2: for being a political a political figure on the other
- 27:52Speaker 2: side of Donald Trump. This indictment is for deliberately and
- 27:56Speaker 2: knowingly lying under oath to the United States Senate, which
- 27:59Speaker 2: is a clear an unmistakable felony. And and I think
- 28:03Speaker 2: I think Comy, I think the odds are good that
- 28:07Speaker 2: Comy will be convicted. And I think if he's convicted,
- 28:10Speaker 2: I think he's going to serve jail time.
- 28:12Speaker 1: How much of very quickly, of his past will come
- 28:16Speaker 1: back to haunt him. He is a prolific guy when
- 28:19Speaker 1: it comes to leaking. He's a pro at it. He's
- 28:21Speaker 1: on amateur because he knows how to leak. Hell, he
- 28:23Speaker 1: leaked information that was apparently classified to make sure that
- 28:26Speaker 1: there was a special counsel that went after Donald Trump.
- 28:30Speaker 1: We know that for a fact. And it went to
- 28:32Speaker 1: one of his former law friends at a university that
- 28:35Speaker 1: then went to a newspaper. That is a fact. Will
- 28:38Speaker 1: that come up? And then the other question I have
- 28:40Speaker 1: for you quickly is this, will the testimony that he
- 28:43Speaker 1: gay before Congress be used in court or literally will
- 28:46Speaker 1: senators that interviewed him, would you guys go to court
- 28:49Speaker 1: or would they just use the testimony video?
- 28:51Speaker 2: Yeah, I think they would use the testimony. They would
- 28:53Speaker 2: read or play the testimony. I don't think you're going
- 28:56Speaker 2: to see senators testifying, and the record is clear in
- 28:59Speaker 2: the objective and so everyone knows exactly what his testimony was.
- 29:04Speaker 2: In terms of his past pattern, I think it could
- 29:06Speaker 2: certainly come in. The prosecution might try to bring it
- 29:10Speaker 2: in to establish a pattern. That would be difficult. But
- 29:13Speaker 2: I think if Comy's lawyer argues, well, he couldn't possibly
- 29:17Speaker 2: have approved this, he never would have approved a leak,
- 29:20Speaker 2: then I think the prosecution would be able to get
- 29:22Speaker 2: all of that in as rebuttal to the defendant's argument.
- 29:26Speaker 2: So I think it's more likely to come in as
- 29:28Speaker 2: rebuttal evidence than directly proving a pattern. But my guess
- 29:33Speaker 2: is one way or another that evidence is going to
- 29:35Speaker 2: come in, And you're right, there's a clear pattern. Comy
- 29:37Speaker 2: has a long pattern of relying on media leaks to
- 29:40Speaker 2: advance his own personal agenda.
- 29:43Speaker 1: Do you have a dog, if you've got one like
- 29:45Speaker 1: I do, My dog is twelve and a half. His
- 29:46Speaker 1: name is Memphis, and there's nothing worse than watching your
- 29:50Speaker 1: dog age. We're having to coach him off the couch,
- 29:53Speaker 1: We're having to help pick him up to get him
- 29:54Speaker 1: on the couch. And then I was told about rough Greens.
- 29:58Speaker 1: It literally has added the spunk back to Memphis life.
- 30:02Speaker 1: And it supports long term health by providing live, bioavailable

- 30:36Speaker 1: It is literally you sprinkle it on your dog's food,

- 31:17Speaker 1: Dallas when this shooting happened. It was eight hours after
- 31:22Speaker 1: we watched Gavin Newsom go on on late night TV
- 31:27Speaker 1: demonizing ICE agents, saying that they are authoritarian. And then
- 31:31Speaker 1: the liberals are like, wait, wait, we're not attacking ICE agents.
- 31:35Speaker 1: Yes they are. They've undermined them, they've demonized them, and
- 31:38Speaker 1: we were watching attack after attack happen against ICE agents.
- 31:41Speaker 1: It's horrific.
- 31:43Speaker 2: Yeah, I was in Dallas this week for a series
- 31:47Speaker 2: of unrelated meetings and the news broke that this strange
- 31:51Speaker 2: gunman had opened fire on an ICE facility in Dallas.
- 31:54Speaker 2: That he had gone onto a rooftop emulating Charlie Kirk's
- 31:58Speaker 2: assassin and with a bolt action rifle, fired multiple rounds,
- 32:03Speaker 2: ended up killing two people severely injuring a third, and
- 32:06Speaker 2: then then he took the gun to himself and took
- 32:09Speaker 2: his own life. And it was horrific. When the news broke,
- 32:12Speaker 2: I canceled my morning meeting and just drove over to
- 32:15Speaker 2: the ICE facility that morning. Was there, was there shortly
- 32:19Speaker 2: after the shooting had occurred. And this has happened far
- 32:23Speaker 2: too often. Here's what I had to say at the
- 32:27Speaker 2: press conference that was ongoing when I arrived at the facility.
- 32:31Speaker 3: If this needs to stop.
- 32:34Speaker 2: Violence is wrong, Politically motivated violence is wrong. It was
- 32:41Speaker 2: two weeks ago today that we saw political assassination in
- 32:44Speaker 2: Utah that tore the heart out of much of this country.
- 32:50Speaker 2: This is the third shooting in Texas directed at ICE
- 32:54Speaker 2: or CBP. This must stop. To every politician who is
- 33:03Speaker 2: using rhetoric demonizing ICE and demonizing CBP, stop to every
- 33:11Speaker 2: politician demanding that ICE agents be dosed and calling for
- 33:15Speaker 2: people to go after their families.
- 33:17Speaker 3: Stop.
- 33:19Speaker 2: This has very real consequences. Look in America, we disagree.
- 33:24Speaker 2: That's fine, that's the democratic process. But your political opponents
- 33:28Speaker 2: are not Nazis. We need to learn to work together
- 33:33Speaker 2: without demonizing each other, without attacking each other. And I
- 33:37Speaker 2: want to say thank you. I want to say thank
- 33:40Speaker 2: you to the brave men and women of law enforcement.
- 33:42Speaker 2: I want to say thank you to the brave men
- 33:44Speaker 2: and women of ICE and CVP and everyone who puts
- 33:48Speaker 2: their lives on the lines to keep us safe. The
- 33:54Speaker 2: divisive rhetoric tragically has real consequences. I hope that every
- 34:00Speaker 2: one of us will I hope that every one of
- 34:02Speaker 2: us will pray Number one for the safety of law
- 34:08Speaker 2: enforcement that are risking their lives to keep us safe.
- 34:11Speaker 2: Number two, for the health of those who were shot
- 34:15Speaker 2: and injured. Today we still don't know the full details
- 34:18Speaker 2: of who was injured, but for the families also of
- 34:21Speaker 2: the victims of this shooting. Violence has no place. It
- 34:25Speaker 2: is wrong, and we should come together. If we want
- 34:29Speaker 2: to have a debate of an immigration policies, we can
- 34:32Speaker 2: do so in the halls of Congress without demonizing each other,
- 34:36Speaker 2: and especially without demonizing the men and women who every
- 34:40Speaker 2: day put on a badge and go risk their lives
- 34:43Speaker 2: to keep us safe. And we should not be putting
- 34:47Speaker 2: language out there that inspires mad men to commit evil crimes.
- 34:55Speaker 2: Our prayers are with the men and women of law enforcement,
- 34:58Speaker 2: and we ought to come together and have some decency
- 35:00Speaker 2: across the political aisle to say this violence is wrong and.
- 35:06Speaker 3: It needs to stop.
- 35:08Speaker 1: We know Senator a lot about this gunman. We know
- 35:11Speaker 1: that he was googling the shooting of our friend whose
- 35:16Speaker 1: funeral we just went to, Charlie Kirk. We know that
- 35:19Speaker 1: he was looking at the app that they put out
- 35:23Speaker 1: there and these websites where you can track ICE agents
- 35:27Speaker 1: which is accent where they are.
- 35:30Speaker 2: That is an app designed to encourage violence against ICE
- 35:34Speaker 2: agents and law enforcement. And whether it's Gavin Newsom or
- 35:37Speaker 2: a Keen Jeffries or any any other Democrat who is
- 35:41Speaker 2: encouraging this targeting of ICE agents, it is fundamentally wrong
- 35:46Speaker 2: and that they need to stand up and stop it.
- 35:49Speaker 2: You know, I will say this shooter, it's the news
- 35:52Speaker 2: has since come out. This shooter. His mother was a
- 35:55Speaker 2: hard leftist who actually had been vocally critical of me
- 35:59Speaker 2: and other Texas Republicans for not embracing gun control, and
- 36:02Speaker 2: in fact, in May of twenty twenty two, she posted
- 36:05Speaker 2: the following Governor Abbot, Senator Cornyn, and Senator Cruz, how
- 36:09Speaker 2: does it feel that your action to open up gun
- 36:12Speaker 2: laws is responsible for the killing of twenty one more people?
- 36:15Speaker 2: Do you secretly sit in front of a TV and
- 36:17Speaker 2: smile with a demented smile. You must be proud of
- 36:21Speaker 2: all the money that sits in your bank accounts from
- 36:23Speaker 2: the gun lobby support. Was it worth it? Governor Abbot?
- 36:26Speaker 2: How about you senators? When you prioritize money over people,
- 36:30Speaker 2: this is what you get And I will say the
- 36:33Speaker 2: irony is rich that this leftist mom who was championing
- 36:38Speaker 2: gun control now her son has committed a mass murder
- 36:42Speaker 2: as a sniper. It is tragic, and it is a
- 36:45Speaker 2: consequence of extreme rhetoric, extreme ideology that is poisoning the
- 36:51Speaker 2: minds of those who are driven to violence. And I
- 36:56Speaker 2: will say this assassin wrote on his shell casings anti Ice,
- 37:03Speaker 2: very much, emulating what Charlie Kirk's murderer did, writing pro
- 37:07Speaker 2: Antifa and pro transgender propaganda on his shell casings. And
- 37:13Speaker 2: we need to stop this violence, regardless of where your
- 37:17Speaker 2: politics are, but we need to stop the rhetoric that
- 37:19Speaker 2: is fueling this violence. And there's a lot of Democrat
- 37:22Speaker 2: politicians engaging in this rhetoric, no matter how many lives
- 37:26Speaker 2: are lost. And I want to be clear, I am
- 37:29Speaker 2: not calling them Nazis. I am absolutely opposing any violence
- 37:34Speaker 2: or calls to violence. I'm calling on them to tone
- 37:38Speaker 2: down their rhetoric and stop demonizing their opponent, stop demonizing Ice,
- 37:42Speaker 2: stop demonizing law enforcement, because it's dangerous and tragically. Lunatics
- 37:48Speaker 2: are acting on the rhetoric they're hearing from these politicians.
- 37:51Speaker 1: No doubt about it. Don't forget. We do this show Monday,
