Latest / The Ben Ferguson Podcast / Sham Hunter Indictment is ALL about Protecting Joe Biden
Transcript
- 0:01Speaker 1: Welcome.
- 0:02Speaker 2: It's Verdict with Center, Ted Cruz, Ben Ferguson with you
- 0:05Speaker 2: and Senator. We've got a lot to talk about tonight,
- 0:07Speaker 2: including Hunter Biden's not shocking indictment at all and the
- 0:12Speaker 2: media acting like this is a big deal when it's
- 0:14Speaker 2: clearly not. It's the fixes already in. Plus, we've got
- 0:18Speaker 2: a new update on Joe biden impeachment and his own
- 0:21Speaker 2: words coming back to haunt him in a big way.
- 0:23Speaker 2: But first, Center, let's walk through this indictment. This is
- 0:27Speaker 2: a big nothing burger. In my opinion, they've in died
- 0:30Speaker 2: him on the federal gun charges. This insulates the president,
- 0:33Speaker 2: It protects the big guy. It focuses on crimes that
- 0:36Speaker 2: are completely limited to Hunter Biden and no one else.
- 0:40Speaker 2: In all the big crimes they could have charged them
- 0:41Speaker 2: with today, they still have not done it.
- 0:44Speaker 1: This is a fix. Do you agree?
- 0:46Speaker 3: Sadly, I do, And we predicted this over a year
- 0:49Speaker 3: ago on this podcast. We talked about how the investigation
- 0:53Speaker 3: into the bidens if at the end of the day,
- 0:55Speaker 3: the indictment that came in was a personal offense limit
- 1:00Speaker 3: to Hunter Biden, if it was a drug offense, if
- 1:04Speaker 3: it was a gun offense, if it was a personal
- 1:07Speaker 3: tax offense that was limited to Hunter himself, then that
- 1:12Speaker 3: was by design. That was by design to insulate Joe Biden.
- 1:18Speaker 3: It's worth underscoring. We've said it before, but we cannot
- 1:21Speaker 3: forget this is not about Hunter Biden. If his name
- 1:25Speaker 3: was Hunter Smith, if he was just some poor, sad
- 1:29Speaker 3: sack dealing with addiction and substance abuse, nobody would care.
- 1:33Speaker 3: It wouldn't be national news, it wouldn't be a matter
- 1:35Speaker 3: of public concern. The reason this matters is because there's
- 1:41Speaker 3: considerable evidence that Hunter Biden solicited and received tens of
- 1:47Speaker 3: millions of dollars from corrupt foreign players in exchange for
- 1:53Speaker 3: official favors from his dad, Joe Biden, now the President
- 1:57Speaker 3: of the United States. That's what matters. And so this
- 2:00Speaker 3: this indictment. We said a year ago, if they just
- 2:02Speaker 3: bring a gun crime, they're covering up for Joe. Now
- 2:05Speaker 3: they're three three indictments. They are three counts of the indictment.
- 2:09Speaker 3: Two counts are tied to Hunter Biden completing a form
- 2:13Speaker 3: indicating that he was not using illegal drugs when he
- 2:16Speaker 3: purchased a cult Cobra revolver in October of twenty eighteen.
- 2:21Speaker 3: And the third count alleges that he possessed a firearm
- 2:25Speaker 3: while using a narcotic. Now, those are crimes that I
- 2:30Speaker 3: think Hunter clearly committed. That there's very little material dispute
- 2:35Speaker 3: that he is guilty of those crimes. By the way,
- 2:37Speaker 3: those indictments could have been brought years ago. The evidence
- 2:40Speaker 3: was there has been there for years, and DOJ delayed
- 2:44Speaker 3: and delayed and Delayden de Layden delayed. And this is
- 2:47Speaker 3: all about insulating Joe Biden. Joe Biden does not bear
- 2:51Speaker 3: any liability for Hunter being on crack while he illegally
- 2:55Speaker 3: buys a gun. That's a bad development for Hunter. But
- 3:00Speaker 3: the purpose of this is to insulate the White House
- 3:05Speaker 3: and to let the Biden do OJ say, see we
- 3:08Speaker 3: indicted to Biden, aren't we tough? And they're deliberately carving
- 3:13Speaker 3: off and protecting Joe, who is the reason that the
- 3:17Speaker 3: public rightfully cares about this.
- 3:20Speaker 2: Well, let's talk about the comparing contrast to the plea deal.
- 3:23Speaker 2: This is what he was gonna plead guilty to that
- 3:27Speaker 2: they're now charging him with.
- 3:29Speaker 1: How is this going to change?
- 3:30Speaker 2: I mean, is the fact that they've it's not in
- 3:32Speaker 2: a plea deal and they're gonna they they've charged him
- 3:35Speaker 2: and died on this federal gun charge. Does that change
- 3:38Speaker 2: the chances he might actually go to prison for any
- 3:40Speaker 2: amount of time?
- 3:42Speaker 3: It probably does.
- 3:43Speaker 4: Uh.
- 3:43Speaker 3: But if you look at it, we look at the
- 3:45Speaker 3: evolution of this, we now know, and we've covered in
- 3:48Speaker 3: previous podcasts that the Biden do OJ was initially prepared
- 3:53Speaker 3: to have a plea deal where Hunter didn't have to
- 3:55Speaker 3: plead guilty to anything. He could just enter an agreement,
- 3:59Speaker 3: get not even a slap on the wrist, sort of
- 4:02Speaker 3: a wave over the hand and everything goes away, and
- 4:06Speaker 3: without even pleading guilty to anything. The Biden DOJ was
- 4:11Speaker 3: prepared to give him complete and total immunity for any
- 4:14Speaker 3: and all criminal conduct, especially especially especially the criminal conduct
- 4:19Speaker 3: that implicated his father, and that really, I believe was
- 4:23Speaker 3: the entire objective.
- 4:24Speaker 1: Of this whole thing.
- 4:25Speaker 3: Now, what happened to derail that plan when they announced
- 4:29Speaker 3: they were indicting Hunter.
- 4:30Speaker 1: That was the plan.
- 4:31Speaker 3: The Biden Department of Justice was obstructing the investigation that
- 4:36Speaker 3: Merrick Garland had lied under oath to Congress. And given that,
- 4:39Speaker 3: the heat ratcheted up and they said, Okay, you got
- 4:41Speaker 3: to plead guilty, but will still make it a slap
- 4:45Speaker 3: on the wrist, Hunter, You still don't have to serve
- 4:48Speaker 3: even a day, even a minute in jail. We'll make
- 4:51Speaker 3: it all magically go away. And the critical piece that
- 4:54Speaker 3: was added to this is and you get a get
- 4:56Speaker 3: out of jail free card for all corrupt activity for Ivory,
- 5:00Speaker 3: for everything that was done, selling access to Daddy, selling
- 5:04Speaker 3: favors from Daddy. All of that is exonerated when you
- 5:08Speaker 3: sign on to this agreement with no jail time. Now,
- 5:13Speaker 3: what happened then is the whistleblowers came and testified before Congress,
- 5:17Speaker 3: and the global attention on this ratcheted up considerably, and
- 5:23Speaker 3: so suddenly they went before the federal district judge and
- 5:26Speaker 3: the judge asked, DOJ, so are you saying that everything
- 5:30Speaker 3: else Hunter's done? And mind you, the House representatives filed
- 5:33Speaker 3: a brief of the district judge laying out all of
- 5:35Speaker 3: the evidence of Hunter's potential other criminal conduct, of Joe
- 5:39Speaker 3: Biden's criminal conduct, and the judge asked, DOJ are you
- 5:43Speaker 3: saying you're not going to prove, prosecute anything else other
- 5:47Speaker 3: than this these counts on which you're giving him a
- 5:50Speaker 3: slap on the wrist, And doj got really nervous and
- 5:53Speaker 3: they said no, no, no, we're not saying that well, and
- 5:56Speaker 3: I think they just they lost their nerve to give
- 6:01Speaker 3: Hunter and really to give Joe, because Joe is always
- 6:04Speaker 3: the beneficiary of this corruption to get out of jail
- 6:07Speaker 3: free pass. That's what led to the plea agreement falling apart.
- 6:12Speaker 3: I think this is the third iteration. And by the way,
- 6:14Speaker 3: we predicted this third iteration that they would come back
- 6:17Speaker 3: and they would indict Hunter. But again it's on the
- 6:20Speaker 3: personal crimes. And if there's not a plea agreement, I
- 6:25Speaker 3: think the odds are significantly higher that Hunter serves some
- 6:30Speaker 3: jail time.
- 6:32Speaker 1: But I also think.
- 6:34Speaker 2: Look like I mean we were talking a day or
- 6:36Speaker 2: two days, or three days or a month. I mean,
- 6:38Speaker 2: if they were willing to give him no jail time
- 6:40Speaker 2: before and now they charge him with us if he's
- 6:42Speaker 2: found guilty, how much does that come to the discretion
- 6:46Speaker 2: of the judge or their minimums are sensing guidelines here?
- 6:51Speaker 1: I mean, how concerned is he tonight?
- 6:53Speaker 2: Okay, wow, I may actually spend real time in jail.
- 6:56Speaker 3: Look, dealj wants to give him no jail time. They
- 6:59Speaker 3: wanted to give him a we doesn't even plead guilty
- 7:01Speaker 3: in anything. So this is not a true adversarial proceeding.
- 7:06Speaker 3: This is not a prosecutor who is seeking to hold
- 7:08Speaker 3: someone accountable. The reason Merrick Garland appointed David Wise as
- 7:12Speaker 3: special prosecutor is special counsel rather, is that he'd already
- 7:16Speaker 3: demonstrated that he was willing to obstruct justice and cover
- 7:21Speaker 3: up Joe Biden. That's the objective here, and so the
- 7:27Speaker 3: small level objective with this case. I think this case
- 7:32Speaker 3: probably gets resolved of the plea deal as well, and
- 7:34Speaker 3: the plea deal may require Hunter to serve six months
- 7:38Speaker 3: in jail. I think that's a real possibility, and they
- 7:42Speaker 3: may get nervous about having a commitment we will not
- 7:44Speaker 3: investigate anything else. Now, mind you, they intend not to
- 7:49Speaker 3: investigate anything else. And it wouldn't surprise me at all
- 7:53Speaker 3: to see THEOJ Yeah, to see doj say privately, look, wink, wink, nudge, nudge,
- 7:59Speaker 3: we're not going to invest at anything else. But we
- 8:01Speaker 3: can't say that in open court because it makes us
- 8:04Speaker 3: look like completely partisan, corrupted, compromised hacks. And it may
- 8:11Speaker 3: be that Biden's lawyers take that and that he serves
- 8:14Speaker 3: some time in jail. We do seem to have seen
- 8:18Speaker 3: some movement among Democrats among the press where they've decided
- 8:23Speaker 3: throw Hunter overboard a little bit in order to protect Joe.
- 8:28Speaker 3: It's why the last podcast on Wednesday, and by the way,
- 8:31Speaker 3: if you did not listen to Wednesday's podcast, you should
- 8:34Speaker 3: go back and listen to it. It was really important
- 8:37Speaker 3: explanation on the impeachment of Joe Biden. Why the Democrats
- 8:42Speaker 3: claim that there is no direct evidence of Joe's involvement
- 8:45Speaker 3: as corruption is a flat out lie, and we walked
- 8:49Speaker 3: through it chapter and verse on Wednesday's podcast. The fact
- 8:54Speaker 3: that they have shifted their defense to saying there's no
- 8:57Speaker 3: direct evidence of Joe's involvement in the hates that they've
- 9:00Speaker 3: collectively decided to cut bait and throw Hunter to some
- 9:05Speaker 3: extent to the Wolves. Now, I suspect Joe is still
- 9:08Speaker 3: not entirely comfortable with Hunter serving ten years. But at
- 9:14Speaker 3: this point I think the most likely outcome, absent enormous
- 9:18Speaker 3: public pressure, is Hunter pleads guilty to these charges, serves
- 9:23Speaker 3: some minimal jail time six months to a year, these
- 9:29Speaker 3: charges go away, and the investigation and everything else just
- 9:32Speaker 3: quietly disappears. Doj doesn't admit in court, they're not going
- 9:37Speaker 3: to investigate it. They simply say nothing else, and actually
- 9:43Speaker 3: that then serves as a shield for DOJ. When Merrick
- 9:47Speaker 3: Garland or anyone else from the Department of Justice is
- 9:50Speaker 3: brought before Congress, their response will be when asked about Hunter,
- 9:54Speaker 3: it's still an ongoing investigation, I'm sorry, we can't tell
- 9:57Speaker 3: you anything. When they have, I belie leave zero intention
- 10:02Speaker 3: to investigate the claims of bribery and corrupt selling of
- 10:09Speaker 3: official favors from Joe Biden because the Department of Justice
- 10:13Speaker 3: wants to protect Joe Biden above all else.
- 10:16Speaker 2: Senator, it's also very interesting to see how the media
- 10:19Speaker 2: is covering this story, and I want to get into
- 10:21Speaker 2: that in a minute, because they're trying to make this
- 10:22Speaker 2: a big deal while also undermining the charges saying they're
- 10:26Speaker 2: actually weak, which is pretty hysterical. But first, let me
- 10:29Speaker 2: tell you about our friends and in viro clins. You
- 10:32Speaker 2: should choose an air purifier like your life depends on it,
- 10:35Speaker 2: because it just might. We've had more than thirty five
- 10:38Speaker 2: thousand wildfires that have devastated the US this year alone,
- 10:42Speaker 2: and the toxins, the particles and wildfire smoke can penetrate
- 10:45Speaker 2: our lungs and threaten our health. That's why in viro
- 10:49Speaker 2: Clins developed military grade air purification for your home, and
- 10:54Speaker 2: they just announced that they're having their biggest sale of
- 10:57Speaker 2: the year. You can get thirty percent off right now,
- 11:01Speaker 2: and Viroclints is specifically designed to wipe out airborne chemicals
- 11:05Speaker 2: and viruses known to cause illness, allergies, and difficulty breathing. Now,
- 11:11Speaker 2: I've got asthma and I have in vira Clints in
- 11:13Speaker 2: my bedroom and I can tell you it has made
- 11:16Speaker 2: a massive difference. This is also one of the cool
- 11:20Speaker 2: things about in viro Clintons. Even toxic gases and particles
- 11:23Speaker 2: found in wildfire smoke are no match. That's why the
- 11:27Speaker 2: US Navy selected in viro Clints protect and purify the
- 11:31Speaker 2: air in their facilities, and viraro Clintons comes with a
- 11:34Speaker 2: free professional air quality monitor, so you know your family's
- 11:38Speaker 2: breathing purified air. So save right now and get the
- 11:42Speaker 2: free air quality monitor and fast free shipping. That's over
- 11:45Speaker 2: a two hundred and fifty dollars savings right there. Loan
- 11:48Speaker 2: go to ekpure dot com use promo code verdict. That's
- 11:54Speaker 2: Ekcure dot com promo code verdict and save and get
- 12:00Speaker 2: in Vira Clints. It's amazing, Senator. I want to play
- 12:03Speaker 2: for you MSNBC. This is what they had to say
- 12:06Speaker 2: is they were breaking the news on the Hunter Biden
- 12:08Speaker 2: indictment on the federal gun charge, and they're trying to
- 12:11Speaker 2: turn this into a very big deal. Well at the
- 12:13Speaker 2: same time, the media, then an hour later is trying
- 12:16Speaker 2: to tell you that the case against Hunter Biden is
- 12:18Speaker 2: actually really weak.
- 12:20Speaker 5: Breaking news.
- 12:21Speaker 6: Now we have just learned and we just got the
- 12:23Speaker 6: paperwork that Hunter Biden, the President's son, has been indicted
- 12:27Speaker 6: for lying when buying a gun. I want to bring
- 12:29Speaker 6: an NBC's Garrett. Hey, Garrett, what can you tell us.
- 12:32Speaker 7: Well, Chris, this indictment just unsealed in Delaware charges Hunter
- 12:36Speaker 7: Biden with three counts, all related to that gun purchase.
- 12:39Speaker 7: It describes two counts of knowingly making a false or
- 12:42Speaker 7: fictitious statement when purchasing a gun, basically accusing him of
- 12:46Speaker 7: lying about being addicted to drugs at the time he
- 12:49Speaker 7: was purchasing this weapon pistol in October of twenty eighteen,
- 12:54Speaker 7: and the third count is that he did knowingly possess
- 12:56Speaker 7: that same firearm while essentially while being addicted to a
- 13:02Speaker 7: controlled substance. So these are counts that were all thought
- 13:05Speaker 7: to have been dealt with in that plea deal that
- 13:08Speaker 7: fell apart a couple of months ago, kicking things back
- 13:11Speaker 7: to the US Attorney. Now special Council whis handling this
- 13:15Speaker 7: in Delaware, a former US attorney in the district of Delaware. Again,
- 13:18Speaker 7: this indictment on Field, dealing only with the gun and
- 13:21Speaker 7: drug charges. I think it's reasonable to presume we have
- 13:24Speaker 7: not heard the last of charges against the President's son,
- 13:28Speaker 7: given the scope of what was originally in front of
- 13:31Speaker 7: the US Attorney and then kind of fallen apart back
- 13:33Speaker 7: to the drawing board to bring forward these counts.
- 13:35Speaker 2: Now, by the way you said it fell apart, that's
- 13:38Speaker 2: not true. And then MS tries to tell you that
- 13:41Speaker 2: they don't think we've heard the last of the indictments.
- 13:44Speaker 1: I don't believe that, do you.
- 13:46Speaker 8: No, No, Look, this is designed to end the matter.
- 13:51Speaker 8: That's what the Biden Department of Justice wants. They want
- 13:54Speaker 8: to say we indicted him. They want to get a conviction,
- 13:57Speaker 8: and I think the conviction is likely. I don't think
- 14:00Speaker 8: the Biden team is going to try this. They may
- 14:02Speaker 8: try to do some pre trial motions and some procedural delays,
- 14:06Speaker 8: but I don't think they're going to want to take
- 14:07Speaker 8: this to a jury, so I think it's likely to
- 14:09Speaker 8: be resolved with a plea deal, and the plea deal,
- 14:13Speaker 8: in all likelihood will end up slightly stouter than the
- 14:16Speaker 8: slap on the wrists that they tried the second time.
- 14:20Speaker 8: But the purpose of this, and we predicted this a
- 14:24Speaker 8: year ago, this is not new. It's not surprising. The
- 14:27Speaker 8: purpose of this is to put to rest all of
- 14:31Speaker 8: the allegations of corruption against Joe Biden because the Biden
- 14:36Speaker 8: DOJ is looking to an election coming up November of
- 14:39Speaker 8: next year, and by the way, they're busy inditing Donald Trump,
- 14:42Speaker 8: which is also looking to an election coming up next year,
- 14:46Speaker 8: and when it comes to election interference, We've never seen
- 14:49Speaker 8: a Department of Justice behave like Merrick Garland and this
- 14:53Speaker 8: profoundly politicized Department of Justice.
- 14:56Speaker 2: Now this case, by the way they have brought against him,
- 14:59Speaker 2: there's a lot of evidence that was from that laptop
- 15:02Speaker 2: from Hell and the and the pictures and the drug use.
- 15:08Speaker 2: I would argue it's probably a very strong case for
- 15:12Speaker 2: there to be a conviction against Hunter Biden.
- 15:14Speaker 1: If you look at the evidence.
- 15:15Speaker 2: Yet CNN just barely an hour after this indictment comes out,
- 15:22Speaker 2: they start carrying water for Hunter Biden.
- 15:24Speaker 1: And this is what they said, calling it a weak case.
- 15:28Speaker 9: Jations of politics is right, often coming from the former
- 15:31Speaker 9: president himself in terms of what they say is to
- 15:35Speaker 9: to your justice system. But here you have it, as
- 15:36Speaker 9: we noted, first time in US history the son of
- 15:39Speaker 9: a president has been charged by the Justice Department. Kris Canal,
- 15:42Speaker 9: thanks so much. Going to turn it over to Borius
- 15:44Speaker 9: for some legal analysis.
- 15:45Speaker 7: Yeah, let's chat with seeing and legal analyst Jennifer Rogers.
- 15:48Speaker 10: Jennifer, obviously, again, this is a historic moment, the first
- 15:51Speaker 10: time DOJ has charged the son of a sitting president.
- 15:54Speaker 1: Your reaction to the news.
- 15:56Speaker 11: Well, Wars, I really think, you know, the first time
- 15:58Speaker 11: we had a charge against to former president, it was
- 16:01Speaker 11: important that prosecutors really took their time and built strong
- 16:04Speaker 11: cases based on compelling evidence. And I'm afraid the prosecutors
- 16:08Speaker 11: have not done that here. I certainly, if I were
- 16:11Speaker 11: making history, would not want to make it with this
- 16:13Speaker 11: set of facts and these laws. I think that this
- 16:16Speaker 11: case is weak. It's very, very rarely charged. This section
- 16:21Speaker 11: on being an addict in possession of a weapon. So
- 16:25Speaker 11: I think they have a lot of problems, both on
- 16:27Speaker 11: the factual side, which is why it's very rarely charged,
- 16:29Speaker 11: and on the legal side. After the Supreme Court's decision
- 16:32Speaker 11: in the Bruin case on the Second Amendment, a lot
- 16:36Speaker 11: of legal observers think that all these gun possession statutes
- 16:39Speaker 11: are in jeopardy. And we know that Hunter Biden's lawyers
- 16:41Speaker 11: will fight vigorously on the legal front, saying that after
- 16:45Speaker 11: the Supreme Court's decision that this conviction could not stand.
- 16:48Speaker 11: So I think they've got a lot of trouble here ahead,
- 16:51Speaker 11: and we'll see how it plays out. But I think
- 16:54Speaker 11: it's inadvisable, Sinner.
- 16:55Speaker 2: When I heard this, I was dying to get your reaction,
- 16:57Speaker 2: because they're now telling you this case is so weak.
- 17:00Speaker 2: This is a dumb case to even bring up, even
- 17:02Speaker 2: though they're willing to do a plea deal on the
- 17:03Speaker 2: same case that got then blown up.
- 17:05Speaker 1: So which one is it?
- 17:06Speaker 3: Yeah, Look, Connor has already agreed to plead guilty to
- 17:09Speaker 3: these counts, so oddly enough, CNN, you know, I don't
- 17:13Speaker 3: know who that quote legal analyst is, but you could
- 17:16Speaker 3: have just called her a Democratic Party shill because she says, well,
- 17:19Speaker 3: first of all, the case against Donald Trump is incredibly strong.
- 17:23Speaker 3: It is meticulously researched. It is oh oh so powerful.
- 17:26Speaker 3: What utter and complete garbage. The case against Trump is
- 17:30Speaker 3: a political hatchet job, and they may get a conviction
- 17:35Speaker 3: before a DC jury that is ninety plus percent Democrat.
- 17:39Speaker 3: But I think the chances of that conviction standing up
- 17:43Speaker 3: on appeal are minuscule. But of course CNN is so
- 17:46Speaker 3: called legal analyst, is not going to tell you that.
- 17:49Speaker 3: And as for the claim that this charge is weak, okay,
- 17:54Speaker 3: the critical elements are did he buy a gun, yes,
- 17:59Speaker 3: as far as I know, there's no dispute about it.
- 18:02Speaker 3: Was he a drug addict? Yes, and I'm not aware
- 18:05Speaker 3: of any meaningful dispute about it. The guy was dishonorably
- 18:08Speaker 3: discharged from the military for his drug addiction. He's wrestled
- 18:11Speaker 3: with drug addiction for years. We have pictures and video
- 18:17Speaker 3: of him using illegal drugs. Did he lie on the form,
- 18:21Speaker 3: which is a felony, Again, there's no dispute about it.
- 18:25Speaker 3: He clearly checked the box lying on the form. So
- 18:29Speaker 3: to say the case is weak, I don't even know
- 18:32Speaker 3: a factual claim. An element of the crime that is
- 18:35Speaker 3: in dispute. And her final point, well, after the Bruin case,
- 18:41Speaker 3: you know, any gun claim is legally dubious.
- 18:44Speaker 1: What nonsense.
- 18:45Speaker 12: No, it's not.
- 18:46Speaker 3: What is legally dubious is efforts from Democrats to restrict
- 18:51Speaker 3: the right to keep in bare arms of law abiding citizens.
- 18:56Speaker 3: There are, she says, lots of legal scholars doubt this
- 18:59Speaker 3: prevent No, that's not true. There have been laws in
- 19:03Speaker 3: the books for a long time prohibiting felons from possessing firearms.
- 19:08Speaker 3: I don't know of a single legal scholar who doubts
- 19:11Speaker 3: the validity of those provisions. This is part of that
- 19:14Speaker 3: same law that deals with people with serious drug addictions.
- 19:19Speaker 3: I again don't know of a legal scholar who challenges
- 19:22Speaker 3: those provisions. So her claim, Look, it's the typical leftist
- 19:26Speaker 3: claim that if a law abiding citizen has a right
- 19:29Speaker 3: to keep in bare arms, well that means everyone can
- 19:32Speaker 3: possess weapons. Let's just hand out hand out guns to
- 19:35Speaker 3: murderers in jail. It's like, no, No, that's not what
- 19:39Speaker 3: the Second Amendment says. That's not what it's ever been
- 19:41Speaker 3: understood to say. What the Second Amendment says is that
- 19:44Speaker 3: a law abiding citizen can defend himself, can defend his
- 19:48Speaker 3: or her family, can keep and bear arms. And so
- 19:53Speaker 3: I got to say, listening to it, there literally is
- 19:56Speaker 3: not a sentence in that so called legal analysis that
- 19:59Speaker 3: isn't us laughably false.
- 20:02Speaker 2: Yeah, it's and they love to make up stuff, and
- 20:04Speaker 2: they do it every day, and even on the biggest
- 20:06Speaker 2: news days they'll come in with the propaganda just hours
- 20:09Speaker 2: afterwards to try to spend this in favor of the
- 20:11Speaker 2: Biden crime family.
- 20:13Speaker 1: I also want to move on to the.
- 20:14Speaker 3: Other begin and by the way, Ben, I want to
- 20:17Speaker 3: make clear that when I talk about what laws are
- 20:21Speaker 3: in dispute or not, the first big seminal case from
- 20:27Speaker 3: the Supreme Court establishing the individual right to keep in
- 20:31Speaker 3: bear arms was Heller versus District of Columbia. I am
- 20:35Speaker 3: very familiar with that case because I represented the State
- 20:39Speaker 3: of Texas and thirty one other states in that case.
- 20:43Speaker 3: I was part of the Supreme Court case that upheld
- 20:47Speaker 3: the individual right to keep in bear arms and it
- 20:49Speaker 3: was a it was a fundamental foundational case. Justice Scalia
- 20:54Speaker 3: wrote the majority opinion. And I'll tell you what we
- 20:57Speaker 3: said in our amicus brief on behalf of Texas and
- 20:59Speaker 3: third one other States. We said, of course, the laws
- 21:03Speaker 3: prohibiting felons from being in possession of firearms are legal
- 21:07Speaker 3: and constitutional. What government cannot do is stripped the right
- 21:11Speaker 3: to keep in bare arms from law abiding citizens. So
- 21:14Speaker 3: she claims lots of people dispute that with no apparent
- 21:19Speaker 3: awareness of what actually is are the underlying arguments concerning
- 21:24Speaker 3: the constitutional right.
- 21:26Speaker 2: Yeah, great point there. I want to move to the
- 21:28Speaker 2: impeachment update. There was some very interesting fodder from James Carvill.
- 21:34Speaker 2: If you don't know James Carville, I'll just remind you
- 21:36Speaker 2: he's a.
- 21:39Speaker 1: On the left.
- 21:39Speaker 2: They would refer to him as a brilliant political mind,
- 21:42Speaker 2: a mastermind behind the Bill Clinton days. He is on
- 21:45Speaker 2: TV a lot, talking on MSNBC in other places about.
- 21:49Speaker 1: The Democratic Party.
- 21:51Speaker 2: He was on CNN and he had this to say
- 21:55Speaker 2: about the impeachment inquiry.
- 21:57Speaker 1: Moving forward on the House side, take a look.
- 22:00Speaker 13: What do you make of how the White House has
- 22:02Speaker 13: been handling it so far? Do you think they're being
- 22:05Speaker 13: aggressive enough or should there be a war room, should
- 22:07Speaker 13: there be a more outfront effort from them?
- 22:11Speaker 4: Well, my honest opinion is the people they have leading
- 22:14Speaker 4: it are not very smart, and in fact they borderline stupid.
- 22:17Speaker 4: I mean James Comber or Jim Jordan and the people
- 22:21Speaker 4: in the House that are going to be on this
- 22:23Speaker 4: committee like Dan Goldman, Delica Plasciat I think is from
- 22:28Speaker 4: from Virgin Islands, Jamie ra Askin. These are very smart people.
- 22:33Speaker 4: I don't think the White House needs to worry too
- 22:36Speaker 4: much about this and left these congressional Democrats who are
- 22:39Speaker 4: a whip smart are just going to eat these people alive.
- 22:42Speaker 4: I so want them to do this. I can't tell
- 22:46Speaker 4: you how much I want them to do this.
- 22:49Speaker 13: This is a very you want them to do the impeachment?
- 22:51Speaker 9: What do you mean?
- 22:52Speaker 4: I want them to hole hearings?
- 22:54Speaker 13: Why do you think it's whole hearing?
- 22:56Speaker 4: And I want I want to and I want to
- 22:59Speaker 4: let people the American public see how then how nonexistent
- 23:04Speaker 4: a case is present, did anything wrong? And I want
- 23:07Speaker 4: our people, who are quite effective lawyers to get them
- 23:10Speaker 4: on cross examination and do what they're gonna do and
- 23:12Speaker 4: make foods out of them.
- 23:14Speaker 1: Senator, this is a new strategy.
- 23:17Speaker 2: I'll give James, I'll give I'll give them a little
- 23:19Speaker 2: credit here, James Carvill's you know, it's a new strategy
- 23:23Speaker 2: to say that two of the most brilliant minds in
- 23:25Speaker 2: the house are idiots, right, Jesus, James Comer and Jim Jordan.
- 23:29Speaker 2: We've had them both on this show for multiple multi
- 23:32Speaker 2: part series. You should go back and listen to it
- 23:34Speaker 2: if you haven't heard what they said. But to say
- 23:36Speaker 2: that they're idiots and that you think that your team's
- 23:39Speaker 2: going to mop the floor with them, if this is
- 23:41Speaker 2: their true strategy, this could be really bad for the president.
- 23:45Speaker 8: Well, listen.
- 23:46Speaker 3: James Carville is one of the most talented Democrat strategists
- 23:51Speaker 3: that that therey is. He was the person responsible for
- 23:54Speaker 3: Bill Clinton's election, most responsible. He's the person most famously
- 23:59Speaker 3: associated with the phrase it's the economy stupid, which was
- 24:03Speaker 3: right behind Bill Clinton beating George Herbert Walker Bush and
- 24:07Speaker 3: getting elected president in the first place. And so Carvel
- 24:12Speaker 3: is a smart guy. But I got to say what
- 24:14Speaker 3: he just said on CNN is shockingly foolish and demonstrably wrong.
- 24:21Speaker 8: Number one.
- 24:23Speaker 3: To claim that James Comer and Jim Jordan are stupid
- 24:26Speaker 3: as he did is laughable. And let me ask our verdict. Listeners,
- 24:31Speaker 3: go back and listen to the podcast. We did two
- 24:34Speaker 3: podcasts with Jim Jordan. We did two podcasts with James Comer.
- 24:39Speaker 3: Go listen to him, go assess it's a deep dive
- 24:42Speaker 3: where you can hear them analyze the issues. That's just
- 24:45Speaker 3: absurdly false. And then he says, oh, and the Democrats
- 24:49Speaker 3: are suck good lawyers. He points to Dan Goldman. Now,
- 24:52Speaker 3: Dan Goldman is the freshman congressman from New York who
- 24:56Speaker 3: we've talked about in this podcast before. He's quickly jumped
- 24:59Speaker 3: into the role of being Hunter Biden's lead lawyer in
- 25:03Speaker 3: the House of Representatives and really Joe Biden's lead lawyer
- 25:05Speaker 3: in the House of Representatives. And that's consistent because he's
- 25:08Speaker 3: incredibly wealthy, he's the heir of a massive fortune. But
- 25:13Speaker 3: he's been a Democrat staffer. He was a Democrat lawyer
- 25:17Speaker 3: on the Trump impeachment, which was utterly ludicrous to begin with.
- 25:21Speaker 3: And he's already shown he's willing to just lie. Whatever
- 25:24Speaker 3: the talking point is from the left, Dan Goldman will
- 25:27Speaker 3: repeat it. He will repeat it without a hesitance. And
- 25:29Speaker 3: he says, oh, people should be afraid. I got to say,
- 25:33Speaker 3: I don't know a lot of lawyers that would be
- 25:35Speaker 3: afraid of Dan Goldman, because it is a bad strategy
- 25:40Speaker 3: for a lawyer to lie a politician, sometimes you can
- 25:43Speaker 3: get away with it because politicians can speak in environments.
- 25:46Speaker 3: If you do like Dan Goldman does, and you go
- 25:48Speaker 3: on CNN and MSNBC, your lies are never challenged. You're
- 25:52Speaker 3: in front of a forum where the corrupt journalists interviewing
- 25:57Speaker 3: you also want to lie about the thing you're lying about,
- 26:00Speaker 3: so you can say things and face no challenge whatsoever.
- 26:04Speaker 3: But where I think Carville is most foolish is saying, gosh,
- 26:11Speaker 3: this is a great thing for Democrats to have these
- 26:15Speaker 3: impeachment hearings. Careful, braer rabbit, Careful what you asked to
- 26:19Speaker 3: be thrown into it is in this instance, Look, Carville
- 26:27Speaker 3: is beating his chest and trying.
- 26:29Speaker 8: To look tough.
- 26:31Speaker 3: But the evidence, which we've discussed at great length of
- 26:37Speaker 3: Joe Biden's corruption is very significant. James Carville does not
- 26:44Speaker 3: want the American people to hear that evidence. Now, if
- 26:48Speaker 3: they watch CNN, if they watch MSNBC, if they watch
- 26:51Speaker 3: ABC or NBC, they won't hear that evidence. But if
- 26:55Speaker 3: we have hearings and hearings that the American people pay
- 26:58Speaker 3: attention to, they will hear that evidence and things like
- 27:02Speaker 3: over one hundred suspicious activity reports, reports that banks filed
- 27:08Speaker 3: about what appeared to be money laundering by the Biden
- 27:11Speaker 3: family over twenty shell corporations, corporations that don't have employees,
- 27:15Speaker 3: that don't manufacture anything, that are not real companies, but
- 27:19Speaker 3: the only purpose of them it is to launder money.
- 27:24Speaker 3: Up to five thousand, four hundred emails from fake email
- 27:28Speaker 3: addresses from Joe Biden to Hunter Biden, many concerning Ukraine,
- 27:36Speaker 3: multiple burner phones by Joe Biden, the testimony of a
- 27:40Speaker 3: confidential informant who says Joe Biden and Hunter Biden personally
- 27:45Speaker 3: solicited and received millions of dollars of bribes from a
- 27:49Speaker 3: Ukrainian oligarch. The WhatsApp text message from Hunter threatening saying
- 27:54Speaker 3: I'm sitting here next to my father and if you
- 27:57Speaker 3: don't give me millions of dollars, my father is going
- 27:59Speaker 3: to retaliate again us. You That evidence, one after the
- 28:02Speaker 3: other after the other, is compelling, And the average American
- 28:07Speaker 3: who is watching the corrupt corporate media doesn't know any
- 28:11Speaker 3: of it. And so what Carvil is doing. Look in
- 28:15Speaker 3: Wednesday's podcast, we said the Democrat talking point is there's
- 28:18Speaker 3: no evidence. The more savvy people are saying, no direct evidence,
- 28:22Speaker 3: because everything I just cited is evidence, although most of
- 28:24Speaker 3: that is circumstantial evidence. Circumstantial evidence is powerful evidence on
- 28:30Speaker 3: which people are convicted of crimes every single day of
- 28:32Speaker 3: the year. But as we discussed in Wednesday's podcast, they're
- 28:35Speaker 3: at least two separate pieces of direct evidence. Number one,
- 28:38Speaker 3: the Hunter Biden text to the Chinese communist official threatening
- 28:42Speaker 3: retaliation from his father. That's direct evidence. And number two,
- 28:47Speaker 3: Joe Biden admitting on tape that he held a billion
- 28:52Speaker 3: dollars in US loan guarantees hostage to force the Ukrainian
- 28:58Speaker 3: government to fire the pro secutor who was investigating the
- 29:02Speaker 3: corrupt Ukrainian oligarch. That too, is direct evidence of one
- 29:06Speaker 3: of the critical elements of bribery. And so I got
- 29:08Speaker 3: to say, James Carvill, be careful what you wish for,
- 29:12Speaker 3: because if the American people hear this evidence, it stinks.
- 29:16Speaker 1: Yeah, it really does. I want to tell you about
- 29:18Speaker 1: my friends over at Chalk.
- 29:19Speaker 2: If you are a guy and you feel like you're
- 29:21Speaker 2: losing your edge, you feel like you've lost some of

- 29:27Speaker 2: Maybe you want to work out, but you just don't
- 29:29Speaker 2: have the energy. Maybe you want to be more active,
- 29:31Speaker 2: but you're just sitting on the couch too much. Well,
- 29:34Speaker 2: testostrum levels have dropped off a cliff historically. They're now

- 30:28Speaker 2: promo code Ben for thirty five percent off. Senator, I
- 30:31Speaker 2: also want to ask you about this. The White House
- 30:34Speaker 2: had a very interesting response and this is the third
- 30:39Speaker 2: change now in the goalposts for Joe Biden's involvement with
- 30:44Speaker 2: Hunter Biden's businesses. The first was they never spoke about business. Ever,
- 30:49Speaker 2: then they change it to he was never in business
- 30:53Speaker 2: with his son. That was the goalpost moving yet again.
- 30:57Speaker 2: Now the White House is Ian Sam came out and
- 31:00Speaker 2: moved the goalposts again when he said this.
- 31:04Speaker 14: The other allegations is the president was present at some
- 31:07Speaker 14: of the meetings between Hunter Biden and his business associates.
- 31:10Speaker 14: Why was the president at those meetings on those phone calls?
- 31:15Speaker 7: Well, again, I think this is part of the right
- 31:17Speaker 7: wing's misinformation machine to try to confuse people about what
- 31:21Speaker 7: the truth is. The truth is that the President, as
- 31:23Speaker 7: he has said publicly for years, calls his family every
- 31:28Speaker 7: day to check in. He calls his son every day
- 31:30Speaker 7: to check in. He calls his other family members to
- 31:32Speaker 7: check in to see how they're doing.
- 31:33Speaker 12: He loves them.
- 31:34Speaker 7: They're a tight knit family. And what the GOP's own
- 31:37Speaker 7: witness testified in this case is that that's exactly what
- 31:40Speaker 7: the President was doing. He was checking in with Hunter
- 31:43Speaker 7: during a particularly hard time. I might add a time
- 31:46Speaker 7: where the family was going through Hunter's brother Bo's illness,
- 31:51Speaker 7: and of course the President checks in with his son
- 31:53Speaker 7: and talks to them, but again that witness testified no
- 31:56Speaker 7: business dealings of Hunter Biden's or anyone's was discussed in
- 31:59Speaker 7: these conversations, and so again they're trying to make this
- 32:02Speaker 7: sort of strange connection when their own investigation has disproven
- 32:06Speaker 7: these claims.
- 32:08Speaker 14: Before I let you go in is the president response?
- 32:11Speaker 14: In terms of how the President has reacted to this,
- 32:14Speaker 14: especially as somebody who's been in politics and been at
- 32:16Speaker 14: Washington for as long as he has been, the idea
- 32:19Speaker 14: that he is now a subject to an impeachment inquiry
- 32:21Speaker 14: as president of the United States, what's his response to that.
- 32:24Speaker 7: You know, the President has been in politics for a
- 32:26Speaker 7: long time, and I think, as he would say, he's
- 32:28Speaker 7: seen a lot of malarkey along the way, but this
- 32:30Speaker 7: might take the cake. You know, he's focused on the
- 32:32Speaker 7: issues that actually matter to the American people. You just
- 32:34Speaker 7: saw him spending the last week traveling around the world,
- 32:37Speaker 7: shoring up our alliance as advancing national interests in Asia,
- 32:41Speaker 7: our economic interests in Asia, showing American leadership on the
- 32:45Speaker 7: world stage.
- 32:46Speaker 9: He's coming back here.
- 32:47Speaker 7: He's announcing today a quarter billion dollar investment in cancer research,
- 32:51Speaker 7: try to finally cure cancer. That's what his administration and
- 32:54Speaker 7: this president is focused on every day. They're focused on
- 32:56Speaker 7: the actual needs of the American people. And I think
- 32:59Speaker 7: what he would say is maybe the House Republicans should
- 33:02Speaker 7: join him.
- 33:03Speaker 2: There's the pardon there where he says that Joe Biden
- 33:07Speaker 2: attended Hunter's business meetings because he loves him. That's the
- 33:11Speaker 2: new goalpost that they just moved significantly from they never
- 33:14Speaker 2: talked about business to then well they never work together.
- 33:17Speaker 2: Now it's well, he just went to the business meetings
- 33:19Speaker 2: because he loves him.
- 33:20Speaker 1: Really, that's the new excuse.
- 33:23Speaker 3: Well, look, I mean, what good and loving and devoted
- 33:27Speaker 3: father hasn't called in twenty times to his son's meeting
- 33:32Speaker 3: with corrupt oligarchs who are paying millions of dollars in
- 33:37Speaker 3: exchange for favors from that father while he's sitting and
- 33:41Speaker 3: serving as the vice president of the United States. I mean,
- 33:43Speaker 3: that's really just what any good dad would do.
- 33:46Speaker 1: I mean, it really is.
- 33:49Speaker 3: It's cynical because they point out that Joe's other son
- 33:54Speaker 3: tragically died of cancer, so they want to wrap it
- 33:56Speaker 3: in the sympathy of a human tragedy. To say, well,
- 34:01Speaker 3: of course, you know, listen, why was Hunter getting paid
- 34:08Speaker 3: the millions of dollars? I didn't hear him say a
- 34:12Speaker 3: word about that. There's no value Hunter provides. What was
- 34:16Speaker 3: the value Hunter brought? You know, Ben, you're a talented guy,
- 34:21Speaker 3: You're a charming guy. Are there any foreign ola garks
- 34:25Speaker 3: calling you up saying Ben, I want to wire millions
- 34:27Speaker 3: of dollars to you.
- 34:29Speaker 1: Zero, That's not all you know.
- 34:32Speaker 3: They don't do that to anybody. They only do it
- 34:36Speaker 3: if you were providing value. And what all of these
- 34:41Speaker 3: talking heads, what all of these democrat hacks are saying,
- 34:45Speaker 3: what all of the corporate media puppets are refusing to answer,
- 34:49Speaker 3: is is what did Hunter get in exchange for the
- 34:54Speaker 3: tens of millions of dollars? And according to the House
- 34:56Speaker 3: it could be north of twenty thirty million dollars. We're
- 34:59Speaker 3: talking massive amounts of money. And by the way, not
- 35:04Speaker 3: money from you know, normal American companies, not money from
- 35:09Speaker 3: our friends and allies. It wasn't money from France, it
- 35:12Speaker 3: wasn't money from Italy, it wasn't money from the United Kingdom,
- 35:15Speaker 3: it wasn't money from Japan. It was money from China, Russia, Ukraine.
- 35:24Speaker 3: They singled out nations with very significant antagonism and hostility
- 35:34Speaker 3: to America and some of the most corrupt nations on Earth.
- 35:39Speaker 3: And there is no innocent explanation. By the way, you
- 35:43Speaker 3: don't hear any of these Democrats explaining why did Joe
- 35:45Speaker 3: Biden have multiple book burner phones, Why did he have
- 35:47Speaker 3: fake emails? Why did he use fake emails to send
- 35:51Speaker 3: emails to his son Hunter about Ukraine on government email
- 35:56Speaker 3: while Hunter was getting paid millions of dollars. All of
- 36:00Speaker 3: that the Democrats want you to ignore and say, well, gosh,
- 36:05Speaker 3: Joe's just a loving dad, and that's what loving dads do.
- 36:09Speaker 3: They help their sons make thirty million dollars from corrupt
- 36:13Speaker 3: oligarchs who are enemies of America.
- 36:15Speaker 2: So there was a montage that we played of Joe
- 36:18Speaker 2: Biden and the lies that had been told by him
- 36:22Speaker 2: as team others in the media.
- 36:24Speaker 1: It went viral several weeks ago. I think it's.
- 36:26Speaker 2: Important that we remind people and if you miss this
- 36:29Speaker 2: or you were looking for this audio, that's why I
- 36:32Speaker 2: want to play it for you again because it's so damning,
- 36:35Speaker 2: especially as we move forward to impeachment. Before I do that,
- 36:38Speaker 2: I want to tell you though about our friends at
- 36:39Speaker 2: Patriot Mobile. For ten years, Patriot Mobile has been America's
- 36:43Speaker 2: only Christian conservative wireless provider. And when I say only
- 36:47Speaker 2: trust me, they're the only one. The team over there
- 36:49Speaker 2: are amazing because not only do they take your dollars
- 36:52Speaker 2: when you pay your bill every month, but when you
- 36:55Speaker 2: pay your bill, you're actually supporting causes that you stand
- 37:00Speaker 2: up for. We're talking about freedom of speech, really, the
- 37:04Speaker 2: sanctity of life, the Second Amendment, are military veterans, first responders.
- 37:08Speaker 2: Now you get nationwide coverage, dependable nationwide coverage, and they
- 37:14Speaker 2: give you access to all three major networks, which means
- 37:17Speaker 2: you get the same coverage you've been accustomed to without
- 37:19Speaker 2: funding the left. You may not realize that Big Mobile
- 37:22Speaker 2: many of them actually give huge checks to Planned Parenthood.
- 37:26Speaker 2: That is why you need to switch to Patriot Mobile.
- 37:29Speaker 2: They have one hundred percent US based customer service team
- 37:31Speaker 2: and that makes switching easy. Keep your number that you
- 37:35Speaker 2: have right now, your same cell phone number, keep your
