County, developer seek dismissal of data center referendum lawsuit
Box Elder County and O’Leary Digital have asked a judge to dismiss a lawsuit brought by six residents seeking to overturn the county’s rejection of two proposed referendums involving the Stratos data center project. In motions filed July 30 and 31 in First District Court, the county and O’Leary Digital argue that the two actions approved by the Box Elder County Commission at the May 4 meeting implemented existing state law and were administrative, rather than legislative, decisions.
