Latest / Palafox Media Network / Political Matrix News: Judges Lack Enforcement Power
Transcript
- Mike Bates: Well, the dirty little secret is, judges have no ability to enforce a contempt ruling either. Who enforces a contempt ruling? Well, in the federal courts, it's the US Marshals. So if the US Marshals simply refuse to arrest the person who was found in contempt of court, well, guess what? That person ain't going to, you know, going to jail for contempt of court. And if the DOJ refuses to prosecute, well, that's not happening either. Greg Fink: Exactly. Mike Bates: But I'll tell you where the judges do have the authority. And that is because if a US Marshal were to refuse an arrest order from a judge, the judge can't make him do it. But the judge does have the authority to ban him from his courthouse. if you are a federal marshal who is assigned to a US courthouse and the judge bans you and you're not allowed in, well, guess what? It's not that you're out of a job necessarily, but your job might now be that you go to nowhere in North Dakota and you're enforcing some terrible duty station. they have power in that regard. But the judiciary has no enforcement power whatsoever. And somebody needs to call them out on that and say, you're out of line, Your Honor. We ain't doing that. Greg Fink: Can't go in.
