- 0:00Speaker 1: Donald Trump says he's gonna be arrested this out of
- 0:04Speaker 1: New York. Why because they're saying he miscategorized a payment
- 0:10Speaker 1: to Stormy Daniels. What's crazy is this is exactly what
- 0:15Speaker 1: Hillary Clinton actually did and was She was never you know,
- 0:20Speaker 1: convicted of anything, never charged with anything. In fact, Clinton
- 0:24Speaker 1: was just fine for doing the same thing. And she
- 0:26Speaker 1: also could have actually been indicted by the same loke
- 0:30Speaker 1: activist George Soros DA. The Manhattan District Attorney Alvin Bragg
- 0:36Speaker 1: is essentially using the same legal theory which is totally
- 0:41Speaker 1: out of bounds to potentially indict former President Donald Trump
- 0:46Speaker 1: that Hillary Clinton's campaign was fined for. That is what
- 0:50Speaker 1: the former United's attorney, Brett Tolman argued. Tollman asserted that
- 0:56Speaker 1: Bragg's legal theory that Trump tried to hide a campaign
- 0:59Speaker 1: expended You're by using his then lawyer Michael Cohen to
- 1:05Speaker 1: pay porn actress Stormy Daniels one hundred and thirty thousand
- 1:08Speaker 1: dollars and alleged hush money before the two sixteen presidential
- 1:12Speaker 1: election would have applied to Clinton when her campaign hit
- 1:16Speaker 1: a payment for the phony Russian dossier against Donald Trump,
- 1:19Speaker 1: and they categorize it as legal fees. Former New York
- 1:24Speaker 1: City police officer and conservative pundit John Cardillo also tweeted
- 1:30Speaker 1: this out. Bill Clinton paid Paula Jones eight hundred and
- 1:33Speaker 1: fifty thousand, and no one cared Toleman tweet in response,
- 1:38Speaker 1: and the Hillary Clinton was actually fine for hiding the
- 1:41Speaker 1: Still dossier payment under legal fees, essentially the same legal
- 1:44Speaker 1: theory on the Stormy Daniels payment. The DA is running
- 1:48Speaker 1: criminal investigation of Trump on that should tell you everything
- 1:53Speaker 1: you need to know. Indeed, the Federal Election Commission in
- 1:56Speaker 1: March of twenty twenty two did in fact fine Larry
- 2:00Speaker 1: Clinton all the way back in twenty sixteen, and that
- 2:03Speaker 1: for that presidential campaign, as well as the Democratic National
- 2:07Speaker 1: Committee for not properly disclosing payments for the so called
- 2:12Speaker 1: Dolcier Still dossier that the DOJ and the FBI relied
- 2:16Speaker 1: on to investigate Trump for alleged Russian collusion. It was
- 2:20Speaker 1: a hoax the entire time. Now campaigns just so you know,
- 2:24Speaker 1: we're supposed to report expenses over two hundred dollars and
- 2:28Speaker 1: disclose the purpose of the expense. Where the Clinton campaign
- 2:32Speaker 1: do well, they knew that they couldn't actually tell America
- 2:36Speaker 1: that they were paying for the dossier, so instead, the
- 2:39Speaker 1: Clinton campaign and the Democratic National Committee funneled their payments
- 2:44Speaker 1: for the dossier, totaling more than a million dollars through
- 2:47Speaker 1: the Democratic law firm Perkins Coy. According to the FEC,
- 2:53Speaker 1: Perkins Coy paid opposition research firm Fusion Gps more than
- 2:57Speaker 1: a million dollars in twenty sixteen for the Steel dossier.
- 3:01Speaker 1: Perkins Coy was then paid one hundred and seventy five
- 3:05Speaker 1: thousand by the Clinton campaign and about eight hundred and
- 3:09Speaker 1: fifty thousand was also paid by the Democratic National Committee
- 3:12Speaker 1: in July and August of twenty sixteen, around the same
- 3:16Speaker 1: exact time that the FBI claimed they opened their investigation
- 3:20Speaker 1: on the Trump campaign. Remember they spied on Donald Trump
- 3:23Speaker 1: and Donald Trump's campaign. The payments were not disclosed until Caspetel,
- 3:29Speaker 1: lead investigator for the then House Intelligence Committee Chairman Devin Unions,
- 3:34Speaker 1: uncovered these payments. That is when the FEC fined the
- 3:38Speaker 1: Clinton campaign a measly eight grand and the DNC one
- 3:43Speaker 1: hundred and five grand nuts chump change, just so you know,
- 3:46Speaker 1: for those two entities for reporting the payments as legal
- 3:50Speaker 1: services and legal and compliance consulting instead of as opposition research.
- 3:57Speaker 1: The FEC sidness statement. George Washington University law professor and
- 4:03Speaker 1: criminal defense attorney Jonathan Turley also noted in a recent
- 4:06Speaker 1: column on the potential indictment against Trump that the Hillary
- 4:10Speaker 1: Clinton faced a not dissimilar campaign finance allegations, saying last
- 4:16Speaker 1: year the Federal Election Commission find the Clinton campaign years
- 4:20Speaker 1: later for funding the Still dossier's a legal expense. The
- 4:23Speaker 1: campaign had previously denied funding the dossier, by the way,
- 4:26Speaker 1: which was used to push false Russian collision claims against
- 4:30Speaker 1: Donald Trump in twenty sixteen, and it buried the funding
- 4:34Speaker 1: in the campaign's legal budget. Yet there was no cry
- 4:40Speaker 1: for this type of prosecution, this type of prosecution in Washington,
- 4:45Speaker 1: DC or New York. So why is it happening now?
- 4:49Speaker 1: Because the dissert attorney Bragg is obsessed with bringing charges
- 4:54Speaker 1: against Trump for federal violations. That's what he's obsessed with,
- 5:00Speaker 1: all right. Before I get into more of that, I
- 5:02Speaker 1: want to talk to you about Patriot Mobile. They are

- 5:36Speaker 1: carriers four free. Yeah. Patriot Mobile, America's only Christian conservative

- 6:29Speaker 1: Now there's another part of this And the question is
- 6:33Speaker 1: could this backfire? Could this be a huge backfire on
- 6:38Speaker 1: the left for them clearly overstepping and going after Donald
- 6:42Speaker 1: Trump to try to get a mug shot. Will it
- 6:44Speaker 1: make people want to vote for Donald Trump even more
- 6:46Speaker 1: on the right if they actually do this, I would
- 6:49Speaker 1: argue yes. I want you to hear what Donald Trump
- 6:52Speaker 1: had to say about his possible arrest and a video
- 6:55Speaker 1: that he released. These four horrible radical left democratic investigations
- 7:01Speaker 1: of your all time favorite president me is just a
- 7:05Speaker 1: continuation of the most disgusting witch hunt in the history
- 7:09Speaker 1: of our country. It's gone on forever with the Russia, Russia,
- 7:12Speaker 1: Russia and Ukraine, Ukraine, Ukraine and the Mueller hooks. It's
- 7:17Speaker 1: an absolute disgrace. What's going on. They even spied on
- 7:21Speaker 1: my campaign, and remember this, with all of the work
- 7:26Speaker 1: that they did on Muller. No collusion, That's what the
- 7:30Speaker 1: answer was, was all no collusion. Whether it's the Marlago
- 7:34Speaker 1: raid or the Unselect Committee hoax, the perfect Georgia phone call,
- 7:39Speaker 1: it was absolutely perfect, or the Stormy horse Face Daniels
- 7:45Speaker 1: extortion plot, they're all sick and it's fake news. Our
- 7:50Speaker 1: enemies are desperate to stop us because they know that
- 7:54Speaker 1: we are the only ones who can stop them, and
- 7:56Speaker 1: they know it very strongly. And they're looking at the
- 7:59Speaker 1: poles where not me, but we are up by so
- 8:03Speaker 1: much they can't even believe it. We won twice and
- 8:06Speaker 1: now we've got to win a third time. They know
- 8:08Speaker 1: that we can defeat them, they know that we will
- 8:11Speaker 1: defeat them. But they're not coming after me. They're coming
- 8:15Speaker 1: after you. I'm just standing in their way, and I
- 8:19Speaker 1: always will stand in their way, Thank you very much.
- 8:23Speaker 1: Donald Trump putting out that official campaign video rallying the troops,
- 8:28Speaker 1: saying we've won twice. We're gonna win again. Now the
- 8:31Speaker 1: question is if they do indict Donald Trump, and there's
- 8:34Speaker 1: a very good chance this activist DA who is supported
- 8:37Speaker 1: and backed by George Soros, does this, will this be
- 8:40Speaker 1: an all time massive backfire. I would argue yes, there's
- 8:45Speaker 1: a lot of Americans that they see a former president
- 8:49Speaker 1: in handcuffs, or see a former president getting a mug shot. Look,
- 8:53Speaker 1: there's no doubt the left is going to celebrate this. Right,
- 8:55Speaker 1: They're gonna love it. They're gonna they're gonna be like
- 8:58Speaker 1: taking a victory lap. What they may not understand is
- 9:01Speaker 1: this may actually help Donald Trump more than anything else
- 9:03Speaker 1: they've ever done, because there's a certain point where there
- 9:06Speaker 1: are people in this country they're gonna say, you don't.
- 9:08Speaker 1: You don't actually go out there and take and take
- 9:12Speaker 1: mug shots and arrest former presence just because you don't
- 9:16Speaker 1: like them politically. That's not what America is supposed to
- 9:19Speaker 1: be about, especially on these ridiculous charges. Now, there is
- 9:24Speaker 1: a chance, I want to be clear, there's a chance
- 9:27Speaker 1: that you could find a really woke jury in New
- 9:32Speaker 1: York that could convict. Then there would be an appeal,
- 9:36Speaker 1: you would assume, and if you went outside of that area,
- 9:38Speaker 1: is there a chance that it could be overturned. Of
- 9:41Speaker 1: course that could happen. But people are gonna see this
- 9:45Speaker 1: for what it is. They are gonna see this as
- 9:47Speaker 1: a clear and decisive move by the left to try
- 9:54Speaker 1: to put Donald Trump in jail because he's their political opponent.
- 9:57Speaker 1: There's no other reason. That's all all it is. This
- 10:01Speaker 1: is trying to destroy a political opponent. They want to
- 10:06Speaker 1: take down Donald Trump. They've been trying, as he described it,
- 10:12Speaker 1: four different times. Is the fourth time now that they
- 10:14Speaker 1: have tried to take him down? Will it work this time? Well,
- 10:19Speaker 1: it's New York City. It's an activist. DA. I think
- 10:22Speaker 1: there's a very good chance that there will in fact
- 10:24Speaker 1: be a mugshot. They were trying to take down Donald Trump.
- 10:27Speaker 1: Don't forget with the rate of Marlago and that went
- 10:29Speaker 1: off the rails. And the only reason why it went
- 10:32Speaker 1: off the rail is because our President of the United
- 10:35Speaker 1: States America, Joe Biden, being an idiot, did something incredibly stupid.
- 10:40Speaker 1: He kept classified documents for up to forty plus years
- 10:44Speaker 1: of his time in office, dating back to when he
- 10:47Speaker 1: was a senator early on his career. And the other
- 10:51Speaker 1: thing that we have to talk about is how the
- 10:53Speaker 1: media is covering this, MYO, may are they excited? I mean,
- 10:56Speaker 1: this is like a political wet dream for the left.
- 10:59Speaker 1: Donald Trump up and handcuffs, Donald Trump getting ah a
- 11:04Speaker 1: mug shot? This would be amazing. But isn't it an
- 11:06Speaker 1: abuse to power? Yes? Is this totally out of a
- 11:11Speaker 1: left field? Yes? Is this being done by a George
- 11:14Speaker 1: Soros activist? Da? Yes? Is this the politicalization of the
- 11:17Speaker 1: criminal justice system? Yes. Jonathan Turley made that point on
- 11:21Speaker 1: Fox Take a Listen. One of the other things you
- 11:23Speaker 1: point out in this op ed is that Hillary Clinton's
- 11:25Speaker 1: campaign was fined for secretly funding the Steel dossier, which
- 11:29Speaker 1: of course was used to damage Trump with these allegations
- 11:31Speaker 1: of Russian collusion, but there was no prosecution there. So
- 11:34Speaker 1: if Trump is arrested charged, could that give credence, you know,
- 11:38Speaker 1: to concerns that the law is used against some but
- 11:41Speaker 1: not others, that you know, prosecutorial discretions being abused. You know,
- 11:47Speaker 1: of all of the cases that are now threatening Donald Trump,
- 11:51Speaker 1: this is the one he would probably hope would come first.
- 11:55Speaker 1: I mean, this is a case that many of us
- 11:58Speaker 1: find just thoroughly proper and fundamentally weak. So if he
- 12:03Speaker 1: wants to perfect that narrative of the weaponization of the
- 12:07Speaker 1: criminal justice system, Bragg just gave him the perfect case
- 12:11Speaker 1: to do it with. So I think that the timing
- 12:15Speaker 1: here is telling. It has a lot more to do
- 12:18Speaker 1: about Bragg, I think, than Trump. He's being really sort
- 12:23Speaker 1: of hit by all sides. Ironically, he's being accused of
- 12:27Speaker 1: not being aggressive and enforcing laws involving violent offenders. But
- 12:33Speaker 1: he is certainly willing to bring this case, which I
- 12:36Speaker 1: think is a mistake. I think people need to think
- 12:39Speaker 1: seriously of the implications of this type of case. You know,
- 12:43Speaker 1: the politicalization of the criminal justice system is one of
- 12:46Speaker 1: the great scourges of the law. It is something that
- 12:50Speaker 1: we have always rejected in this country. I can't say
- 12:54Speaker 1: that this is the first prosecutor to yield to temptation,
- 12:58Speaker 1: but there are serious flaws and the implications are great.
- 13:02Speaker 1: The implications are basically, are we losing this country and
- 13:07Speaker 1: what it's supposed to be when it comes to we
- 13:09Speaker 1: don't weaponize our justice system to take out our political opponents.
- 13:13Speaker 1: You know, you see all the time in other countries,
- 13:15Speaker 1: I say all the time, but you know third world
- 13:17Speaker 1: countries and where there are coup attempts and things where
- 13:20Speaker 1: you'll have leaders that are put into exile and they
- 13:23Speaker 1: come back to power, they're arrested, they're put in Jailman
- 13:26Speaker 1: as a great example of that, you can go throughout
- 13:29Speaker 1: history and you can see this. This is something that
- 13:34Speaker 1: we should all condemn, the left, the right, everybody in between.
- 13:37Speaker 1: You should never have to worry that running for office
- 13:40Speaker 1: can mean that you're going to be politically persecuted and
- 13:43Speaker 1: put into prison because people are obsessed with you. And
- 13:50Speaker 1: yet Democrats are now coming out and they're saying this
- 13:55Speaker 1: is victory. This is what we needed this is this
- 13:58Speaker 1: is the ball game. Right, he couldn't wait for this
- 14:01Speaker 1: to happen. Over at CNN when this news broke. I
- 14:04Speaker 1: want you to hear what they said. They actually said,
- 14:06Speaker 1: Donald Trump telling people to stand up for what they
- 14:08Speaker 1: believe in and say no to this and go out
- 14:10Speaker 1: there and protest the weaponization of our judicial system. Okay,
- 14:16Speaker 1: they're now saying that he has nothing more than a
- 14:19Speaker 1: domestic terrorist for doing that, and that anybody else is
- 14:24Speaker 1: a domestic terrorist for doing it. Take a listen your
- 14:27Speaker 1: reaction to Trump's claim that he will be arrested Tuesday,
- 14:31Speaker 1: his calls for protests, and by the way, the Manhattan
- 14:34Speaker 1: Day's Office still not confirming that there is any imminent
- 14:37Speaker 1: arrest or indictment that is scheduled for Tuesday. Right, that's
- 14:42Speaker 1: part of the story that he's putting a specific date
- 14:45Speaker 1: on it that the DA's office is not. But obviously
- 14:48Speaker 1: the larger point is the one Fred that you mentioned.
- 14:51Speaker 1: You know, if you are the most sympathetic observer possible
- 14:54Speaker 1: to Donald Trump and you do double backflips, you can
- 14:57Speaker 1: find some credence in his argument on January sixth, he
- 15:01Speaker 1: did not know that his language would lead to violence,
- 15:05Speaker 1: but January sixth has now happened. He knows the effect
- 15:08Speaker 1: of the language that he used that day and how
- 15:10Speaker 1: it led to violence, and here he is coming very
- 15:13Speaker 1: close to that language again. It makes it very hard
- 15:17Speaker 1: to avoid the conclusion that he is willing to use
- 15:21Speaker 1: the threat of violence as part of his political strategy.
- 15:25Speaker 1: And that is just a reminder of the very different
- 15:28Speaker 1: era we are in that we have been at any
- 15:30Speaker 1: point in American history where you have Trump, the leader
- 15:33Speaker 1: of a political movement who is routinely willing to raise
- 15:37Speaker 1: the specter of violence as a way of advancing his goals,
- 15:41Speaker 1: and so many conservative commentators and members of Congress who
- 15:46Speaker 1: have condemned preemptively the possibility of indictment remained silent on
- 15:53Speaker 1: his raising this threat of violence, So that I think
- 15:57Speaker 1: is just enormously significant, any marker of the very different
- 16:01Speaker 1: era that we are in politically that we have ever
- 16:03Speaker 1: been in before. What's unprecedented is not that it's the
- 16:10Speaker 1: way the media is acting, it's the way this rogue
- 16:15Speaker 1: DA is acting. I really do believe this is going
- 16:19Speaker 1: to be the biggest backfire that we've ever seen. I've
- 16:22Speaker 1: talked to people that have said to me, look, I
- 16:25Speaker 1: wasn't going to vote for Trump again this time around.
- 16:27Speaker 1: I think it was time to move on to somebody else. However,
- 16:29Speaker 1: if they do this, if there's a mug shot of
- 16:31Speaker 1: Donald Trump, I will definitely back and support him, if
- 16:36Speaker 1: for no other reason, so that he goes in there
- 16:41Speaker 1: and he cleans house, and then he goes in there
- 16:44Speaker 1: and he completely overhauls the Justice Department and completely overhauls
- 16:48Speaker 1: the deep state in the FBI. If Donald Trump gets reelected,
- 16:52Speaker 1: he has promised that he will do that this time,
- 16:54Speaker 1: something that he didn't do last time. And I think
- 16:58Speaker 1: it is very clear that this environment in our deep
- 17:01Speaker 1: state is so toxic and is so vile and is
- 17:05Speaker 1: so disgusting that if he does win again, I believe
- 17:08Speaker 1: he would have a mandate, a mandate to go in
- 17:12Speaker 1: there and a mandate to say I am going to
- 17:14Speaker 1: do this and there's nothing that you can do to
- 17:16Speaker 1: stop me, because I've been elected by the American people.
- 17:20Speaker 1: In fact, I would run on this right. I wouldn't
- 17:25Speaker 1: hold back on this. I would run on this. I
- 17:29Speaker 1: would make this my mission, my mission in life, to
- 17:36Speaker 1: not back down and to say, look at what they've
- 17:38Speaker 1: done to me. If they can do it, to a
- 17:40Speaker 1: former president, and I would I would make posters and
- 17:44Speaker 1: T shirts of my mug shot, and I would say,
- 17:47Speaker 1: that's what this is, what this election is about. Do
- 17:49Speaker 1: you want to live in a third world country? Do
- 17:52Speaker 1: you want to live in a in a third world
- 17:54Speaker 1: nation where we put into prison into ye are political opponents,
- 18:02Speaker 1: just because there are political opponents. I wouldn't back down
- 18:06Speaker 1: from this. I would own it. And not only would
- 18:11Speaker 1: I own it, I would stand there proudly and say, yes,
- 18:15Speaker 1: I'm a political prisoner. I am persecuted for having my
- 18:21Speaker 1: own beliefs and freedom of speech. I wouldn't stop on this.
- 18:27Speaker 1: I wouldn't back down on this. I would open up
- 18:30Speaker 1: the biggest cannon whoop ay I could find, and I
- 18:33Speaker 1: would run on this and say, this is the country
- 18:36Speaker 1: that the Democrats have created, and it's time that we
- 18:39Speaker 1: get back to what's supposed to happen this country. Yeah.
- 18:42Speaker 1: I've said this before and people are like, oh, lock
- 18:44Speaker 1: her up, lock her up. I'm like, I don't want
- 18:46Speaker 1: to lock up Hillary Clinton unless she actually committed a crime.
- 18:49Speaker 1: And I don't want to lock up any Democrat unless
- 18:51Speaker 1: they've actually committed a crime, and a crime that has
- 18:55Speaker 1: been proven and a jury of their peers. I do
- 18:58Speaker 1: not like the persecute of people on the other side
- 19:01Speaker 1: of the aisle just because of what they say and
- 19:04Speaker 1: or what they believe in. That is wrong. It's always
- 19:07Speaker 1: been wrong, and it's something that we should never advocate. Four.
- 19:12Speaker 1: It's something that we should never not ever should we
- 19:17Speaker 1: sit there and celebrate it, because if they can do
- 19:20Speaker 1: this to a former president, they can do it to you.
- 19:25Speaker 1: Never forget that. One eight hundred four seven four nine
- 19:31Speaker 1: seven three two. If Donald Trump is indicted, I want
- 19:35Speaker 1: to get your reaction to it. Will you support him
- 19:39Speaker 1: if he is indicted? One eight hundred four seven four
- 19:44Speaker 1: nine seven three two. One eight hundred four seven four
- 19:47Speaker 1: nine seven three two don't forget On Verdict with Ted Cruz,
- 19:52Speaker 1: I co host that podcast with him Monday morning, we're
- 19:54Speaker 1: going to do a deep dive into all of this.
- 19:58Speaker 1: I want to make sure that you're able to listen
- 20:00Speaker 1: sent to that. It's an extremely important conversation that we're
- 20:04Speaker 1: going to be having, So make sure you download Vertical
- 20:06Speaker 1: Tech Crews. You can also listen all week on on
- 20:08Speaker 1: my podcast, The Ben Ferguson Podcasts. We'll give you all
- 20:11Speaker 1: the breaking news on this one as well. Again your
- 20:14Speaker 1: phone calls one eight hundred four seven four nine seven
- 20:19Speaker 1: three two. Hillary Clinton gets fined years later for miscategorizing
- 20:25Speaker 1: donate or miscategorizing you know, campaign expenditures from twenty and sixteen.
- 20:30Speaker 1: Campaign didn't have to pay the fines back until years later,
- 20:34Speaker 1: was not indicted. Now you have a liberal DA, an
- 20:39Speaker 1: activist by the name of brag Manhattan DA that is
- 20:42Speaker 1: now out there saying, Yep, I'm gonna put Donald Trump
- 20:45Speaker 1: in jail for doing the exact same thing. Again. Hillary
- 20:50Speaker 1: Clinton's campaign was actually fined for hiding the still dossier
- 20:53Speaker 1: payments under quote legal fees. Essentially the same legal theory
- 20:57Speaker 1: on the Stormy Daniels payment. The DA is remaining a
- 20:59Speaker 1: crime investigation of Trump on That is what you call
- 21:03Speaker 1: a legal double standard. And that's the problem here, is
- 21:08Speaker 1: that legal double standard where they are now politicizing the
- 21:13Speaker 1: District Attorney's office and they are trying to destroy a
- 21:17Speaker 1: political opponent, trying to make it where he cannot run
- 21:21Speaker 1: for president. That's their goal. They're trying to make it
- 21:24Speaker 1: where he would be ineligible to be president. They believe
- 21:28Speaker 1: that if they can just indict him. They believe if
- 21:31Speaker 1: they can just shut him down and get that mugshot
- 21:34Speaker 1: that his career will be over. I would argue it's
- 21:38Speaker 1: going to be the complete opposite of that. Let's talk
- 21:43Speaker 1: about a great opportunity for your IRA. In four o

- 22:43Speaker 1: guest with me is Senator Ted Cruz, Senator I appreciate
- 22:47Speaker 1: you coming on to chat about this. The world's obviously reacting. Dude,
- 22:51Speaker 1: Donald Trump saying I'm gonna be and I'm gonna be arrested,
- 22:55Speaker 1: he said on Tuesday. And the crazy part is this
- 22:59Speaker 1: could be an indictment against him for the same thing
- 23:02Speaker 1: that Hillary Clinton was actually fine for doing but never indicted.
- 23:06Speaker 1: Break it all down for us. Gotta say, I think
- 23:08Speaker 1: this podcast coming out is one of the most important
- 23:11Speaker 1: we've ever done because it walks people through what are
- 23:15Speaker 1: really confusing legal issues and really confusing facts. And it's
- 23:19Speaker 1: hard when you're understanding it. You see Democrats and you
- 23:23Speaker 1: see the media celebrating yea, we're finally going to get Trump.
- 23:26Speaker 1: You see people on the right saying, boo, this is terrible,
- 23:29Speaker 1: and it's hard to know, Okay, what really is happening.
- 23:34Speaker 1: What we do in tomorrow Morning's podcast is we walk
- 23:37Speaker 1: you through chapter and verse to understand what's going on.
- 23:41Speaker 1: The long and short of it is, I think this
- 23:45Speaker 1: indictment is garbage. This indictment is this is a political persecution.
- 23:49Speaker 1: It is not, in fact a fair application of the law.
- 23:53Speaker 1: The person bringing the indictment as a guy named Alvin Bragg,
- 23:57Speaker 1: who is Alvin Bragg. He is a George Oros supported
- 24:01Speaker 1: district attorney in Manhattan. He is an elected Democrat. He
- 24:04Speaker 1: is a left wing activist. The main thing Bragg has
- 24:09Speaker 1: been known for in a short tenure as the DA
- 24:12Speaker 1: in Manhattan has been letting violent criminals go. And he
- 24:15Speaker 1: has shifted dramatically. He ran promising to prosecute fewer violent criminals,
- 24:19Speaker 1: to let violent criminals go. George Soros put over a
- 24:23Speaker 1: million dollars behind this campaign to get him elected, and
- 24:27Speaker 1: now he is threatening to arrest on Tuesday Donald Trump.
- 24:33Speaker 1: And this all goes back to twenty sixteen, which obviously
- 24:37Speaker 1: was seven years ago. And in twenty sixteen, Trump allegedly
- 24:42Speaker 1: gave one hundred and thirty thousand dollars in a hush
- 24:44Speaker 1: payment to Stormy Daniels, the stripper and the porn star.
- 24:48Speaker 1: Twenty sixteen was obviously the presidential year, and the allegation
- 24:54Speaker 1: is that he paid her that money to stay quiet
- 24:56Speaker 1: about an adulterous affair they'd had. Now, paying someone to
- 25:01Speaker 1: stay quiet is not in and of itself illegal. It
- 25:04Speaker 1: may not be the most moral thing on earth to do,
- 25:07Speaker 1: but it is typically not a criminal violation. What Alvin
- 25:13Speaker 1: Bragg is doing is using a relatively obscure New York
- 25:17Speaker 1: criminal law, new York Penal Law one seven five dot
- 25:20Speaker 1: oh five, which makes it a crime to essentially keep
- 25:24Speaker 1: a fraudulent business record. And his whole claim is that
- 25:29Speaker 1: the one hundred and thirty thousand dollars that Michael Cohen,
- 25:32Speaker 1: who was Trump's personal attorney at the time, allegedly delivered
- 25:36Speaker 1: to Stormy Daniels, that Trump recorded that on his books
- 25:40Speaker 1: as legal fees, what in fact, it was hush money
- 25:43Speaker 1: to the stripper. Now, this is a tickie tac claim.
- 25:48Speaker 1: This is a claim that has been tried against other politicians.
- 25:52Speaker 1: Member John Edwards, the Democrat senator, ran for president. They
- 25:56Speaker 1: went after him on this. They tried him on this
- 25:58Speaker 1: and they lost. The jury laughed amount of court said
- 26:00Speaker 1: this is stupid and ironically and it's what you open
- 26:04Speaker 1: your show with. Hillary Clinton did the exact same thing
- 26:08Speaker 1: at the same time in the twenty sixteen election, Hillary
- 26:12Speaker 1: Clinton's campaign spent over a million dollars paying for the
- 26:16Speaker 1: Steel dossier, the bogus fake Russia Gate thing where they
- 26:20Speaker 1: hired this guy Steele to compile all sorts of sordid
- 26:24Speaker 1: rumors in about innuendo about Donald Trump, but the million
- 26:28Speaker 1: dollars she paid, she called it legal fees. Did the
- 26:31Speaker 1: exact same thing Trump what did, but instead it was
- 26:35Speaker 1: to dig up dirt and to try to disseminate dirt
- 26:38Speaker 1: on Trump that was false. And yet ironically, the same
- 26:42Speaker 1: Democrats and media that are celebrating going after Trump on
- 26:45Speaker 1: this ridiculous charge were perfectly fine with Hillary not facing
- 26:51Speaker 1: any criminal liability. I want to ask you one of
- 26:55Speaker 1: the other big questions, and we're going to dive into,
- 26:57Speaker 1: obviously a lot of the legal aspects of this verdict
- 27:00Speaker 1: that we just got finished recording. So now a verdict
- 27:02Speaker 1: with Ted Cruz, I get to co host a show
- 27:05Speaker 1: with you. It's a blast listen to it. We do
- 27:07Speaker 1: it three days a week. But the big question people
- 27:10Speaker 1: are saying is okay, and this comes down donald Trump
- 27:13Speaker 1: has a mug shot. Is Donald Trump then at that
- 27:16Speaker 1: point ineligible to run for president or ineligible to become
- 27:20Speaker 1: president of the uniteds America if he is a indicted
- 27:24Speaker 1: or b goes to trial and it's found quote guilty
- 27:26Speaker 1: by a New York jury, which I think in New
- 27:29Speaker 1: York a jury there they can hate Donald Trump as
- 27:32Speaker 1: much as this prosecutor does. Yeah, the short answer is no,
- 27:35Speaker 1: absolutely not. There is no legal prohibition on someone indicted
- 27:40Speaker 1: running for president or serving as president. There's no legal
- 27:42Speaker 1: prohibition on someone convicted running for president or serving as president.
- 27:47Speaker 1: There are political constraints and that if you're a convicted felons,
- 27:50Speaker 1: sometimes that will cause people to vote against you. But
- 27:53Speaker 1: there have been multiple convicted felons elected to federal office previously.
- 27:59Speaker 1: We've had one of the things we talked about in
- 28:00Speaker 1: the podcast, Eugene Debs, who was the Socialist candidate for president,
- 28:05Speaker 1: ran four times. One of the times he ran, he
- 28:07Speaker 1: was in jail and was running for president. In the
- 28:10Speaker 1: United States, the only way to bar someone from running
- 28:14Speaker 1: for president is if they are impeached by the House
- 28:18Speaker 1: and convicted by the Senate by two thirds of the Senate.
- 28:21Speaker 1: And one of the punishments that can be imposed in
- 28:24Speaker 1: impeachment is barring them from running for federal office. The
- 28:28Speaker 1: chances of that happening are zero. There's no chance on
- 28:31Speaker 1: earth it'll happen, and so this is going to be
- 28:34Speaker 1: decided by the voters. But that being said, I gotta say,
- 28:37Speaker 1: if Alvin Bragg goes through with this, if he arrests
- 28:39Speaker 1: Trump on Tuesday, if he brings this bogus charge, I
- 28:42Speaker 1: think it is likely to get laughed at a court.
- 28:44Speaker 1: I think a jury is likely to acquit And if
- 28:47Speaker 1: and when that happens, Alvin Bragg, this left wing Soros
- 28:51Speaker 1: elected DA might have single handedly reelected Donald Trump as president,
- 28:57Speaker 1: which which is more than a little bit of irony.
- 29:00Speaker 1: Every time they seem to go into extreme senator it
- 29:03Speaker 1: backfires on the left when they try to go after
- 29:05Speaker 1: Donald Trump. Even Elon Moss tweeted out basically saying the
- 29:09Speaker 1: same thing that you just said, which is, if you
- 29:11Speaker 1: actually do this, if you're dumb enough to do this,
- 29:14Speaker 1: this will backfire in such a way that it will
- 29:17Speaker 1: guarantee the presidency to Donald Trump. I tend to go
- 29:21Speaker 1: with that assessment that this is going to be seen
- 29:24Speaker 1: by so many Americans as such a political enemies list,
- 29:28Speaker 1: the same type that we see in third world countries.
- 29:31Speaker 1: But the scary part is it's actually quite possible it's
- 29:33Speaker 1: happening here in the United States of America. Well, look,
- 29:36Speaker 1: it is sad, it's dangerous. It's why, as you know,
- 29:40Speaker 1: the latest book I wrote, which just came out a
- 29:42Speaker 1: couple of months ago, is entitled Justice Corrupted. How the
- 29:46Speaker 1: Left has weaponized the legal System, And the entire book
- 29:49Speaker 1: is about what's happening right now. It's about how Joe
- 29:52Speaker 1: Biden has turned the Department of Justice and the FBI
- 29:55Speaker 1: into political weapons to target his enemies. It's about how
- 29:58Speaker 1: Barack Obama turned a Partment of Justice and the IRS
- 30:01Speaker 1: and the FBI and the CIA into political weapons to
- 30:04Speaker 1: target his enemies. It's about George Soros prosecutors. I've got
- 30:07Speaker 1: an entire chapter in the book on George Soros prosecutors.
- 30:11Speaker 1: We talked about the Steel Dossier. I've got an entire
- 30:14Speaker 1: chapter in the book on crossfire, hurricane and on the
- 30:16Speaker 1: efforts to go after Donald Trump by these hard partisans.
- 30:20Speaker 1: And I got to say, it is dangerous. The reason
- 30:22Speaker 1: I wrote the book Justice Corrupted, is we all count
- 30:27Speaker 1: on our liberty coming from the rule of law, coming
- 30:30Speaker 1: from the fact that law enforcement is not used as
- 30:34Speaker 1: a political weapon to attack your political opponents, but rather
- 30:38Speaker 1: the law should apply fairly to everyone. And I think
- 30:40Speaker 1: what is happening right now is incredibly dangerous. It is
- 30:44Speaker 1: We're gonna continue this conversation on our podcast. Senator Thank
- 30:49Speaker 1: you for joining us to night Dowload Verdict with Ted Cruz.
